The Hardwick Board of Selectmen meeting addressed significant community concerns, including allegations of an "illegal meeting" regarding a Casella landfill presentation and conflicts of interest, and challenges in obtaining PFAS questionnaire data from local water departments. The Board of Health discussed its role in the landfill host agreement, sought legal counsel, and approved an increase in annual permit fees. Planning for the "Christmas on the Common" event was detailed, and a Special Town Meeting was scheduled for November 2nd. The Capital Planning Committee advanced a police vehicle purchase, and various administrative and infrastructure updates were provided.

Comments sir is there if I read a statement sure can you just say who you are first my name is Jeffrey Smith I live on upper church thank you I'm here tonight to voice my concern about the July 18th hard Hardwick Board of selectman meeting it is my informed
Opinion that that was an illegal meeting due to a lack of quum I'm aware that Vice chair Kemp has filed her disclosure of conflicts of interest with the town and I'm aware that the form was filed on July 19th the day after the meeting after 16 years of working for David G Ro and Sons I see no
Reason why the conflict was not known on July 18th or on even on July 13th when the meeting agenda was first filed had the board consulted the Town Council before scheduling the meeting and disclosed their conflicts of interest the meeting would not have happened at no time during the recorded
July 18th meeting did Vice chair abstain or recuse herself I'm aware that chair rugles recused himself in the July 18 meeting however in the same meeting both chair Ruggles and vice chair Kemp did vote to put cella's pres presentation on the town website chair Ruggles also engaged
With cassella vice president directly asking him questions during the meeting and after the presentation in the August 16th meeting chair Ruggles made conflicting claims about the July 18th meeting he said that two members abstained from being involved in the July 18th discussion he
Said that only one member was involved with the discussion then he said actually there was no discussion then he said there was no vote taking by the board and the the August 16th meeting chair rles apologizes to the people that were blocked from attending due to a failure of technology or technical
Glitches there were no technical glitches or failures of Technology at the July 18th meeting the zoom meeting report clearly shows people were stuck in the waiting room and were blocked from attending the meeting the YouTube video of the meeting shows clearly the incompetence which which the meeting was
Handled Town Administrator Parker purposely gave host controls over to cassella Vice President Oliver for the entirety of his presentation that's not a glitch it's not a technical failure agenda items are supposed to be reasonably specific the only agenda item for the July 18 meeting was the
Presentation of a proposed project on Cella and roach property located on patril Hollow Road it does not say anything about a landfill the agenda never indicated this meeting would not allow public comment or questions in the September 25th meeting chair rles voted to acknowledge receipt of the draft host
Community agreement from Cel we are still still waiting for both the chair and the vice chair to address their conflicts of interest directly and openly in a meeting we're waiting for chair Rebel to file his disclosure form if the board is trying to appear neutral on this landfill matter in particular it
Isn't working very well will the Board address their conflicts of interest tonight what happened to the self- declared conflicts of interest of the chair why has no disclosure for the chair b f and why have there been no approved opinions from the state ethics commissions regarding these conflicts of
Interest thank you any other visitor comments not so I brought something here today to discuss um what happen with the zo I don't know if that falls under visitor comments should I bring it up now or you
Can bring up what the concern is and we can see if it's okay um so my name is Matthew Tolman I'm the owner of Tolman Home Solutions um I received a letter from Jenna garby um from the planning board uh stating I have to take down my signs are in violation
Of uh bylaws 8.0 under sections 8.3 uses allowed as a matter of right um so that wouldn't fall under our jurisdiction unfortunately that is the planning board and or the building inspector I believe so that's nothing that we could have any
Say in okay I was told that you may be able that you may be able to or kind of overrule it no no they're an elect they're independently elected right they're an elected board just as we are could you point me in the right direction as to how to how to this if you want to call me I can walk you
Through the steps on how you appeal a planning board's decision oh excellent thank you very much Nicole should I just get your number off the website or um I have a card but it's in my office 477 6197 yeah would you that' be great
Andie's going to grab me that I won't any more no worry no unfortunately we don't have jurisdiction over that so but I can at least give you the tis to where to go next right awesome thank you so much all right good luck when would be a good time to call anytime we're open 9: to 4:30 the rest of the week actually 9:
To 2 on one day but um you can call me and my cell phone anytime I'll thank you any other visitor comments okay um on to um visitation Judy for the P discussion and KP law
Contract yep uh a year ago I um received a an ad from my Law Firm about a p settlement of national class action lawsuit against the manufacturers of P bass and I didn't
Hear any anything I just felt good because I got Hardwick signed up in case something happens and this August of they I was um asked by that agency that Law Firm nepi sholic to um fill in the retainer I had
Signed a retainer um but this is the technical questionnaires and I have been trying with the Water Commission and the water districts we have three of them we all write Gilbertville and Hardwick
Center but I've been unable to get the various parties uh don Dunbar um I haven't approached Neil Noble uh I I did talk to him at one point and uh I have talked to the engine
Engineer so I brought these forms and I wonder if the select board could help me get these in in the timely fashion so that if the long chance that we we are parting to this lawsuit because we have
Contamination we don't know whether we do or not um but we will be signed on if if they fill in the technical forms it's like bunch of question but I find some resistance on their part because I think they're
Afraid to get uh um outside parties like the fed or the de telling them what to do I don't know their reluctance to to unfortunately they're private entities we don't have any we don't have
