The Hardwick Select Board met to discuss the potential development of two town-owned properties, 179 Main Street and the Ruggles Hill Road school, while also addressing administrative matters including the Cemetery Commission's revolving fund, a mowing contract, and the appointment of a new commission member. The Board reviewed and approved several sets of meeting minutes, tabled others for corrections, and received updates from the Town Administrator regarding ongoing projects and municipal training.

Meeting to order. I'd like to pledge allegiance to the flag.
I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all.
Now, tonight we have a lot of minutes to go over.
We have some other items. I would like to put the minutes off to the end and deal with people who are here to speak so that they don't get tangled up. No problem. And uh so uh I'd start with
Felix and I'm sorry I don't know your last name.
>> And we were interested in talking about 179 Main Street. Yes, >> the white builders. So, I'll turn it over to you.
>> Yeah.
>> Um, thank you for having me on the agenda today. Um, so the white building I came about it I would I own the building right next to it. Um, actually, so one has a building I own and the building right next to it is the abandoned building, right? So, I
Was just trying to do some work on my own property when uh Marty Henderson Almighty, the high wishing protectant, happened to be around the building.
Him and I started talking and I asked him what the story was with the building and he said it's been abandoned for a while. So, him and I kind of walked in toward the building, told him, you know, I'd be interested to see what the town would be willing to do with the building. Um, so I'm here proposing or
Just first of all introducing myself and you guys know who I am, but also letting you know that we are interested in pursuing that white building as um some form of housing, whether that would be some condos, whether that would be some apartments. Um, that's what our interest
Is. Um, I think Eric, we had met in the summer, like late summer, my wife and I met with you.
>> Yeah. And um at the time there was maybe some discussions going on with the page building and we thought there were title issues that would affect all of the buildings. So we kind of put everything on hold. Um now it sounds like the page has kind of been sorted out. So I'm not
Sure where that building stands um in terms of that. But, uh, I really just wanted to put out what my suggestion is and, um, see if it's something I think town could benefit from having a building like that
Renovated, fixed up, being put back to use. Um, when I looked at it with Marty, it looked like it was in decent shape on the inside, given it's been left for 12 years with no use. Mhm.
>> Um, so yeah, I just want to get the RFP going or >> get a discussion of how we can, you know, find mutual agreement um to make that building back or put that building back to use.
>> Well, I think we're getting close to the RFP stage with this building and another that we'll be talking about tonight. So, it was, uh, was it was a good time that you came and blessed us again.
>> Yeah.
>> Would you like to ask any questions, sir?
>> And when you say we, it's just you and your wife or is it a group of people?
>> No, just just my wife. Okay. Yeah, just questions at this point. I mean, condo like what are you like what are you kind of considering? Is it going to
Be low income housing, elderly housing or just housing?
>> Just housing. We weren't really considering low income.
>> Okay.
>> Um, we're just going to make it housing.
>> Mhm. Um, initial thought was about just looking at the footprint and having my engineers look at the building and and the architecture, the layout, the square footage, >> about 14 apartments.
>> Mhm.
>> Um, 10 to 14 apartments or we could also do some condominium style housing as well where there's bigger more units like more bedrooms um but fewer units.
But that was >> Yeah, that was my initial thought.
>> All right. Thank you.
>> Yeah.
>> Okay.
>> Anybody else?
>> Yes, ma'am.
>> Um, where are you going to put the 14 apartments?
>> Same footprint of the building.
>> Got the whole building and fit the 14 apartments in there. So obviously this is just hypothetically what I envision doing, right? So >> how many square feet are each one of those apartments going 20 feet?
>> 900 roughly. 900,000.
>> Okay.
>> Um are you aware of the fact that it is a historic building?
>> Yeah.
>> Okay. What are you going to do to preserve the historic?
>> So that's where I want to work with the town, right? This is this is just the very beginning. I haven't even done a lot to look into that part of it.
