Eagle Scout service project for the town of Hardwood. Now therefore, we the Hardwood Select Board on behalf of the town of Hardwood do hereby present this gesture of gratitude with great admiration.
Thank you very >> Do you want to tell the board a little bit about what you did? Yeah. So, um the funds that I worked on project took around a year to complete once we had gotten the idea for it. Um it's a key it's aformational kiosk uh located past the train tracks on the rail trail over
There and it's um it's right next to a mural that was painted on um the fence of displaying history of the town. Um I was able to do this with the help of Miss Kiano and Miss Bon. She helped me put it together and um get this installed. I uh to build the project, I
Had the help of the DPW come and um give me the materials and helped me like like locate the materials that I needed. And then I had my troop come to my house and we worked on building the uh kiosk and put it all together. And then later on we came we installed it um in the ground
Past the train track. So >> yeah.
Thank you. Thank you very much.
Mr. Chair.
>> Yes, ma'am.
>> Um, I would like to thank Ben. Um, he is an outstanding young man, worthy of being an Eagle Scout, as I know, we're a big scouting family, and he did a great job. Um, this will be a very useful kiosk that is right next to this mural that we have done about the history of Harvick. is on a stocking fence um which
Depicts different scenes of the history carpet from actually uh Native American time to present day and uh we're still a work in progress but we're getting there but right now it has the ecoourism map on it. Um I don't know if you saw it recently that it's posted there but we're also going to use that for
Information about uh the mural and about the rail trail but it's right across from the hardware of pizza this end of the rail trail. So, um it's very useful and we found a place for it and he also made a bench which we did in that day you did mention that they're going to put the bench farther down the rail
Trail um to over so people can sit and enjoy the the river. So, thank you very much. We really appreciate it.
>> Thank you, sir. Thank you.
>> Okay. discussion and vote on special event for the Hardick Fair August 15th and 16th.
>> Mr. Chair, you going back to business comments?
>> Excuse me.
>> Are you going back to vis comments?
>> I'll go back to visit the comments.
Thank you.
You want to Lisa like to say something?
>> Um, >> come to the fair. It's an incredible volunteer effort. I cannot tell you.
Hundreds and hundreds of volunteers, thousands of volunteer hours. It's I get choked up on Friday night every year to see the community come together.
It's worth the year's worth of work.
Please make a motion to approve the special event uh application for the hardwood fair on uh August 15th and 16th. I'll second it. All >> in favor?
>> I >> Okay. Um, visitor comments.
>> Yes, ma'am.
>> When we lost power Friday night, we again lost water in Hardwork Center. And I thought there was a backup.
>> U supposed to be a backup generator, right? Supposed to kick in.
>> Um, at 11:00 when the power came on, there was still drizzle of water coming out of the faucet. But at 6:30 when I got out, there was no water. And so you call dispatch and they call Marty and he has to come do something. But
>> yeah, it's no good. I'm sorry.
So who who is the >> who who would be responsible for getting that >> the generator >> generator district >> I probably would call Marty first.
>> Okay.
We have a couple of them >> later.
I'll start with him.
Follow his.
>> Anybody else? Anything?
>> Should I come up with >> please?
And was very nervous at his eagle board for the first few minutes and he was good after that. He did really well.
Smile.
Fire truck. So you guys know the process or I don't know if you do. So the governor had filed the bill. Took her a few weeks to do that because the governor has to file those bills.
The holdup was the house and the senate for the past two year terms. We haven't had joint rules. So we've been working off joint rules from six years ago. So until they came to a consensus on joint rules, no bills were reported out of
Committee. So, usually those go out pretty quick, stuff like that. Um, those usually go out quicker than like sick leave banks or there's some, you know, typically a little bit of research they have to do on those. Um, so that was as soon as it came, we accepted joint rules that came out of committee like a week
Later and then went through the house went to third reading through third reading in two days and the house got voted on. Now it sits in the Senate.
It's the third reading. So that's the last place before the floor of the Senate. And then once it's done there, it gets enacted and the governor signs it. She usually signs it within a day or two. So as soon as she signs it, there's an emergency preamble law. So it's effective right away.
>> So maybe in a few weeks.
>> I I I mean I talked to Peter today. We talked to I just left Peter's house and he said usually something like that comes out very quick. So he said probably a week or two, which would be good.
That would be good. The problem with problem the house and senate don't get along. So like if we have a sick if I do a sickly event for you. So the in judiciary they'll do all the research and how much time you have left and all the vacation time
Gets passed and it goes to Senate. Well they do it all again instead of just taking the houses for it and vice versa from Texas. So but there's really not much research on this. just a down fix. So, >> and it's just the the legislature agreeing that we have the right to
Borrow the money.
>> Uh, no. No. So, what it does is because you were off a couple days. Um, you you have the right to borrow the money. Just because you were off a couple days in town, you you need that whatever how many days?
>> So, um, yes. So, in order to it's we can't get our green light letter from our bond council. So, what this is essentially doing is it's our green light letter from the state of Massachusetts that says we can go ahead and borrow the money. So, we've already set up everything with bond council.
We're all ready to go. We're literally just waiting on the legislature to do what they need to do so we can move forward with that essential green light letter that we're getting from the Commonwealth.
>> We're getting a lot of comments.
>> I know. I know. And yours was the most popular when I was getting phone calls on the East Brookfield water. No, nobody cares about >> trying to come up with something else.
>> Yeah. Yeah. Yeah.
>> Well, thanks.
>> Yeah. She calls me like 72 times a week.
Check on.
>> I'm thinking of changing my phone.
>> Oh my god.
>> Yeah. I'll keep you updated.
>> Okay. Thank you very much.
>> It's my job. Does anybody have any sticky questions for the representative?
>> Well, you got him here. All [Music] >> he was here already today.
>> Yeah, I did office hours with Donna this month. Nobody came. Nobody came here.
Nobody came to West Brookfield. Nobody came.
[Music] >> She told me she's so busy all the time.