Any oversight over either the hardware the Gilbertville or will right water departments well how do you propose that I get get these filled in for the retainer because I think once we are party to this lawsuit one 3M has to pay
12.8 billion into this um class action suit another firm is uh 1 point I don't know about two billion has somebody else from your board reached out to these people no maybe another a different person and
I'm only saying this because sometimes people are willing to communicate with one person versus another it's not any disrespect but it maybe another voice would be a sound of Reason well I've got Paul Maya and Ernest warburn perhaps one of them if they reached out to the
Gentleman I work in a very male dominant World sometimes that helps oh yeah I just I'm just putting it out there I mean it truly helps sometimes Judy so that may be what what could get that ball rolling for you but uh I was told that the Hardwick Center is uh the
Responsibility of the select board correct so that that we have a so we have East National Water in Marty who I forwarded the questionnaire to so we're working on that yeah okay so we they want them electronic so I have the paper and I would fill it in if if they would provide it so we we' put we're working
On that so we can follow up on that that one we can follow up on yeah and uh don dunbar's the head of both wheel right and and the engineers promised he would do it but it we stay on them maybe and again maybe if one of the guys reach out
To them thank you um the second thing is what oh since the host agreement came to our attention I have been studying the role of the health the Board of
Health and using the legal handbook for Mass Boards of Health you can see I've been studying it and is this I'm sorry can I back up is this what host agreement just so we're clear for the landfill the solid Solid Waste you know right but nothing
Nothing has been presented Ed since that presentation however it's in our face and I'm nervous about what my role is because the first thing we have to do is the site assignment process is initiated by
Filing a site assignment application with the local Board of Health 310 CMR 16.08 and um I get mixed messages about what the order is either from uh resources that I apply
To and look up and there are many there's the Academy of Science for local Health departments and they have a a library that is open to us so is the mass health boards I contacted a lawyer there
Matthew Hugo and he jumped right on it and he said you have to pass a motion and just shut down any talk because you certainly have the rights well that didn't fly because um at the same time Nicole's
Trying to put a uh a you know caution because nothing nothing's written in stone but my health agent Matt who's quite knowledgeable Matt forer says you could be sued for not doing
Anything after it all happens and comes down so we request that we can talk to KP law and knowing that that is um going to incur their hourly rate of $300 I think Eric said uh an
Hour we would pay for it the Board of Health would use our budget our expense budget to pay for an hour just to make sure and the mass uh Health Board Association uh told me that KP law is
Really an excellent excellent firm that knows all about this stuff so we would feel good just just you know Consulting our lawyer who is KP law to reassure us so I can stop
Scrambling and we can also research the health effects of solid waste which since the last closure science has advanced so much further and we know so much more but we have to gather that
Information so um one thing we could maybe do is meet with the select board and the Board of Health and KP law and we would pay for that hour hopefully it wouldn't take more than an hour
So that's what I'm ask do not a post okay not tonight yeah not tonight what not tonight not tonight we're not meeting with them tonight though no no thank you for considering
That you Judy is that all Judy I think so oh no if we're having a town election we have so many things to work on in the Board of Health that concern
Air water soil food um and everything above what we actually have to do for permits and sep septic and that I need to have more hours of our Clerk and so I wonder if we can get on
The docket to raise uh Trisha tinker's hours to I from 8 a week to 12 and have the town boat on it that's what they did P with Peggy at the board
Of at the conservation just you know the allotment has been voted for voted for at this point it would have to go you're look you're looking for this change immediately because that's I me the budget's already in place Duty so unless you had funds in your
Budget no well well here's what happened when we went with Lester you cut the Board of Health budget in half which was not part of the contract you weren't supposed to do that so we've been reduced uh in half for the clerk and for
Our agent and to help fix that we uh started this revolving fund where our permit fees and so on and Matt's working all right but Trisha has and she came on board after half the year had
Started and she worked a lot and Lord knows she does the gargantuan work of the Board of Health the permits the septics coordinating with our health agent and with Lester now and um she's
Unable to get it all done and then help me with these other projects that um and I won't be here in July so come because my term will end and I'll be too old for this [Music]
So it's 12 hours is would give her four days at three hours a day instead of so the only thing that I can suggest is that there is a special meeting coming up there is a special meeting town meeting coming up
It would have to go in front of the voters yeah that's the only way to you know adjust your budget and I don't know how to write that for the town dock or whatever it's called did you figure out how much it is no it just means more help for me so you
Need to figure that part out you need to find figure out what that dollar amount is so that we can present it at the meeting can you help me do that in yeah oh good thanks okay I I have one more thing we're so excited we have six new
Volunteers and four four of them are Physicians and um it started with uh Dr Romano volunt saying how can I help the Board of Health and um I said well we could appoint you the town physician or you
Could help us write regulations and he had the idea to be an advisor and he said he knew other doctors and he has gotten four do himself included Dr Romano his wife Lisa Nash uh who
Has a master's in public health and is a physician and uh Dr um John Leland who had come in well before this to volunteer and um Neil H Hamlin yes who is new to town but