This is just at the very beginning across.
>> Are you are you aware of the fact that it's in a historic district?
>> Yes, I am.
>> Okay.
>> That will affect what you can do on the outside of the building.
>> I'm not even looking to um my plan is not to change the outside of the building. Right. I don't plan to make this some modern looking like building.
Right. I'm trying to preserve as much of the building as I can.
I've done projects where we've tried to rehabilitate. I mean, we've met with the historical community that have come looked at the building.
>> Well, I'm on the historic commission.
That's why I'm asking.
>> Right. So I've met with people like you who have come on site, looked at a building, >> gone through the viability of either saving it, proposing in some situations the building is so far gone that it has to be torn down, >> but we look for things we can preserve.
What can we preserve that we can put back in the building? I don't think this building is anywhere close.
>> It's not. So I wouldn't I wouldn't be looking to um make drastic modifications to what's already there. It's more what's inside.
Are you talking onebedroom apartments?
>> So there was a consideration of majority two bedrooms.
>> two bedrooms and 900 ft.
>> Two bedrooms would be at 1,000 ft.
>> 1,000 ft.
>> Right. And then the one bedrooms would be more like the 800 foot range. Um you're aware of the fact that under that allowment of apartments that certain percentage of them have to be kept as low income by uh the feds have rules and
Regulations.
>> So yeah. So I don't know where the threshold of the town is. I don't know how much low income the town has. It depend the threshold of what's required.
>> Hardook is considered a lowinccome town.
>> Yeah. So the there when you do housing according to the feds there's a certain amount you have to put aside for low income. Correct gentlemen.
>> There'll be u I'm sure that Felix is going to run into all sorts of reds at this point.
>> It's like you said it's the beginning stages.
>> Yeah. It's preliminary.
>> Mhm.
>> Exactly.
>> We haven't even got an arrested.
Thank you.
>> I'm asking him questions that he may or may not know so that he can make informed decisions.
>> Thank you.
>> Yeah.
>> Okay.
>> Thank you.
>> All right. Thank you so much for coming.
>> All right. Thank you.
>> Has just briefly.
>> Would you kindly spell your last name, Felix, and and have you done something like this before?
>> So, I've not done something of this magnitude before, but I have done something similar, smaller. Um, my last name is W A and I'm like Mary Be like boy. You are you home?
>> I live in Southport.
>> And that's Bill Cole. He's chair of the planning board.
>> Yes, I'm okay. I just >> Thank you.
>> Yeah, no problem.
>> We got some heavy hitters in the room.
That's fine. I'm just >> Mr. Chair. Yes, ma'am.
>> Um, so after tonight or whatever direction that the board chooses, um, I can let uh, Felix know and whoever might be interested if that's >> okay.
>> All right. Great.
>> Well, thank you so much for your time.
>> Thank you, sir. Appreciate it.
>> Should we just go right across to a discussion on Rugles Hill Street?
Sure. Yeah. No reason why you can put it.
>> Did you get a you got an email from Jesus? Mr.
>> Yep. I responded.
>> Okay.
>> Take the lead here, per se.
>> Take the lead. Uh well, I assumed that Liz was interested in talking about it or >> um uh the the situation is that um it's basically as we all know there's a uh a restriction on the deed and the mixture
Family is uh interested and wants to do the exact same thing they did with the page building is to take it back and then transfer it to another.
>> You're sure of that?
>> I'm sure of that.
>> Okay.
Okay. It's just a matter of, you know, they everybody's crossing their tees to make sure that if, you know, we put in this amount of time and effort that this will come to pass because the mixers don't want to spend astronomical amounts of money and neither do I.
>> Okay.
>> Mr. Chair, in your packet is a correspondence from town council regarding the deed.
Read it. What does it say?
>> Yeah, you want to It basically says that their right to revert the property is expired.
>> It's kind of like the page building, but it's on the D >> and the D is in your packet.