I didn't see anybody.
>> Unfortunately, people were working during the day.
>> Yeah. Right. Right.
Thanks for trying. Yeah, we do our best.
>> Okay.
Appointments conservation commission.
Pretty straightforward. Make a motion.
>> Yes.
>> Yeah.
>> I move that the select board reappoint William Zinny and Dr. Danielle Halen to the conservation committee for a three-year terms expiring June 30th, 2028 and appoint Marjgerie L. Baxter as secretary clerk to the conservation committee for a one-year term expiring
June 30th, 2026.
>> I'll second that, >> Mr. Chair. Um, we technically don't have to appoint um Peggy because she's at will. Um, but Bill and Neil Yes, it >> was in the packet. I know she that's she included it in her letter.
>> it's moved.
>> It's moved. Yeah.
>> So, all in favor?
>> I I thank you.
>> Thank you.
>> Appointment of wastewater treatment plant operator James Leair.
>> He's not here, is it?
>> Nope. Um so the wastewater treatment plant superintendent and myself interviewed two candidates um and we selected Jim um at the recommendation of the superintendent. He's already started and he's been working out great so far.
A very positive attitude. Selecting Tanker actually got a chance to meet him.
>> Very nice guy and his career on stay as long as possible.
>> Good references and background check worked out.
I'll uh make a motion to appoint James Bear to uh recreation facility supervisor.
>> No, it's wastewater.
>> I'm sorry. I'm working with that.
>> Okay, I'll second the motion.
>> Okay, all in favor.
>> Let's seek a motion to appoint assistant treasurer collector Felix Diko.
[Music] He yes he accepted the position. He is aimed to start on the 19th. I'm just waiting back from his quarry form. I did check his references. They were great.
So next up would be his quy check, but he with pending everything successfully.
He starts the 19th. We interviewed five candidates for the position. This is the candidate that um the treasure collector uh like the best out of the five that we interviewed. The assessor was also on the interview panel. Okay.
So I move that the select board appointed as assistant treasurer/collector for the time >> and then move cor.
>> I'll second that. All >> in favor?
>> I discussion and vote on tree bid award for the cemetery commission. Yes, ma'am.
So the cemetery went out we did um is to remove eight trees between the upper cemetery and the common and six tree stumps between the upper cemetery and the common. We received five bids.
The lowest bid was 12,500. The highest bid was 22,000 500. The lowest bid was from Timber Tiger Isaac Camp um who is doing >> we can hear right now right now and
Heard us good things about him.
>> Yeah.
>> So the cemetery commission um met on July 29th and we um made a motion to recommend to the board selectman to award the bid to Isaac Camp for $12,500.
>> Okay. Do you have the money in your >> The money is in the cemetery account, right?
>> Okay. Make a motion.
>> I move that the selector move the contract to Tiger Timber for tree work and stump removal at the upper cemetery and hardwood common awarding the work to the lowest eligible build bidder in the amount of $12,500.
>> I'll second. All >> in favor? I >> thank you gentlemen.
>> Thank you.
>> Uh discussion and vote on fiscal year 20126 fuel bids.
I believe we have one for each in front of us.
>> Yep. You'll see um RJ McDonald for diesel, EPY for propane, and um Burke for gasoline.
Okay. Um, so we went out to bid. Didn't really get a lot of um really didn't get a lot of bids. Um, one of them came in after the deadline. We didn't get anyone for gasoline. So, the gasoline is actually off to the state bid list.
The other two u met the requirements of the bid and wine for the propane and RJ McDonald for the diesel.
>> Mhm. And how do these rates compare with what we had previously?
>> It's almost exactly the same according to our highway superintendent.
>> Okay.
So, uh I'll make a motion to accept RJ McDonald for the uh diesel fuel EP for the propane and Dennis K. Burke incorporated for the gas emitted.
>> I'll second the motion. All in favor?
>> I I >> Okay. Approval of minutes for May 12th, 2025.
Yes.
Read them. No, you're not kidding.
They already Okay.
>> Okay. No issues with them.
>> So, you want to make a motion or >> Yeah, I'll make a motion to approve them. Is it May 11th?
>> May 12th.
>> May 12th uh meeting minutes.
>> Okay. I'll uh second in >> favor.
Town administrator report.
[Music] the trees behind town hall are currently being removed as you all can hear.
We actually decided to not go ahead with a dumpster removing the stuff from the basement.
It just wasn't going to be possible given the time constraints and the remediation that would have to be done prior to um removing all the material on that side of the basement. you have to do some mold and asbestous removal that would just bring our cost so we just couldn't go ahead with that. Um, so
Distance actually had been an issue. We had been searching for a service contract for a new copier. It wasn't finding a copier, it was a service contract. So I actually reached out to my colleagues on the small town administrator listerve and got um a couple local places. So, I received two
Quotes. Um, trying to I want to get some feedback from staff that also use it before I pull the trigger, but we're down to two. So, hopefully by tomorrow, we'll be going ahead and pulling the trigger on a new service contract to go with our new copier. Um, the Harvard pump station is officially online.
[Music] I had a call with the cure attorney and our attorney on the solar lease before it goes back to the select board.
There was just some they just went through line by line exactly what our town council had as an issue and what they were going to do to change it. I don't know where they are beyond that, but so that is going to be coming to the select board. If not the next meeting, I'm going to assume in September. So
That's very soon to be to being done.
Just to give you guys an update.
Working on the procurement documents for the townhouse grant.
Working with the town accountant and the treasurer on town pec cards which is a purchase card.
Held our bi-weekly financial management planning zoom. I met with the finance committee chair on ongoing financial issues.
Had a zoom meeting with the treasure collector in the office of veteran affairs on the financial issues related to our veterans benefits.
So, we're working with every area of our finances, cleaning up and making sure that we're doing it the right way and we're getting the right reimbursement and we're giving the right benefits to our veterans and right benefits to our employees. And just we're going through everything. We're combing through
Everything line by line. We're advertising for a wastewater treatment plant operator, a highway equipment operator, a town accountant, a police officer, and a van driver.