He's newly retired uh from toughs and worked Works uh I think still in base date on a prum basis EXC so we don't have to appoint them we call them the Physicians advisory panel and and they can help determine
The health effects scientifically of of everything that's happening whether it's the Pas in the water or the solid waste proposal and and so on or food quality or that's great yeah it's great I should
Have written an article or but hopefully it's on now it's on Zoom yes exactly thank you thanks Judy okay uh class one two and three annual fee discussion so we were going I looked at this last year but uh you know went
Pretty fast I was relatively new to it but we were looking at the fees and at least since 2002 it's been $50 and in Barry it's 120 harbertson it's 100 and wear is 200 so I just thought I'd bring a proposal to you to change the fees to to $100 annually I so
Move is that a motion y i moov that we raise the fee to $100 a second that all in favor I I it's time probably over 20 years
Yeah okay request for approval November 26 3-7 for Christmas on the common and um I know that this is was a cemetery commission actually decision probably but you're here to just kind of let us know what's going on
And we can yay you okay um so we are doing Christmas in the common and so far we have some vendors coming um we're going to have some lights put up very classic Christmas which is just white and red ribbon um and MIM is decorating theirs
Up as gingerbread house and we're going to have s'mores and a hot chocolate bar one loaded one not loaded um so people can go back there and do everything nice the other thing is is I did talk to Paula a while ago about redoing the benches and the to Common has very
Little rough and so she was okay with that so that's something our commun going to look at doing but we did have a question in regards to the fountain that she told me to ask you about and it's kind of dirty um so my husband's been doing research on what chemicals to use
On it and he looks at what all other Parks use for national monuments there which would be safe so we're looking to see if you guys would prove if it was okay for us to clean up that Fountain and make it pretty for the Christmas on uh depending on the chemicals I me it
Has to be it's ladders and some of those chemicals will make your eye Fallin right down or something like that that you have to use so with the right if somebody is watching out yeah yeah cuz we understand it's Marvel and it's yeah it might be muriatic acid would be what
I'd think about which tough stuff yeah so Mar already said that he would hoist this up so we won't have to put ladders or anything else on it um yep great yes so we hope everybody comes out to Christmas on the common we have calendars and we're going to get hats
For sale and everything else so awesome and I'll do my Shameless pitch at this point then that the point set are deliveries are also that morning and I'm happy to take donations for it that is the reason and the only reason why this event happens every year we did have a surplus last year of
$516 the point Setters right now I am looking at roughly 1,400 to be able to deliver 270 this year um I have had some trickle in already so that's great so I hope that everyone would consider any any anything is fine and also um elves to deliver so um email me message me you
You everyone knows where to find me so any and all help is welcome so thank you and I on being the recipient of those poetas the first time uh delivered by our former select
Board whose name I Keenan young and all dressed up in a suit in a red sweater I was just overwhelmed it it means so much to to us old folks well and for some people it's the only interaction they have around the holidays so that's you
Know and flowers are can be really therapeutic for people so yeah when do you need help with delivery um it will be that morning the 26th um so it's the Sunday after Thanksgiving Rel roughly around 11: to 12 I put a schedule together and then I try to stagger
People coming yeah so that my driveway is not that big so um I try to like do 15minute increments so email me message me however you want to get a hold of me if you want to get on that list happy to have anyone thank you okay any other new business thank you Angie you guys are doing a great
Job any other new business no I don't have anything anything over there no good okay uh special town meeting date uh the town clerk's here yes yes I have before you uh the 2nd of
November as 10 days prior I have to do voter registration I would put it at next Monday could do the I would just recommend doing a Thursday this is prior to finding out yeah um Judy's request so it's entirely up to I can certainly add the line item into
That um but we wouldn't be able to necessarily disclose the reasons why which may we may have to have it at the school instead of here oh I see you were trying to I got you so that but that's that's your purview I mean that's it's it's your
Warrant um but I would prefer the second because we do have the special election on November the 7th so I'm already here Saturday October 28th doing voter registration I had mentioned in passing to selectman volheim that we could potentially do it if it was going to be here because if it's only one article I
Can leave the polls and and and on the meeting but now we've got a second so I'm just letting you know what's going on and whatever you decide second the 9 16 and the second would be able to be here certainly but again you have to take into account the fact that you know
This the article that you're proposing was an oversight that's easily explainable and and not saying that that the board of healths isn't easily explainable but it is it is a change where you're asking for more money for a position so so people might be more apt to show up to it would it be too much
The crowd here you could certainly call it for here and if they got too busy then we could go up there I you could really flip a coin in that regard I mean you look at how many people are in here right now you know we could probably get like 30 in here whatever I don't know theity 32 yeah so you know we go above
That I mean we could put a few people out in the hall do you want to try for this and can you add that yes I can add that if that's what you want then I can add that and I'll bring it back I that's the only way to consider that change correct at this point it could be explained on the
Floor correct oh absolutely and the thing is I'm just going to put the line I'm just going to put the line item in and then the call the revised budget we can have for everybody here so that they can see what all you know the changes in this department this department and the bottom line and then um when do you need
To to post this by 14 days so that would be so that would be this if you do the second it would be this Thursday so that's why I can go change it right now oh yeah I have the word doc so but we don't have the we don't have the number you could just you could just list it that you are going