>> Okay. So, we had the same exact language on the page and then we ran into we couldn't get around it. We had to give it back to the next, right? So, but the attorney saying that the their right of that has expired and whether it has or hasn't I don't know. It's was mentioned
>> if I remember correctly that's the exact same thing they said on the page.
Correct.
>> So, we start an RFP. We'll find out pretty quick.
>> Yeah.
>> If that's the case.
>> Right. And we don't want to spend a whole lot of money on label on this.
>> No.
>> At all.
>> Spend a little >> quite a bit on the page building.
>> Well, that's what I mean. All to find out that we had to give a building. So, >> right.
>> So, we make sure that the title is clear and as you say and we need to sit and think of how to put what to put in the RFP.
So, I guess tonight or if you if you could tell me which one you want to do first cuz I if it's 179 or if it's Rugles just some direction from the board and I can draft something and I can um have you guys look at it at at the next
Meeting. But I just need to know which one because I can't do both. I'm already working on the IT one.
>> So, the title is clear on 179.
>> Yep. Uh Katie um attorney Klein had >> right that's was a school in the town and it hasn't moved so >> right that property has been clear for a while see >> so um should we proceed that way come up
With two RFPs before our next meeting >> I can't do the I can't do both of them at your next meeting so I have to do the IT one but I can do one of them for your next meeting a draft Yeah.
>> Well, let's do the uh uh the Ruggles Hills Road School and we have to contact D.
We have to know that we're clear there, >> right?
Well, >> I I you know, in what I've I've done in research, um you can basically piggy back off of everything you did on the page without spending any astronomical amounts of money as long as the board agrees to do that and votes in favor of
Doing that.
>> But we still have to get the okay from D that it's a legal lot for us to develop or it's too close to the well. Um, well, do you want information on that?
>> Because I did that research back 10 years ago.
>> Does it still hold? Do you think >> it what the situation is according to D is that they they don't care. All right.
And correct me if I'm wrong, the tax maps cut your well out. The survey from 2014 does not cut the well out. Okay. Was there a survey done after 2014, Justine? Was there one done in the last
Couple of years on all of the buildings?
>> Uh, we use Gary Lamper. I don't think so.
>> Okay. Well, from 2014, it's a dotted line cutting out the wellwater. When I talked to D, they said there's a setback. Okay. at this particular point when you go by their rules and their regulations 150 ft if I recall that goes
About a foot into the corner of one of the building. Um when I talked to DP they said that um well who wants the building? Okay. And I I explained to them what we were going to do. He says what is going to take place on that side? I said it's only going to be gardens. He says, "Would you like me to
Take the the setback out of the building?" I said, "Well, it would be helpful when I paint the building so I don't have to ask you for permission." Okay. So DP said as long as the building was going to sit it because it's still within the zone as long as it wasn't going to be a
Auto repair facility. It wasn't going to do any of the things that they prohibit in their zone >> and it was basically going to stay within the same general makeup what that building's always been which is a school because we're going to do educational things out
Of there. They were perfectly fine with four set back up. They, you know, in my opinion, and I don't think that the mixers care at this point, my nonprofit is ultimately going to get that building. I am more than happy to argue with D down the line because I don't
Think it's going to be an argument.
And that the town does not have to go through whatever they have to do to get that set back pulled out like 5 ft or 10 ft.
But that is the situation. It's just a matter of they because it's in the the water situation, but I'm going to be in the same situation. I'm going to be planting like blueberries and peaches there and doing organic farming and gardening in that area. So, I don't want any problems either, and that's only
Going to help the wells, >> right? Um, still, I'd like to I think we should investigate a little bit with the EP and make sure what still goes >> what you just explained.
>> And I remember Justine saying something at one of one of these situations that she had uh talked to D and they were willing to pull the setback out of the building.
That's still >> we have to I'm sorry.
>> We'll do that. We'll call him I'll call him and and we'll talk to him.