We received another resignation for a wastewater treatment plant operator. So that's why even though you appointed one tonight, we still have it advertised.
We're still looking for another one.
Cuz John Paul's last day was today.
>> We made an I made.
>> I know. I know. It's just >> um Did you say why?
>> More money, no weekends, and no holidays.
>> I thought the hours might have something to do with it. Um today we held two interviews for a town accountant with the treasur collector member of the finance committee and selectman tinker.
So the next step of that process is I'll be doing a reference check this week on the two candidates that we interviewed today and then following back up with the group and going from there. I met with the planning board chair on an ethics issue. I had a call with town council on various complaints. Attended
A Massachusetts Municipal Managers Association programming committee meeting because I serve on that committee.
So what we do is when we have various meetings across the state um I'm on the committee that picks the programming for that facilitated a zoom uh with for the hydraologist presentation at the last health meeting. I attended national night out at Quadum Regional High School
Attended the planning board public hearing on the um new dorm for Eagle Hill.
So for recognition, I want to recognize Detective Armstrong, Officer Herbado, Chief Landine, Lorie Hoffman from the police department, Chief Josh Peas from the fire department, Tessa Gurnie and their staff for another successful national night out. I only stayed for
The first hour. It seemed like a better turnout than last year because the weather was better, but they did a great job and I really didn't have to be there, but I was happy to be there.
Important dates. We have a public records law training at Eagle Hill School on August 18th from 4:00 to 6 for all staff and elected officials. So the town hall municipal office building will be closed for that 2 hours so the staff can attend the training.
Part of fair is August 15th and 16th. I will be there and then just my um vacation in September and that's all I have.
>> When when are you not here? I leave September 1st, but I that's a holiday.
So, I'll be gone the uh 2nd through the 10th. So, we'll be back the Thursday before your September meeting.
So, I won't have a town administrator report for that meeting because I won't have anybody.
>> Okay.
Mr. Chair. Yes, sir. Um is there a reason why I was excluded from the solar page solar conversation? Not that I know. last time we met they expressed interest in being that conversation. So I'm wondering why it was executed
Wasn't included either face >> coming back to the select board. There was no decisions made. It was just the two attorneys and me as a representative for the town and the representative from CARES were on it. But there was nothing.
We didn't I didn't do anything. It was just I was on it so that I could report back to you what was done and give you guys an update. So again, either the next meeting or the meeting in September, it's going back before you.
This is really I didn't do anything.
>> Do you feel that you wanted to be involved in that?
>> I I expressed we agreed as a board that I'd be involved.
>> Yep. All right. Well, >> and I sent an email on it to, you know, follow up and say, make sure I'm included in this There was nothing. I didn't do anything.
I just they two attorneys were talking which you heard from the attorney that he was going to do.
>> And I also requested the that digital file.
>> I don't have a file.
>> You don't have the digital file of the contract or what they went over.
>> I just have the one that you saw at the last meeting which you have a copy of if you like it electronically.
>> Yeah. Electron digital.
>> Oh, I can do that.
>> And I sent that with the email.
>> There's something about a file. I don't have a file. I just have the same contract that you have that you were handed out to.
>> I'm looking for town council's contract with comments line items so I can go over it and review it.
>> But you already have it. If you'd like electronically, I can electronically.
>> Okay, I can do that.
>> All right. Am I going to be included in this or excluded? Who's deciding? It's coming back to the board in two weeks or the >> Is there another is there another session of deliberation?
>> No, >> it's just between the lawyers.
>> Yes.
>> Can't go back.
Okay. So, this is how it's going to be or no.
>> Well, is this going to be standard operating procedure?
When we make a decision as a board and then we get excluded by the town administrator.
>> You might you might have to kind of >> go to the town administrator.
>> Yeah. I sent you an email and copied her >> and you know so I could you know schedule this property so I'm doing everything on my behalf but I have no control if somebody just excludes me.
>> Well I'm not excluding you.
You were copied.
>> I was copied. I get a lot of emails.
>> Yeah, I know.
>> I get a lot of emails from you.
>> I know, >> right? I try to keep up with them.
>> Okay.
>> All right. Please do.
Good.
All right. Now, we're in selectman round table. Do you want to start?
>> Sure. I would like to recognize Lisa Cohen and all the volunteers for the hard work community fair and this, you know, tremendous time and effort that it takes to put this together. And I'd just like to say thank you to everyone involved.
>> Thank you very much. It is a cast of thousands.
>> Yep.
>> It isn't funny.
>> I don't have anything.
>> Nothing. Nothing.
>> Nothing. Okay. All right. uh as uh EMD, I'd like to say that I got my reimbursement documentation into MIMA and the town will get reimbursed for the money that I spent for the big generator out back and uh some equipment for the
Highway department Bluetooth communicators so that they can Marty can be up in the bucket and talk to somebody on the ground.
And uh, Wednesday I get together with uh, board of health chair and uh, Colleen Muhan, superintendent of the schools to talk about where to put a 40ft, you know, shipping container so that we have a place to move all the emergency gear out
Of the white building preppy and getting ready to somehow sell the white building. So, first step is to move Tens of thousands of masks and gloves and thermometers and all sorts of stuff.
Here we go. Yes, ma'am.
>> Um, in in that vein, the AED in the townhouse is beeping like a smoke detector. That's unhappy. And >> well, I'm sure you can find a a trained professional medical person.
>> Maybe one I'm sitting next to. I'll look at it tomorrow. I'm not >> It says it's alarmed. Is it alarm?
>> Oh, did somebody open the door?
>> If you opened it up, >> it's an alarmed cabinet. So, it probably needs the alarm reset.
>> Well, I don't I don't know if anybody open the door, but it is a lot more.
>> Well, those cases just call to you to open them up before.
I can I will get more batteries, but if it hasn't been used, >> the batteries have officially a 2 to three year lifespan. The pads usually have to be replaced at that point, right?