To to see if the town will vote to amend the Board of Health clerk salary clerk salary it's all you have you want to do that and then position it would be the clerk position from 8 to 12 hours right okay we'll just do a
Split if you can do that then I'm I move that we uh we call the town meeting for the 2nd of November at 6m here at the myin E Richardson Building yes ma'am I'll second that all those in favor
Sorry okay um we are tabling reorganization of the select board because Rob is not here and cuz he's sick so that will come up at an upcoming meeting uh old business is the disclosure for two special employee positions I can explain it but we can't
Deal with it um I mean because I can't vote on it oh okay so what this is yeah if you want to explain it and then we'll have to vote this is me going to ethics after my ethics training and finding the can't be compensated for Emergency Management
Director and selectman so I was going to have to give up one or the other so I sought a Tiny Town exemption and uh if I make a disclosure um and the select board then accepts it I can get paid
$2,000 for each or actually it's not quite that much but wait what are you so uh right and this uh this was a lot of phone calls back and forth so and then what happened was that uh I filed the disclosure in time but the
Town clerk's automatic State stamp machine came in a day in the future and my fellow select person Kelly noticed that so they had to kick it back so I was waiting for tonight uh and I was going to have to
Get up and leave the room and everything but as it is we'll put it off so well now you've explained it next time we can vote on it hopefully I hope I hope to be at the head of the list I have a I have a check in my pocket oh okay well we don't want to
Hold that back I'm sorry I'm sorry to take the time you're fine no worries request for proposals and Sewer oversight I know that's something that we need Maybe a working meeting to go through that I think yeah rabbit should be here correct I agree so I think we're going to have
To wait on that one as well ARA anything no uh reports I know there were some in here so if there's anything I read through them have you read through them yes Library report
Etc the highway the treasurer and then any signatures there is a couple actually that you can have to shair this is the Green community
Application chief executive officer not the administrative officer has to sign and this is a cemetery contract that you already voted on but uh Paula didn't have you sign you guys had voted on it a while back before the budget season we can do that I'll keep and then
Your report if you want to I'll go through this if you want to start going through your so we're really moving forward rapidly on the USDA project the driller working to pre-drill the ledge they should be out there Wednesday
Right I think it was yeah 1018 mobilization and wet well delivery still slated for November 2nd uh the wheel right wastewater treatment plant will have a bid opening at of um October 25th at 2 p.m. and the next agenda will be issued next week answering bidder's questions
As happens throughout the bid and the Gilbertville um treatment plant the chapter 30b advertised for this week for UV and mechanical surface are and responses are due by November 1st so sometimes parts are required to go out to bid first and that's happen here um the park in rack along with the
Youth would like to have a Halloween celebration at the municipal building on 10:28 with rain dat of 1029 to coincide with the drunker treating um and the capital planning committee has been meeting monthly we should have recommendations to you soon we did meet today um just kind of really going over
The deficiencies and things that we really need for Capital planning that should come soon enough they're really getting down in the weeds with it um we had a safety insult for our boiler here in this in this building on October 11th it will shun the pump pump off if the water goes about a certain
Amount this is not a permanent fix but we did have PVE in here tonight and he he said there's all there's a also an alarm that they can put on there that would come to my phone maybe Marty maybe police maybe yeah saying that you know we need to get in here and do something Ryan would be one of them as well good
This last one is uh the 35 % match for equipment so I put in for a police car and a highway truck and I did um you know I got all the quotes and they went to Capital planning who did vote to at least move the police vehicle forward since we didn't purchase one last year and they do have two vehicles that are
Over 100,000 miles but um I'm going to wait until the next meeting to get that to you because they had a couple other questions maybe were we going to trade something in we selling out right so before I have questions I'll bring that to you okay and then the ongoings are things that are on the website that are
On my um Town Administrator page yep and anyone can any at any time can reach out to the call yeah um select around table anything no one
Set and move we adjourn second that all those in favor

regarding these conflicts of [00:03:28] interest [00:03:30] thank you any other visitor [00:03:34] comments [00:03:36] um not so I brought something here today [00:03:40] to discuss um what happen with the zo I [00:03:42] don't know if that falls under visitor [00:03:44] comments should I bring it up now or you [00:03:47] can bring up what the concern is and we [00:03:49] can see if it's okay um so my name is [00:03:53] Matthew Tolman I'm the owner of Tolman [00:03:55] Home Solutions um I received a letter [00:03:57] from Jenna garby um from the planning [00:04:00] board uh stating I have to take down my [00:04:03] signs are in violation [00:04:05] of uh bylaws 8.0 under sections 8.3 uses [00:04:10] allowed as a matter of right um so that [00:04:13] wouldn't fall under our jurisdiction [00:04:15] unfortunately that is the planning board [00:04:17] and or the building inspector I believe [00:04:20] so that's nothing that we could have any [00:04:23] say in okay I was told that you may be [00:04:26] able that you may be able [00:04:28] to or kind of overrule it no no they're [00:04:33] an elect they're independently elected [00:04:34] right they're an elected board just as [00:04:36] we are could you point me in the right [00:04:37] direction as to how to how to this if [00:04:39] you want to call me I can walk you [00:04:42] through the steps on how you appeal a [00:04:45] planning board's decision oh excellent [00:04:48] thank you very much Nicole should I just [00:04:50] get your number off the website or um I [00:04:53] have a card but it's in my office 477 [00:04:58] 6197 yeah