>> Can do you mind if I just pay you back on this real quick?
>> Sure.
>> Um so any sort of disposition of property, any sort of real estate transaction, we need to have our town council involved. You know, that's, you know, why we we have them to, >> you know, advocate for us on our behalf.
Like they work for us. Um, >> so you're suggesting we get our town council to talk to DE?
>> No, I'm suggesting that we do our due diligence as a town. Um, I have contacts with them, just dealing with them on the sewer project side of it. Um, but I highly recommend that we follow the advice this time from our town council.
I mean, they do this for over 200 towns in the Commonwealth. You know, reading these correspondences, I think the board should take them seriously.
Well, we did take them seriously for the page building. We spent about what 6,500 in legal only to give up the page building.
>> But by the board that wasn't that was not the recommendation of town council or court or to go to court and fight this decision, >> right?
>> That was the option, >> right? We didn't know that we had trouble until we got into it.
>> So, I'm just saying I >> we already know our legal bills.
>> Yes.
>> Y right. I mean, and I I get it. We want to take the legal advice, but we can read the deed. If that restriction's on the deed, what do we do?
>> Sounds just like the page, >> right? So, I I would, you know, I'd recommend that you actually reach out to the Mixster Trust and say because ultimately we're only going to give it to them and what they do with that property is the same like they chose to do with the page builder,
>> you know, cuz once we give it to the mixer trust, that's it. The town's >> town. We can't say, "Oh, pass it on to this person. I'll pass it on to that." We lose all control over it. But we give it to them because it's on the deed.
>> Well, let's see the deed.
>> Right. Okay. We'll review it.
>> It's in your packet.
>> Okay. All right. You want to block together an RFP?
>> I can work on one. I'll draft something for your next building before our next meeting.
>> Yeah.
>> And then we'll know what we're talking about.
>> This was my question though, sir. On the RFP.
If we can't sell the building, we can only give it to the next trust.
>> Well, if that's the way that's the deed is written, >> right?
>> Right.
>> So then why do an RP? You know what I mean? We should read the the deed and and have town council or you know, we read it and say, is it the same language? Is are we going to have to give this back to the next trust?
>> Well, that's the thing. Why do the R >> cuz if we why do an RFP?
>> Why do the RFP if we're only going to end up in the same position again?
>> So what do you want to do now? Read the deed and figure it out.
>> I in my opinion, you know, with all due respect, Liz, >> we should be looking at the 179 Main Street RFP because that's clear. It's clear title. We We own the building.
We should get our ducks more in a row.
Figure out what we want to do with the Rugles School.
>> I think that's a good idea.
>> Well, we can reach out to D. We can reach out to the Minister Trust and we can read the dean and if we have any questions, we can run by town council.
We don't need to waste our >> right resource of resources to do an RFP that might not do anything. That's >> all right. So, we make some calls. We read the deed.
>> We talk about it at our next meeting and decide which way we're going to jump.
>> Exactly.
>> So, don't do don't work on something.
Prepare for your next.
>> Okay.
>> Just the Rugles not the Rugles Hill School, but 179 Main Street.
>> So, you do want a draft of that one.
Okay. I want to make sure I understand where Okay. Yeah. Don't write up an RFP for school.
>> Um, Mr. Chair, do you mind if I ask a quick question?
>> Um, Bill, if you want, I can set up a call with town council if you want to talk to them about Rugles in the meantime, too. Like if to make if you want to be get more comfortable and get your head wrapped around what they're saying. I absolutely don't mind doing that. You just have to let me know.
>> Okay.
>> Okay. I mean, I'll I'll look at the deed and everything.
>> I'd like to go through it, too.
>> Right. I haven't had >> the least we can call town council at this point. Right.
>> Yeah.
>> I don't >> Well, there we're going to have to ask, >> right? But they're clear, concise, >> clear, concise questions.