>> Also, cuz the gel gets dry. So, I will look at the dates tomorrow.
>> Look at the dates and let me know and there'll be I have some money in my expensive account.
>> Okay.
>> All right. Good. Thank you.
And all we have now is an executive session.
Are you interested in having it closed or open? Um yeah, I do not consent to executive session. This matter must be heard in open session.
And accent, you know, for the record, this is the third time it's been brought forward without written complaint, without supporting documentation, without witnesses statements, or a third party investigation advised by town council.
>> Okay.
Ma'am, you have a comment.
[Music] just going to vote on a a third party to come in. That's fine.
But if not, I would prefer an executive session. If it's going to be more of a discussion cuz if it's going to be, I will see the council on my own.
>> Are you do you want to have the executive session?
You don't want to have it closed. if you want to have it over. That's what I've said.
So, there there's no uh agreement here.
What I'd like to do is seek a motion to hire a mediator on advice of town council.
Oh, so she doesn't need super mediator at this point when there's no investigation and no formal complaint.
>> The investigation can't be h I can't do that legally. I can't run an investigation. Excuse me. Let me finish.
>> Okay.
>> This is the way we can go. As far as town council says, >> all town council also says and have an investigation for >> says I can't run an investigation neutral. So who just >> that's what I'm talking about when you said this is not
>> okay fine this is an investigator using a different word >> this is what we're I've been waiting for to bust this log jam loose >> okay >> so I need a vote majority vote select >> I just made the motion >> okay I'll second >> all in favor I
>> I Okay thank Thank you.
>> And that closes our little meeting.
Thank you very much. We'll make a motion toend that motion.
>> Okay. All in favor?
>> I it wasn't enough. The first year I was I didn't know about IR. So I'm like, "Oh, we'll go Saturday." My son was like time. So we go Saturday. I thought there
Might be a hamburg.

And so you [00:04:13] call dispatch and they call Marty and he [00:04:16] has to come do something. But [00:04:19] >> yeah, it's no good. I'm sorry. [00:04:26] So who who is the uh [00:04:31] >> who who would be responsible for getting [00:04:33] that [00:04:34] >> the generator [00:04:34] >> generator district [00:04:36] >> I probably would call Marty first. [00:04:39] >> Okay. [00:04:41] We have a couple of them [00:04:46] >> later. [00:04:48] I'll start with him. [00:04:51] Follow his. [00:04:56] >> Anybody else? Anything? [00:05:01] >> Should I come up with [00:05:03] >> please? [00:05:08] And was very nervous at his eagle board [00:05:09] for the first few minutes and he was [00:05:11] good after that. He did really well. [00:05:13] Smile. [00:05:15] Um fire truck. So [00:05:18] you guys know the process or I don't [00:05:19] know if you do. So the governor had [00:05:21] filed the bill. Took her a few weeks to [00:05:23] do that because the governor has to file [00:05:24] those bills. [00:05:26] The holdup was the house and the senate [00:05:29] for the past two year terms. We haven't [00:05:33] had joint rules. So we've been working [00:05:34] off joint rules from six years ago. So [00:05:38] until they came to a consensus on joint [00:05:41] rules, no bills were reported out of [00:05:44] committee. So, usually those go out [00:05:45] pretty quick, stuff like that. Um, those [00:05:47] usually go out quicker than like sick [00:05:49] leave banks or there's some, you know, [00:05:51] typically a little bit of research they [00:05:53] have to do on those. Um, so that was as [00:05:57] soon as it came, we accepted joint rules [00:05:59] that came out of committee like a week [00:06:01] later and then went through the house [00:06:04] went to third reading through third [00:06:06] reading in two days and the house got [00:06:07] voted on. Now it sits in the Senate. [00:06:09] It's the third reading. So that's the [00:06:11] last place before the floor of the [00:06:12] Senate. And then once it's done there, [00:06:14] it gets enacted and the governor signs [00:06:16] it. She usually signs it within a day or [00:06:18] two. So as soon as she signs it, there's [00:06:20] an emergency preamble law. So it's [00:06:22] effective right away. [00:06:24] >> So maybe in a few weeks. [00:06:26] >> I I I mean I talked to Peter today. We [00:06:29] talked to I just left Peter's house and [00:06:31] he said usually something like that [00:06:32] comes out very quick. So he said [00:06:34] probably a week or two, which would be [00:06:36] good. [00:06:37] That would be good. The problem with [00:06:39] problem the house and senate don't get [00:06:41] along. So like if we have a sick if I do [00:06:44] a sickly event for you. So the [00:06:48] in judiciary they'll do all the research [00:06:52] and how much time you have left and all [00:06:54] the vacation time [00:06:56] gets passed and it goes to Senate. Well [00:06:57] they do it all again instead of just [00:06:59] taking the houses for it and vice versa [00:07:01] from Texas. So but there's really not [00:07:04] much research on this. just a down [00:07:08] fix. So, [00:07:10] >> and it's just the the legislature [00:07:13] agreeing that we have the right to [00:07:14] borrow the money. [00:07:16] >> Uh, no. No. So, what it does is because [00:07:18] you were off a couple days. Um, you you [00:07:22] have the right to borrow the money. Just [00:07:23] because you were off a couple days in [00:07:24] town, you you need that whatever how [00:07:27] many days? [00:07:28] >> So, um, yes. So, in order to it's we [00:07:31] can't get our green light letter from [00:07:32] our bond council. So, what this is [00:07:34] essentially