would you that' be great [00:05:01] andie's going to grab me that I won't [00:05:04] any more no worry no unfortunately we [00:05:07] don't have jurisdiction over that so but [00:05:09] I can at least give you the tis to where [00:05:11] to go next right awesome thank you so [00:05:13] much all right good luck when would be a [00:05:16] good time to call anytime we're open 9: [00:05:17] to 4:30 the rest of the week actually 9: [00:05:19] to 2 on one day but um you can call me [00:05:22] and my cell phone anytime [00:05:24] I'll thank [00:05:26] you any other visitor comments [00:05:31] okay um on to um visitation Judy for the [00:05:35] P discussion and KP law [00:05:38] contract [00:05:41] yep uh a year ago I um received a an ad [00:05:46] from my Law Firm about a p settlement of [00:05:52] national class action lawsuit against [00:05:55] the manufacturers of P bass and I didn't [00:05:59] hear any anything I just felt good [00:06:00] because I got Hardwick signed up in case [00:06:03] something happens and this August of [00:06:07] they I was um asked by that agency that [00:06:13] um Law Firm nepi [00:06:16] sholic to um fill in the retainer I had [00:06:22] signed a [00:06:24] retainer um but this is the technical [00:06:28] questionnaires [00:06:30] and I have been trying with the Water [00:06:33] Commission and the water districts we [00:06:35] have three of them we all write [00:06:39] Gilbertville and Hardwick [00:06:41] Center but I've been unable to get um [00:06:45] the various parties uh don Dunbar um I [00:06:50] haven't approached Neil Noble uh I I did [00:06:54] talk to him at one [00:06:56] point and uh I have talked to the engine [00:06:59] engineer so I brought these forms and I [00:07:03] wonder if the select board could help me [00:07:06] get these in in the timely fashion so [00:07:10] that if the long chance that we we are [00:07:14] parting to this lawsuit because we have [00:07:17] contamination we don't know whether we [00:07:19] do or not um but we will be signed on if [00:07:26] if they fill in the technical forms it's [00:07:28] like [00:07:29] bunch of [00:07:30] question but I find some resistance on [00:07:34] their part because I think they're [00:07:36] afraid to get uh um outside parties like [00:07:41] the fed or the de telling them what to [00:07:45] do I don't know their reluctance to to [00:07:49] um unfortunately they're private [00:07:52] entities we don't have any we don't have [00:07:54] any oversight over either the hardware [00:07:57] uh the Gilbertville or [00:07:59] um will right water [00:08:02] departments well how do you propose that [00:08:04] I get get these filled in for the [00:08:07] retainer because I think once we are [00:08:11] party to this lawsuit one 3M has to pay [00:08:16] 12.8 [00:08:18] billion into this um class action suit [00:08:22] another firm is uh 1 point I don't know [00:08:26] about two billion has somebody else from [00:08:29] your board reached out to these people [00:08:32] no maybe another a different person and [00:08:34] I'm only saying this because sometimes [00:08:36] people are willing to communicate with [00:08:38] one person versus another it's not any [00:08:41] disrespect but it maybe another voice [00:08:44] would be a sound of Reason well I've got [00:08:47] Paul Maya and Ernest warburn perhaps one [00:08:50] of them if they reached out to the [00:08:53] gentleman I work in a very male dominant [00:08:55] World sometimes that helps oh yeah I [00:08:58] just I'm just putting it out there I [00:08:59] mean it truly helps sometimes Judy so [00:09:02] that may be what what could get that [00:09:04] ball rolling for you but uh I was told [00:09:07] that the Hardwick Center is uh the [00:09:11] responsibility of the select board [00:09:13] correct so that that we have a so we [00:09:16] have East National Water in Marty who I [00:09:18] forwarded the questionnaire to so we're [00:09:20] working on that yeah okay so we they [00:09:22] want them [00:09:23] electronic so I have the paper and I [00:09:26] would fill it in if if they would [00:09:28] provide it so we we' put we're working [00:09:30] on that so we can follow up on that that [00:09:33] one we can follow up on yeah and uh don [00:09:36] dunbar's the head of both wheel right [00:09:39] and and the engineers promised he would [00:09:43] do it but it we stay on them maybe and [00:09:46] again maybe if one of the guys reach out [00:09:48] to them thank you um the second thing is [00:09:53] what oh [00:09:57] um since the host agreement came to our [00:10:02] attention I have been studying the role [00:10:05] of the health the Board of [00:10:08] Health and using the legal handbook for [00:10:12] Mass Boards of Health you can see I've [00:10:14] been studying [00:10:16] it and is this I'm sorry can I back up [00:10:20] is this what host agreement just so [00:10:22] we're clear for the landfill the solid [00:10:24] Solid Waste you know right but nothing [00:10:28] nothing has been presented Ed since that [00:10:31] presentation [00:10:32] however it's in our face and I'm nervous [00:10:37] about what my role is because the first [00:10:41] thing we have to do is the site [00:10:43] assignment process is initiated by [00:10:46] filing a site assignment application [00:10:49] with the local Board of Health 310 CMR [00:10:54] 16.08 and um I get mixed messages about [00:10:59] what the order is either [00:11:02] from uh resources that I apply [00:11:06] to and look up and there are many [00:11:09] there's the Academy of Science for local [00:11:13] Health [00:11:14] departments and they have a a library [00:11:17] that is open to us so is the mass health [00:11:21] boards I contacted a lawyer there [00:11:24] Matthew um [00:11:27] Hugo and he jumped right on it and he [00:11:30] said you have to pass a motion and just [00:11:34] shut down any talk because you certainly [00:11:37] have the rights well that didn't fly [00:11:40] because um at the same time Nicole's [00:11:44] trying to put a uh a you know caution [00:11:48] because nothing nothing's written in [00:11:51] stone but my health agent Matt who's [00:11:54] quite knowledgeable Matt forer says you [00:11:58] could be sued for not doing [00:12:02] anything after it all happens and comes [00:12:05] down so we [00:12:08] request that we can talk to KP [00:12:12] law and knowing that that is um going to [00:12:15] incur their hourly rate of $300 I think [00:12:19] Eric said uh an [00:12:22] hour [00:12:24] um we would pay for it the Board of [00:12:27] Health would use our budget our expense [00:12:30] budget to pay for an hour just to make [00:12:34] sure and the mass uh Health Board [00:12:39] Association uh told me that KP law is [00:12:43] really an excellent excellent firm that [00:12:47] knows all about this stuff so we would [00:12:50] feel good just just you know