>> Yes, >> Bill.
>> Thank you. Um, I'm not 100% sure about this, but I think that the with the page building, the deed clearly said, you know, go the mixers have the right to provide for a dollar.
>> Correct.
>> And there was the question, well, did that expire or not? I think I think our town council said that's expired, but I think the the buyers, the friends of the page, their attorney or title company or something said, "No, we We won't accept that. You won't be able to accomplish
This unless the mixers unless it goes through their right of first take it for the dollar and then and then donate.
>> So they did that. I don't think there was a mixer trust until that >> need arose. So that so they >> created among the living beneficiaries or whatever uh and then transferred in that fashion. So one question would be and I guess here you've already looked at the deed is it is the language
Exactly the same? If it is then it seems like that one of the next questions would be does the buyer whoever that is are they able to are they able to take the property and buy the
Property without the concern that the that the friends of the page have? In other words, does it have to go through the page through the mixtures at all?
Because I don't I don't think the mixers would have cared if if it wasn't the opinion of the buyers that it had to go that route. So anyway, maybe maybe you do need that when it if it gets down to the RFP stage. I would just have this question. Liz has mentioned how things in historic district or historic
Buildings need to be mentioned. Um, so in any RFP about either of these properties, I guess that would be part of it. Sort of do your own diligence, but recognize that it's in an historic district. Um, I don't think, I may be wrong about this,
But I don't think that there is any requirement to have uh sustain this uh subsidized housing provided in in a development.
>> Um, doesn't have to be. We we have essentially none of that in town and it could continue that way. It puts us at risk for some other kinds of expedited developments, you know, that that could come our way. But, uh, if people know that and they're looking at an RP, then I think that they could, you know, could
Do their own diligence from there and maybe come up with an idea.
>> Okay. Thank you. Yes, ma'am.
Basically um I I understand you know that you have to do the due diligence.
The deed um says that if the building is not being used by the town, they have to go back to the heirs and the heirs being the same people that uh go you trickle down to the to the next trust. Okay. Um, and if if this going to
Be going this way, um, you know, you spend $6,500 on the page, why would you why would you spend anything to fight something that is going to be, I mean, kind of a losing battle in some ways because, you know, >> well, it was triggered by an offer or we
Were in the process of trying to sell it.
>> Mhm. and found out that that was not the way to go. So at this point, >> well, I think you know, >> we have to most people will look at a lot of people would look at that deed from the mixers and it would raise the same red flags. Okay, I I my nonprofit
Is not raising the red flags, okay?
Because um we're not going to mess with the building or anything like that, okay? Um and and wait.
>> You're going to re you're planning to >> get a hold of this building and fix it.
>> Yeah. We're going to fix it back to where it's going to look just like it did before.
>> Renovate it. And you're going to You were talking community kitchen and glasses and all sorts of great stuff.
>> Mhm.
>> And there's a group behind you.
>> This is what >> a group of people behind you to do this.
>> Yes.
>> Okay. I mean, we're already we're already in the, you know, we've gone and filed for our 501c3. We're already investigating grants, which, you know, I can't go and put in yet because I don't want to have to explain if I have to give them back, you know. So, um it's
It's that type of situation. I mean, we're ready, willing, and able to um fix that building. Same situation.
>> All right. So, we're going to read the deed.
We're going to contact D. Make sure that this is still doable.
>> Yep.
>> We're focusing on Rugles Hill Road.
>> I thought it was 179.
>> 179 Main Street in Gilbertville. We're focusing on for the RFP.
>> For the RFP.
>> Before we do an RFP on this, we have to figure out >> I'm going to call D and we'll follow that down. We'll read the deed and and we come up with an RFP for the white building >> and I'll have it on your agenda for the next meeting.
>> Okay. Agreeable.
>> Reach. Should we reach out to Mr. Trust if you'd like?
>> Okay. Sure. You want to do that?
>> Sure.