doing is it's our green [00:07:36] light letter from the state of [00:07:37] Massachusetts that says we can go ahead [00:07:38] and borrow the money. So, we've already [00:07:40] set up everything with bond council. [00:07:42] We're all ready to go. We're literally [00:07:43] just waiting on the legislature to do [00:07:46] what they need to do so we can move [00:07:47] forward with that essential green light [00:07:49] letter that we're getting from the [00:07:50] Commonwealth. [00:07:51] >> We're getting a lot of comments. [00:07:53] >> I know. I know. And yours was the most [00:07:56] popular when I was getting phone calls [00:07:58] on the East Brookfield water. No, nobody [00:08:00] cares about [00:08:03] >> trying to come up with something else. [00:08:05] >> Yeah. Yeah. Yeah. [00:08:06] >> Well, thanks. [00:08:08] >> Yeah. She calls me like 72 times a week. [00:08:10] Check on. [00:08:12] >> I'm thinking of changing my phone. [00:08:14] >> Oh my god. [00:08:16] >> Yeah. I'll keep you updated. [00:08:19] >> Okay. Thank you very much. [00:08:20] >> It's my job. Does anybody have any uh uh [00:08:24] sticky questions for the representative? [00:08:28] >> Well, you got him here. All [00:08:31] [Music] [00:08:34] >> he was here already today. [00:08:35] >> Yeah, I did office hours with Donna this [00:08:36] month. Nobody came. Nobody came here. [00:08:38] Nobody came to West Brookfield. Nobody [00:08:40] came. [00:08:41] [Music] [00:08:43] >> She told me she's so busy all the time. [00:08:44] I didn't see anybody. [00:08:46] >> Unfortunately, people were working [00:08:47] during the day. [00:08:48] >> Yeah. Right. Right. [00:08:50] Thanks for trying. Yeah, we do our best. [00:08:56] >> Okay. [00:08:59] Appointments conservation commission. [00:09:07] Pretty straightforward. Make a motion. [00:09:09] >> Yes. [00:09:11] >> Yeah. [00:09:12] >> I move that the select board reappoint [00:09:14] William Zinny and Dr. Danielle Halen to [00:09:17] the conservation committee for a [00:09:19] three-year terms expiring June 30th, [00:09:21] 2028 [00:09:23] and appoint Marjgerie L. Baxter as [00:09:26] secretary clerk to the conservation [00:09:28] committee for a one-year term expiring [00:09:30] June 30th, 2026. [00:09:32] >> I'll second that, [00:09:34] >> Mr. Chair. Um, we technically don't have [00:09:38] to appoint um Peggy because she's at [00:09:40] will. Um, but Bill and Neil Yes, it [00:09:44] >> was in the packet. I know she that's she [00:09:46] included it in her letter. Um [00:09:48] >> it's moved. [00:09:49] >> It's moved. Yeah. [00:09:50] >> So, all in favor? [00:09:53] >> I I thank you. [00:09:56] >> Thank you. [00:09:59] >> Appointment of wastewater treatment [00:10:01] plant operator James Leair. [00:10:06] >> He's not here, is it? [00:10:07] >> Nope. Um so the wastewater treatment [00:10:10] plant superintendent and myself [00:10:12] interviewed two candidates um and we [00:10:16] selected Jim um at the recommendation of [00:10:19] the superintendent. He's already started [00:10:21] and he's been working out great so far. [00:10:22] A very positive attitude. Selecting [00:10:24] Tanker actually got a chance to meet [00:10:25] him. [00:10:26] >> Very nice guy and his career on [00:10:30] stay as long as possible. [00:10:33] >> Good references and background check [00:10:35] worked out. [00:10:37] I'll uh make a motion to appoint James [00:10:40] Bear to uh recreation facility [00:10:44] supervisor. [00:10:46] >> No, it's wastewater. [00:10:49] >> I'm sorry. I'm working with that. [00:10:51] >> Okay, I'll second the motion. [00:10:53] >> Okay, all in favor. [00:10:59] >> Let's seek a motion to appoint assistant [00:11:02] treasurer collector Felix [00:11:04] Diko. [00:11:06] [Music] [00:11:07] He yes he accepted the position. He is [00:11:10] aimed to start on the 19th. I'm just [00:11:12] waiting back from his quarry form. I did [00:11:15] check his references. They were great. [00:11:16] So next up would be his quy check, but [00:11:18] he with pending everything successfully. [00:11:21] Um he starts the 19th. We interviewed [00:11:23] five candidates for the position. This [00:11:25] is the candidate that um the treasure [00:11:27] collector uh like the best out of the [00:11:30] five that we interviewed. The assessor [00:11:31] was also on the interview panel. Okay. [00:11:36] So I move that the select board [00:11:38] appointed [00:11:40] as assistant treasurer/collector [00:11:43] for the time [00:11:44] >> and then move cor. [00:11:47] >> I'll second that. All [00:11:49] >> in favor? [00:11:50] >> I [00:11:53] discussion and vote on tree bid award [00:11:55] for the cemetery commission. Yes, ma'am. [00:11:59] Um so the cemetery went out we did um is [00:12:03] to remove [00:12:05] eight trees between the upper cemetery [00:12:08] and the common and six tree stumps [00:12:12] between the upper cemetery [00:12:14] and the common. We received five bids. [00:12:18] Um the lowest bid was 12,500. The [00:12:21] highest bid was 22,000 [00:12:25] 500. The lowest bid was from Timber [00:12:28] Tiger Isaac [00:12:32] Camp um who is doing [00:12:34] >> we can hear right now right now and um [00:12:39] heard us good things about him. [00:12:41] >> Yeah. [00:12:41] >> So the cemetery commission um met on [00:12:44] July 29th and we um made a motion to [00:12:48] recommend to the board selectman to [00:12:50] award the bid to Isaac Camp for $12,500. [00:12:55] >> Okay. Do you have the money in your [00:12:57] >> The money is in the cemetery account, [00:12:59] right? [00:13:01] >> Okay. Make a motion. [00:13:03] >> I move that the selector move the [00:13:05] contract to Tiger Timber for tree work [00:13:07] and stump removal at the upper cemetery [00:13:10] and hardwood common awarding the work to [00:13:13] the lowest eligible build bidder in the [00:13:15] amount of $12,500. [00:13:17] >> I'll second. All [00:13:18] >> in favor? I [00:13:20] >> thank you gentlemen. [00:13:22] >> Thank you. [00:13:25] >> Uh discussion and vote on fiscal year [00:13:27] 20126 [00:13:30] fuel bids. [00:13:33] I believe we have one for each in front [00:13:36] of us. [00:13:37] >> Yep. You'll see um RJ McDonald for [00:13:40] diesel, EPY for propane, and um Burke [00:13:43] for gasoline. [00:13:47] Okay. Um, [00:13:50] so we went out to bid. Didn't really get [00:13:51] a lot of um really didn't get a lot of [00:13:54] bids. Um, one of them came in after the [00:13:57] deadline. We didn't get anyone for [00:13:59] gasoline. So, the gasoline is actually [00:14:00] off to the state bid list. [00:14:04] The other two u met the requirements of [00:14:06] the bid [00:14:08] and wine for the propane and RJ McDonald [00:14:11] for the diesel. [00:14:12] >> Mhm. And how do these rates compare with [00:14:16] what we had previously? [00:14:18] >> It's almost exactly the same according [00:14:20] to our highway superintendent. [00:14:23] >> Okay. [00:14:25] So, uh I'll make a motion to accept uh [00:14:29] RJ McDonald for the uh diesel fuel EP [00:14:34] for the propane and Dennis K. Burke [00:14:37] incorporated for the gas emitted. [00:14:39] >> I'll second the motion. All in favor? [00:14:42] >> I I [00:14:48] >> Okay. Approval of minutes for May 12th, [00:14:52] 2025. [00:14:57] Yes. [00:15:08] Read them. No, you're not kidding. [00:15:12] They already Okay. [00:15:15] >> Okay. No issues with them. [00:15:17] >> So, you want to make a motion or [00:15:19] >> Yeah, I'll make a motion to approve [00:15:20] them. Is it May 11th? [00:15:23] >> May 12th. [00:15:25] >> May 12th uh meeting minutes. [00:15:27] >> Okay. I'll uh second in [00:15:30] >> favor. [00:15:34] Town administrator report. [00:15:36] [Music] [00:15:37] Um the trees behind town hall are [00:15:39] currently being removed as you all can [00:15:41] hear. [00:15:43] Um [00:15:45] we actually decided to not go ahead with [00:15:49] a dumpster removing the stuff from the [00:15:52] basement. [00:15:54] Um it just wasn't going to be possible [00:15:56] given the time constraints and the [00:15:58] remediation that would have to be done [00:16:00] prior to um removing all the material on [00:16:04] that side of the basement. you have to [00:16:06] do some mold and asbestous removal that [00:16:08] would just bring our cost so we just [00:16:10] couldn't go ahead with that. Um, so [00:16:14] distance actually had been an issue. We [00:16:16] had been searching for a service [00:16:18] contract for a new copier. It wasn't [00:16:19] finding a copier, it was a service [00:16:22] contract. So I actually reached out to [00:16:24] my colleagues on the small town [00:16:25] administrator listerve and got um a [00:16:28] couple local places. So, I received two [00:16:30] quotes. Um, trying to I want to get some [00:16:34] feedback from staff that also use it [00:16:36] before I pull the trigger, but we're [00:16:37] down to two. So, hopefully by tomorrow, [00:16:40] uh, we'll be going ahead and pulling the [00:16:41] trigger on a new service contract to go [00:16:43] with our new copier. Um, the Harvard [00:16:46] pump station is officially online. [00:16:49] [Music] [00:16:53] Um, I had a call with the cure attorney [00:16:56] and our attorney on the solar lease [00:16:58] before it goes back to the select board. [00:17:00] Um, there was just some they just went [00:17:02] through line by line exactly what our [00:17:05] town council had as an issue and what [00:17:07] they were going to do to change it. I [00:17:09] don't know where they are beyond that, [00:17:11] but so that is going to be coming to the [00:17:12] select board. If not the next meeting, [00:17:14] I'm going to assume in September. So [00:17:16] that's very soon to be to being done. [00:17:18] Just to give you guys an update. um [00:17:21] working on the procurement documents for [00:17:23] the townhouse grant. [00:17:26] Um working with the town accountant and [00:17:28] the treasurer on town pec cards which is [00:17:30] a purchase card. [00:17:33] Held our bi-weekly financial management [00:17:35] planning zoom. I met with the finance [00:17:37] committee chair on ongoing financial [00:17:39] issues. [00:17:40] Had a zoom meeting with the treasure [00:17:42] collector in the office of veteran [00:17:43] affairs on the financial issues related [00:17:45] to our veterans benefits. [00:17:48] So, we're working with every area of our [00:17:50] finances, cleaning up and making sure [00:17:52] that we're doing it the right way and [00:17:54] we're getting the right reimbursement [00:17:55] and we're giving the right benefits to [00:17:57] our veterans and right benefits to our [00:17:59] employees. And just we're going through [00:18:01] everything. We're combing through [00:18:02] everything line by line. We're [00:18:04] advertising for a wastewater treatment [00:18:06] plant operator, a highway equipment [00:18:08] operator, a town accountant, a police [00:18:09] officer, and a van driver. [00:18:12] We received another resignation for a [00:18:14] wastewater treatment plant operator. So [00:18:15] that's why even though you appointed one [00:18:17] tonight, we still have it advertised. [00:18:18] We're still looking for another one. Uh [00:18:20] cuz John Paul's last day was today. [00:18:24] >> We made an I made. [00:18:26] >> I know. I know. It's just [00:18:29] >> um Did you say why? [00:18:31] >> More money, no weekends, and no [00:18:33] holidays. [00:18:36] >> I thought the hours might have something [00:18:37] to do with it. Um today we held two [00:18:40] interviews for a town accountant with [00:18:42] the treasur collector member of the [00:18:44] finance committee and selectman tinker. [00:18:47] So the next step of that process is I'll [00:18:48] be doing a reference check this week on [00:18:50] the two candidates