Consulting [00:12:53] our lawyer who is KP law to reassure us [00:12:58] so [00:12:59] I can stop [00:13:01] scrambling and we can also research the [00:13:05] health effects of solid waste which [00:13:08] since the last [00:13:10] closure science has advanced so much [00:13:13] further and we know so much more but we [00:13:16] have to gather that [00:13:19] information so um one thing we could [00:13:23] maybe do is meet with the select board [00:13:27] and the Board of Health and KP law and [00:13:31] we would pay for that hour hopefully it [00:13:34] wouldn't take more than an [00:13:36] hour [00:13:37] um so that's what I'm ask do not a [00:13:43] post [00:13:45] okay not [00:13:47] tonight yeah not [00:13:49] tonight what not tonight not tonight [00:13:52] we're not meeting with them tonight [00:13:53] though no no thank you for considering [00:13:57] that you [00:13:59] Judy is that all [00:14:02] Judy I think so oh no [00:14:06] um if we're having a town [00:14:09] election we have so many things to work [00:14:13] on in the Board of Health that concern [00:14:16] air water soil [00:14:19] food um and everything above what we [00:14:22] actually have to do for permits and sep [00:14:26] septic and that um [00:14:29] I need to have more hours of our [00:14:32] Clerk and so I wonder if we can get on [00:14:36] the docket to raise uh Trisha tinker's [00:14:42] hours to I from 8 a week to [00:14:49] 12 and have the town boat on it that's [00:14:53] what they did P with Peggy at the board [00:14:55] of at the conservation just you know the [00:14:58] allotment has been voted for voted for [00:15:01] at this point it would have to [00:15:04] go you're look you're looking for this [00:15:06] change [00:15:07] immediately because that's I me the [00:15:09] budget's already in place Duty so unless [00:15:12] you had funds in your [00:15:14] budget no well well here's what happened [00:15:18] when we went with [00:15:20] Lester you cut the Board of Health [00:15:23] budget in half which was not part of the [00:15:27] contract you weren't supposed to do that [00:15:29] so we've been [00:15:31] reduced uh in half for the clerk and for [00:15:35] our uh [00:15:37] agent and to help fix that we uh started [00:15:41] this revolving fund where our permit [00:15:44] fees and so on and Matt's [00:15:46] working all right but Trisha has and she [00:15:51] came on board after half the year had [00:15:54] started and she worked a lot and Lord [00:15:57] knows she does the gargantuan work of [00:16:02] the Board of Health the permits the [00:16:05] septics coordinating with our health [00:16:08] agent and with Lester now and um she's [00:16:13] unable to get it all done and then help [00:16:15] me with these other projects that um and [00:16:19] I won't be here in July [00:16:23] so come because my term will end and [00:16:25] I'll be too old for this [00:16:28] [Music] [00:16:32] so it's 12 hours [00:16:35] is would give her four days at three [00:16:40] hours a day instead of so the only thing [00:16:43] that I can suggest is that there is a [00:16:45] special meeting coming up there is a [00:16:47] special meeting town meeting coming up [00:16:50] it would have to go in front of the [00:16:51] voters yeah that's the only way to you [00:16:54] know adjust your budget and I don't know [00:16:56] how to write that for the town dock or [00:16:58] whatever it's called did you figure out [00:17:00] how much it [00:17:01] is [00:17:04] no it just means more help for me so you [00:17:08] need to figure that part out you need to [00:17:09] find figure out what that dollar amount [00:17:12] is so that we can present it at the [00:17:14] meeting can you help me do that in yeah [00:17:18] oh good thanks okay I I have one more [00:17:22] thing we're so excited we have six new [00:17:26] volunteers and four four of them are [00:17:30] Physicians and um it started with uh Dr [00:17:34] Romano volunt saying how can I help the [00:17:36] Board of [00:17:38] Health and um I said well we could [00:17:41] appoint you the town physician or you [00:17:45] could help us write [00:17:46] regulations and he had the idea to be an [00:17:50] advisor and he said he knew other [00:17:53] doctors and he has gotten four do [00:17:57] himself included [00:17:59] uh Dr Romano his wife Lisa Nash uh who [00:18:03] has a master's in public health and is a [00:18:07] physician and uh Dr um John Leland who [00:18:13] had come in well before this to [00:18:16] volunteer and um Neil [00:18:20] um H Hamlin yes who is new to town but [00:18:26] he's newly retired uh from toughs and [00:18:30] worked Works uh I think still in base [00:18:33] date on a prum basis EXC so we don't [00:18:37] have to appoint them we call them the [00:18:39] Physicians advisory [00:18:42] panel and and they can help determine [00:18:46] the health effects scientifically of of [00:18:51] everything that's happening whether it's [00:18:53] the Pas in the water or the solid waste [00:18:57] proposal and and so on or food quality [00:19:01] or that's great yeah it's great I should [00:19:05] have written an article or but [00:19:08] um hopefully it's on now it's on Zoom [00:19:11] yes exactly thank you thanks [00:19:14] Judy okay uh class one two and three [00:19:18] annual fee [00:19:19] discussion so we were going I looked at [00:19:22] this last year but uh you know went [00:19:24] pretty fast I was relatively new to it [00:19:26] um but we were looking at the fees and [00:19:29] at least since 2002 it's been $50 and in [00:19:32] Barry it's 120 harbertson it's 100 and [00:19:34] wear is 200 so I just thought I'd bring [00:19:37] a proposal to you to change the fees to [00:19:40] to $100 annually I so [00:19:44] move is that a motion y i moov that we [00:19:48] raise the fee to [00:19:49] $100 a second that all in favor I [00:19:57] I [00:19:58] it's time probably over 20 years [00:20:02] yeah okay request for approval um [00:20:05] November 26 3-7 for Christmas on the [00:20:09] common and um I know that this is was a [00:20:12] cemetery commission actually decision [00:20:15] probably but you're here to just kind of [00:20:18] let us know what's going on [00:20:20] and we can yay [00:20:24] you okay um so we are doing Christmas in [00:20:27] the common and so far we have some [00:20:29] vendors coming um we're going to have [00:20:32] some lights put up very classic [00:20:34] Christmas which is just white and red [00:20:36] ribbon um and MIM is decorating theirs [00:20:40] up as gingerbread house and we're going [00:20:43] to have s'mores and a hot chocolate bar [00:20:46] one loaded one not loaded um so people [00:20:49] can go back there and do everything nice [00:20:52] um the other thing is is I did talk to [00:20:55] Paula a while ago about redoing the [00:20:57] benches and the to Common has very [00:21:00] little rough and so she was okay with [00:21:04] that so that's something our commun [00:21:06] going to look at doing but we did have a [00:21:08] question in regards to the fountain that [00:21:09] she told me to ask you about and it's [00:21:12] kind of dirty um so my husband's been [00:21:15] doing research on what chemicals to use [00:21:18] on it and he looks at what all other [00:21:20] Parks use for national monuments there [00:21:24] which would be safe so we're looking to [00:21:27] see if you guys would prove if it was [00:21:29] okay for us to clean up that Fountain [00:21:31] and make it pretty for the Christmas [00:21:35] on uh depending on the chemicals I me it [00:21:38] has to be it's ladders and some of those [00:21:41] chemicals will make your eye Fallin [00:21:44] right down or something like that that [00:21:46] you have to use so with the right if [00:21:49] somebody is watching out yeah yeah cuz [00:21:52] we understand it's Marvel and it's yeah [00:21:54] it might be muriatic acid would be what [00:21:56] I'd think about which tough stuff yeah [00:22:00] so Mar already said that he would hoist [00:22:02] this up so we won't have to put ladders [00:22:04] or anything else on it um yep [00:22:07] great yes so we hope everybody comes out [00:22:10] to Christmas on the common we have [00:22:12] calendars and we're going to get hats [00:22:14] for sale and everything else so awesome [00:22:17] and I'll do my Shameless pitch at this [00:22:19] point then that the point set are [00:22:20] deliveries are also that morning and um [00:22:23] I'm happy to take donations for it that [00:22:25] is the reason and the only reason why [00:22:27] this event happens every year we did [00:22:30] have a surplus last year of [00:22:33] $516 the point Setters right now I am [00:22:36] looking at roughly 1,400 to be able to [00:22:38] deliver 270 this year um I have had some [00:22:41] trickle in already so that's great so I [00:22:44] hope that everyone would consider any [00:22:46] any anything is fine and also um elves [00:22:50] to deliver so um email me message me you [00:22:54] you everyone knows where to find me so [00:22:56] um any and all help is welcome so thank [00:23:00] you and I on being the recipient of [00:23:05] those poetas the first [00:23:08] time uh delivered by our former select [00:23:12] board whose name I Keenan young and all [00:23:15] dressed up in a suit in a red sweater I [00:23:18] was just overwhelmed it it means so much [00:23:24] to to us old folks well and for some [00:23:27] people it's the only interaction they [00:23:28] have around the holidays so that's you [00:23:30] know and flowers are can be really [00:23:33] therapeutic for people so yeah when do [00:23:36] you need help with delivery um it will [00:23:38] be that morning the 26th um so it's the [00:23:41] Sunday after Thanksgiving Rel roughly [00:23:44] around 11: to 12 I put a schedule [00:23:47] together and then I try to stagger [00:23:49] people coming yeah so that my driveway [00:23:52] is not that big so um I try to like do [00:23:54] 15minute increments so email me message [00:23:57] me however you want to get a hold of me [00:23:59] if you want to get on that list happy to [00:24:01] have [00:24:02] anyone thank [00:24:04] you okay any other new business thank [00:24:06] you Angie you guys are doing a great [00:24:11] job any other new business no I don't [00:24:14] have anything anything over there no [00:24:17] good okay uh special town meeting [00:24:21] date uh the town clerk's here yes yes I [00:24:25] have before you uh the 2nd of [00:24:29] November as 10 days prior I have to do [00:24:31] voter registration I would put it at [00:24:34] next Monday could do the I would just [00:24:36] recommend doing a Thursday this is prior [00:24:39] to finding out yeah um Judy's request so [00:24:43] it's entirely up to I can certainly add [00:24:46] the line item into [00:24:49] that um but we wouldn't be able to [00:24:52] necessarily disclose the reasons why [00:24:55] which may we may have to have it at the [00:24:58] school instead of here oh I see you were [00:25:01] trying to I got [00:25:02] you so that but that's that's your [00:25:05] purview I mean that's it's it's your [00:25:07] warrant um but I would prefer the second [00:25:10] because we do have the special election [00:25:11] on November the 7th so I'm already here [00:25:14] Saturday October 28th doing voter [00:25:17] registration I had mentioned in passing [00:25:19] to selectman volheim that we could [00:25:22] potentially do it if it was going to be [00:25:23] here because if it's only one article I [00:25:25] can leave the polls and and and on the [00:25:28] meeting but now we've got a second so [00:25:30] I'm just letting you know what's going [00:25:32] on and whatever you [00:25:34] decide second the 9 16 and the second [00:25:37] would be able to be [00:25:39] here certainly but again you have to [00:25:42] take into account the fact that you know [00:25:44] this the article that you're proposing [00:25:46] was an oversight that's easily [00:25:49] explainable and and not saying that that [00:25:51] the board of healths isn't easily [00:25:53] explainable but it is it is a change [00:25:55] where you're asking for more money for a [00:25:56] position so so people might be more apt [00:25:59] to show up to it would it be too much [00:26:01] the crowd here you could certainly call [00:26:03] it for here and if they got too busy [00:26:05] then we could go up there I you could [00:26:08] really flip a coin in that regard I mean [00:26:11] you look at how many people are in here [00:26:12] right now you know we could probably get [00:26:14] like 30 in here whatever I don't know [00:26:18] theity 32 yeah so you know we go above [00:26:23] that I mean we could put a few people [00:26:24] out in the [00:26:26] hall do you want to try for this and can [00:26:29] you add that yes I can add that if [00:26:31] that's what you want then I can add that [00:26:33] and I'll bring it back I that's the only [00:26:34] way to consider that change correct at [00:26:38] this point it could be explained on the [00:26:41] floor correct oh absolutely and the [00:26:43] thing is I'm just going to put the line [00:26:44] I'm just going to put the line item in [00:26:47] and then the call the revised budget we [00:26:49] can have for everybody here so that they [00:26:51] can see what all you know the changes in [00:26:53] this department this department and the [00:26:54] bottom line and then um when do you need [00:26:57] to to post this by 14 days so that would [00:26:59] be so that would be this if you do the [00:27:02] second it would be this Thursday so [00:27:04] that's why I can go change it right now [00:27:06] oh yeah I have the word doc so but we [00:27:09] don't have the we don't have the number [00:27:11] you could