that we interviewed [00:18:52] today and then following back up with [00:18:54] the group and going from there. I met [00:18:57] with the planning board chair on an [00:18:58] ethics issue. I had a call with town [00:19:00] council on various complaints. Attended [00:19:02] a Massachusetts Municipal Managers [00:19:04] Association programming committee [00:19:06] meeting because I serve on that [00:19:07] committee. [00:19:09] So what we do is when we have various um [00:19:12] meetings across the state um I'm on the [00:19:14] committee that picks the programming for [00:19:16] that [00:19:18] facilitated a zoom uh with for the [00:19:20] hydraologist presentation at the last [00:19:22] health meeting. I attended national [00:19:25] night out at Quadum Regional High School [00:19:27] attended the planning board public [00:19:28] hearing on the um new dorm for Eagle [00:19:32] Hill. [00:19:34] So for recognition, I want to recognize [00:19:37] Detective Armstrong, Officer Herbado, [00:19:40] Chief Landine, Lorie Hoffman from the [00:19:43] police department, Chief Josh Peas from [00:19:46] the fire department, Tessa Gurnie and [00:19:48] their staff for another successful [00:19:49] national night out. I only stayed for [00:19:52] the first hour. It seemed like a better [00:19:54] turnout than last year because the [00:19:55] weather was better, but they did a great [00:19:57] job and I really didn't have to be [00:19:59] there, but I was happy to be there. [00:20:02] Important dates. We have a public [00:20:04] records law training at Eagle Hill [00:20:06] School on August 18th from 4:00 to 6 for [00:20:08] all staff and elected officials. So the [00:20:10] uh town hall municipal office building [00:20:12] will be closed for that 2 hours so the [00:20:14] staff can attend the training. [00:20:17] Part of fair is August 15th and 16th. I [00:20:20] will be there [00:20:22] um and then just my um vacation in [00:20:24] September [00:20:26] and that's all I have. [00:20:27] >> When when are you not here? I leave [00:20:29] September 1st, but I that's a holiday. [00:20:32] So, I'll be gone the uh 2nd through the [00:20:34] 10th. So, we'll be back the Thursday [00:20:36] before your September meeting. [00:20:40] So, I won't have a town administrator [00:20:41] report for that meeting because I won't [00:20:42] have anybody. [00:20:45] >> Okay. [00:20:48] Mr. Chair. Yes, sir. Um is there a [00:20:50] reason why I was excluded from the solar [00:20:52] page solar conversation? Not that I [00:20:56] know. last time we met they expressed [00:20:59] interest in being [00:21:02] that conversation. So I'm wondering why [00:21:04] it was executed [00:21:08] wasn't included either [00:21:10] face [00:21:12] >> coming back to the select board. There [00:21:13] was no decisions made. It was just the [00:21:15] two attorneys and me as a representative [00:21:17] for the town and the representative from [00:21:19] CARES were on it. But there was nothing. [00:21:20] We didn't I didn't do anything. It was [00:21:23] just I was on it so that I could report [00:21:24] back to you what was done and give you [00:21:27] guys an update. So again, either the [00:21:30] next meeting or the meeting in [00:21:31] September, it's going back before you. [00:21:33] This is really I didn't do anything. [00:21:37] >> Do you feel that you wanted to be [00:21:39] involved in that? [00:21:40] >> I I expressed we agreed as a board that [00:21:42] I'd be involved. [00:21:43] >> Yep. All right. Well, [00:21:45] >> and I sent an email on it to, you know, [00:21:49] follow up and say, make sure I'm [00:21:50] included in this [00:21:53] There was nothing. I didn't do anything. [00:21:55] I just they two attorneys were talking [00:21:57] which you heard from the attorney that [00:21:58] he was going to do. [00:21:59] >> And I also requested the that digital [00:22:02] file. [00:22:03] >> I don't have a file. [00:22:04] >> You don't have the digital file of the [00:22:07] contract or what they went over. [00:22:09] >> I just have the one that you saw at the [00:22:10] last meeting which you have a copy of if [00:22:12] you like it electronically. [00:22:13] >> Yeah. Electron digital. [00:22:14] >> Oh, I can do that. [00:22:16] >> And I sent that with the email. [00:22:18] >> There's something about a file. I don't [00:22:20] have a file. I just have the same [00:22:21] contract that you have that you were [00:22:22] handed out to. [00:22:23] >> I'm looking for town council's contract [00:22:26] with comments line items so I can go [00:22:29] over it and review it. [00:22:30] >> But you already have it. If you'd like [00:22:31] electronically, I can electronically. [00:22:33] >> Okay, I can do that. [00:22:40] >> All right. Am I going to be included in [00:22:42] this or excluded? Who's deciding? It's [00:22:46] coming back to the board in two weeks or [00:22:49] the [00:22:49] >> Is there another is there another [00:22:51] session of deliberation? [00:22:52] >> No, [00:22:53] >> it's just between the lawyers. [00:22:55] >> Yes. [00:23:02] >> Can't go back. [00:23:06] Okay. So, this is how it's going to be [00:23:10] or no. [00:23:12] >> Well, is this going to be standard [00:23:13] operating procedure? [00:23:15] when we make a decision as a board and [00:23:17] then we get excluded by the town [00:23:19] administrator. [00:23:22] >> You might you might have to kind of [00:23:25] >> go to the town administrator. [00:23:27] >> Yeah. I sent you an email and copied her [00:23:29] >> and you know so I could you know [00:23:33] schedule this property so I'm doing [00:23:35] everything on my behalf but I have no [00:23:38] control if somebody just excludes me. [00:23:40] >> Well I'm not excluding you. [00:23:43] You were copied. [00:23:44] >> I was copied. I get a lot of emails. [00:23:46] >> Yeah, I know. [00:23:46] >> I get a lot of emails from you. [00:23:48] >> I know, [00:23:49] >> right? I try to keep up with them. [00:23:50] >> Okay. [00:23:51] >> All right. Please do. [00:23:54] Good. [00:23:57] All right. Now, we're in selectman round [00:24:00] table. Do you want to start? [00:24:02] >> Sure. I would like to recognize Lisa [00:24:05] Cohen and all the volunteers for the [00:24:07] hard work community fair and this, you [00:24:10] know, tremendous time and effort that it [00:24:12] takes to put this together. And I'd just [00:24:15] like to say thank you to everyone [00:24:16] involved. [00:24:17] >> Thank you very much. It is a cast of [00:24:19] thousands. [00:24:20] >> Yep. [00:24:24] >> It isn't funny. [00:24:26] >> I don't have anything. [00:24:27] >> Nothing. Nothing. [00:24:28] >> Nothing. Okay. All right. uh as uh EMD, [00:24:34] I'd like to say that I got my uh [00:24:36] reimbursement documentation into MIMA [00:24:39] and the town will get reimbursed for the [00:24:41] money that I spent for the big generator [00:24:44] out back and uh some equipment for the [00:24:48] highway department [00:24:51] Bluetooth [00:24:53] communicators so that they can Marty can [00:24:56] be up in the bucket and talk to somebody [00:24:57] on the ground. [00:25:00] Um, and uh, Wednesday I get together [00:25:03] with uh, board of health chair and uh, [00:25:08] Colleen Muhan, [00:25:10] superintendent of the schools to talk [00:25:13] about where to put a 40ft, you know, [00:25:15] shipping container so that we have a [00:25:17] place to move all the emergency gear out [00:25:20] of the white building preppy and getting [00:25:23] ready to somehow sell the white [00:25:26] building. So, first step is to move [00:25:30] Tens of thousands of masks and gloves [00:25:32] and thermometers and all sorts of stuff. [00:25:38] Here we go. Yes, ma'am. [00:25:41] >> Um, in in that vein, the AED in the [00:25:45] townhouse is beeping like a smoke [00:25:48] detector. That's unhappy. And [00:25:50] >> well, I'm sure you can find a a trained [00:25:53] uh professional medical person. [00:25:55] >> Maybe one I'm sitting next to. I'll look [00:25:58] at it tomorrow. I'm not [00:25:59] >> It says it's alarmed. Is it alarm? [00:26:02] >> Oh, did somebody open the door? [00:26:04] >> If you opened it up, [00:26:05] >> it's an alarmed cabinet. So, it probably [00:26:06] needs the alarm reset. [00:26:08] >> Well, I don't I don't know if anybody [00:26:10] open the door, but it is [00:26:12] a lot more. [00:26:14] >> Well, those cases just call to you to [00:26:16] open them up before. [00:26:18] Uh, I can I will get more batteries, [00:26:22] but if it hasn't been used, [00:26:24] >> the batteries have officially a 2 to [00:26:27] three year lifespan. The pads usually [00:26:30] have to be replaced at that point, [00:26:31] right? [00:26:31] >> Also, cuz the gel gets dry. So, I will [00:26:34] look at the dates tomorrow. [00:26:36] >> Look at the dates and let me know and [00:26:38] there'll be I have some money in my [00:26:40] expensive account. [00:26:41] >> Okay. [00:26:44] >> All right. Good. Thank you. [00:26:47] And uh [00:26:49] all we have now is an executive session. [00:26:52] Are you interested in having it closed [00:26:56] or open? Um yeah, I do not consent to [00:26:59] executive session. This matter must be [00:27:01] heard in open session. [00:27:04] And accent, [00:27:06] you know, for the record, this is the [00:27:07] third time it's been brought forward [00:27:08] without written complaint, without [00:27:10] supporting documentation, without [00:27:11] witnesses statements, or a third party [00:27:14] investigation advised by town council. [00:27:17] >> Okay. [00:27:19] Ma'am, [00:27:21] you have a comment. [00:27:24] um [00:27:26] [Music] [00:27:28] just going to vote on a [00:27:32] a third party to come in. That's fine. [00:27:34] But if not, I would prefer an executive [00:27:36] session. If it's going to be more of a [00:27:38] discussion [00:27:40] cuz if it's going to be, I will see the [00:27:43] council on my own. [00:27:45] >> Are you uh [00:27:48] do you want to have the executive [00:27:49] session? [00:27:51] You don't want to have it closed. if you [00:27:53] want to have it over. That's what I've [00:27:55] said. [00:27:57] So, there there's no uh agreement here. [00:28:03] What I'd like to do is seek a motion to [00:28:07] hire a mediator on [00:28:12] advice of town council. [00:28:15] Oh, so she doesn't need super [00:28:20] mediator at this point when there's no [00:28:22] investigation and no formal complaint. [00:28:24] >> The investigation can't be h I can't do [00:28:26] that legally. I can't run an [00:28:28] investigation. Excuse me. Let me finish. [00:28:31] >> Okay. [00:28:32] >> This is the way we can go. As far as [00:28:34] town council says, [00:28:36] >> all town council also says and have an [00:28:39] investigation for [00:28:40] >> says I can't run an investigation [00:28:43] neutral. So who just [00:28:46] >> that's what I'm talking about when you [00:28:48] said this is not [00:28:50] >> okay fine this is an investigator using [00:28:52] a different word [00:28:53] >> this is what we're I've been waiting for [00:28:55] to bust this log jam loose [00:28:58] >> okay [00:28:58] >> so I need a vote [00:29:01] majority vote select [00:29:02] >> I just made the motion [00:29:04] >> okay [00:29:05] I'll second [00:29:07] >> all in favor I [00:29:09] >> I Okay thank [00:29:11] Thank you. [00:29:13] >> And that closes our little meeting. [00:29:16] Thank you very much. We'll make a motion [00:29:17] toend [00:29:19] that motion. [00:29:21] >> Okay. All in favor? [00:29:23] >> I [00:29:26] it [00:29:29] wasn't enough. The first year I was I [00:29:33] didn't know about IR. So I'm like, "Oh, [00:29:37] we'll go Saturday." My son was like [00:29:39] time. So we go Saturday. I thought there [00:29:46] might be a hamburg. [00:29:46] [Music]