just you could just list it [00:27:14] that you are going [00:27:15] to to see if the town will vote to amend [00:27:20] the Board of Health clerk salary clerk [00:27:23] salary it's all you have you want to do [00:27:25] that and then position it would be the [00:27:27] clerk position from 8 to 12 hours right [00:27:31] okay we'll just do a [00:27:34] split if you can do that then I'm I move [00:27:37] that we uh we call the town meeting for [00:27:40] the 2nd of November at 6m here at the [00:27:45] myin E Richardson Building yes ma'am [00:27:47] I'll second [00:27:49] that all those in favor [00:27:54] sorry okay um we are tabling [00:27:58] reorganization of the select board [00:28:00] because Rob is not here and cuz he's [00:28:01] sick so that will come up at an upcoming [00:28:05] meeting uh old business is the [00:28:08] disclosure for two special employee [00:28:10] positions I can explain it but we can't [00:28:13] deal with [00:28:14] it um I mean because I can't vote on it [00:28:18] oh okay so what this is yeah if you want [00:28:21] to explain it and then we'll have to [00:28:22] vote this is me going to ethics after my [00:28:25] ethics training and finding the can't be [00:28:28] compensated for Emergency Management [00:28:31] director and selectman so I was going to [00:28:35] have to give up one or the other so I [00:28:38] sought a Tiny Town [00:28:41] exemption and uh if I make a [00:28:44] disclosure um and the select board then [00:28:47] accepts it I can get paid [00:28:50] $2,000 for each or actually it's not [00:28:53] quite that much [00:28:56] but wait what are [00:28:58] you so uh right and this uh this was a [00:29:01] lot of phone calls back and forth so uh [00:29:04] and then what happened was that uh I [00:29:06] filed the disclosure in time but the [00:29:10] town clerk's [00:29:12] automatic State stamp machine came in a [00:29:15] day in the future and my fellow select [00:29:21] person Kelly noticed that so they had to [00:29:24] kick it back so I was waiting for [00:29:26] tonight uh and I was going to have to [00:29:28] get up and leave the room and everything [00:29:29] but as it is we'll put it off so well [00:29:33] now you've explained it next time we can [00:29:35] vote on it hopefully I hope I hope to be [00:29:37] at the head of the list I have a I have [00:29:40] a check in my [00:29:44] pocket oh okay well we don't want to uh [00:29:47] hold that back I'm sorry I'm sorry to [00:29:49] take the time you're fine no worries um [00:29:52] request for proposals and Sewer [00:29:54] oversight I know that's something that [00:29:56] we need Maybe [00:29:57] a working meeting to go through that I [00:30:02] think yeah rabbit should be here correct [00:30:04] I agree so I think we're going to have [00:30:06] to wait on that one as well um [00:30:10] ARA anything no uh reports I know there [00:30:13] were some in here [00:30:17] so if there's [00:30:19] anything I read through them have you [00:30:22] read through them yes Library report [00:30:26] Etc the highway the treasurer and then [00:30:30] um [00:30:32] any [00:30:35] signatures there is a couple actually [00:30:38] that you can have to [00:30:41] shair this is the Green community [00:30:44] application chief executive officer not [00:30:47] the administrative officer has to sign [00:30:49] and this is a cemetery contract that you [00:30:51] already voted on but uh Paula didn't [00:30:53] have you sign you guys had voted on it a [00:30:55] while back before the budget [00:30:59] season we can do that I'll keep and then [00:31:02] your report if you want to I'll go [00:31:04] through this if you want to start going [00:31:05] through your [00:31:10] um so we're really moving [00:31:12] forward rapidly on the USDA project um [00:31:17] the driller working to pre-drill the [00:31:19] ledge they should be out there Wednesday [00:31:21] right I think it was yeah 1018 [00:31:23] mobilization and wet well delivery still [00:31:26] slated for November 2nd uh the wheel [00:31:29] right wastewater treatment plant will [00:31:31] have a bid opening at of um October 25th [00:31:35] at 2 [00:31:36] p.m. and the next agenda will be issued [00:31:38] next week answering bidder's questions [00:31:40] as happens throughout the bid and the [00:31:44] Gilbertville um treatment plant the [00:31:46] chapter 30b advertised for this week for [00:31:48] UV and mechanical surface are and [00:31:51] responses are due by November 1st so [00:31:53] sometimes parts are required to go out [00:31:55] to bid first and that's happen [00:31:57] here um the park in rack along with the [00:32:01] youth would like to have a Halloween [00:32:02] celebration at the municipal building on [00:32:04] 10:28 with rain dat of 1029 to coincide [00:32:06] with the drunker treating um and the [00:32:11] capital planning committee has been [00:32:12] meeting monthly we should have [00:32:14] recommendations to you soon we did meet [00:32:15] today um just kind of really going over [00:32:18] the deficiencies and things that we [00:32:19] really need for Capital planning that [00:32:21] should come soon enough they're really [00:32:23] getting down in the weeds with [00:32:25] it um we had a safety insult for our [00:32:28] boiler here in this in this building on [00:32:30] October 11th it will shun the pump pump [00:32:33] off if the water goes about a certain [00:32:34] amount this is not a permanent fix but [00:32:37] we did have PVE in here tonight and he [00:32:40] um he said there's all there's a also an [00:32:43] alarm that they can put on there that [00:32:44] would come to my phone maybe Marty maybe [00:32:47] police maybe yeah saying that you know [00:32:49] we need to get in here and do something [00:32:50] Ryan would be one of them as well good [00:32:54] um this last one is uh the 35 % match [00:32:57] for equipment so I put in for a police [00:32:59] car and a highway truck and I did um you [00:33:02] know I got all the quotes and they went [00:33:04] to Capital planning who did vote to um [00:33:07] at least move the police vehicle forward [00:33:09] since we didn't purchase one last year [00:33:10] and they do have two vehicles that are [00:33:11] over 100,000 miles but um I'm going to [00:33:16] wait until the next meeting to get that [00:33:17] to you because they had a couple other [00:33:19] questions maybe were we going to trade [00:33:21] something in we selling out right so [00:33:23] before I have questions I'll bring that [00:33:24] to you okay and then the ongoings are [00:33:26] things that are on the website that are [00:33:27] on my um Town Administrator [00:33:29] page yep and anyone can any at any time [00:33:33] can reach out to the call [00:33:37] yeah um select around [00:33:40] table anything no one [00:33:48] set and move we adjourn second that all [00:33:52] those in favor