>> I'll give you the contact.
>> Okay.
>> Um and just just so that Justin just so you know, there's at least two RFPs that are already been written for that building.
>> I've seen I've seen them. Do you mind if I respond to what Mr. poll said.
>> Thanks. Um, so you're talking about chapter 40b, which is the um the 10% that we're required to have for lower than housing. I actually don't know off the top made the percentage of what Hardwick has. Um, >> less than 1%, >> but that's a it was stated that it was a federal law. It's actually a state law.
And we actually that would not be triggered by someone wanting to come in and put in condos. So, I just wanted to make sure >> condos I don't know. It wouldn't have isn't attributed by apartments.
>> No, not at all. Um, >> number of units.
>> No. And just cuz it was um talked about historic district. Um so when I put together the one for the RFP for the page building, I actually worked with Paula who is very knowledgeable and the historic nature and the historic
Districts and all the facts and information that she gathered for me.
So that I'm sure I'm hoping that you'll help me with this one too. So yeah that's the historic nature of these buildings is covered by what I consider to be an expert.
>> Yeah.
>> One thing chair um you did mention we we didn't put on an RFP on this property and that's what happened with the page by us trying to sell that property. Excuse me. By us trying to sell that property is what triggered the actual reversal. We haven't technically
Done anything to trigger that reversal.
>> That's what I was asking. How do we trigger that?
>> Right. But that's why we just ask the mixer trust. We we give it to you. Find out.
>> Yeah. Good.
>> We'll just give it to you and and then you do what you want to do with that property.
>> Right.
>> So, it saves us from doing an RFP, triggering it, and then them showing up saying, "Hey, we want it." >> Right.
>> You know that. I think they add to it anyway.
>> Just make it easy, >> right?
>> All right. I'm still going to call D.
>> Yep.
>> Oh, absolutely.
>> Yeah.
>> It's a town. Well, >> town.
>> Yeah. We don't want to give that away.
>> Okay.
Okay. Um, I guess we'll keep going.
Cemetery commission.
>> Which item? There's three of them. Is it take them in order discussion and vote on cemetery commission revolving account?
>> So the cemetery commission has had a has a revolving account even before I went on the commission which was probably five or six years ago. And in the revolving account um and I do have the certification from Ryan. It's this piece of paper right here.
>> Yep. It's in your packets.
>> Yep. And um so under the cemetery commission, we can only withdraw $5,000 of any money that is in the revolving fund today.
That would be this piece of paper and it was from um the town accountant. Today we have $11,767.36 in the revolving fund. But in this 26 fiscal year, we can only spend $5,000
Of that $11,700.
>> Mhm. So, um, we would like we would we are asking the select then to and the finance committee to vote that we can spend up to $11,000 in this fiscal year, both the finance committee and the
Select, and let the town accountant know, >> yes, >> that we can spend up to $11,000 in this fiscal year. and at the annual town meeting because that's the only time that you can make changes to the revolving fund unless the finance committee is selected through the first
Fiscal year vote um differently um that we could spend up to $11,000. When the town meeting comes, we will ask the town meeting, we will put it right in the in our um revolving fund that we're going to now spend up to $11,000. And just to
Let you know, in prior years, we have never raised $11,000 in a in a fiscal year. That $5,000 limit that we have had in the revolving fund
Has always been enough of money because that's all that we've earned in that fiscal year from July 1st to December 31st of 25.
We earned $11,000. We have had a very very busy six first six months of this fiscal year. with deaths, burials, whether they be cremations or full burials, as well as monuments,
And ground markers. Because for a monument or a ground marker, we require a footing that the people who own the um the lot have to pay for. So we have had a a bonus year of a lot of burials and footings that we have had to
Put in. So we have a lot of things that that we could do at the cemetery.
That's why I'm asking if you could raise our revolving amount to this to $11,000.
>> Bill, but >> this wouldn't take effect until next fiscal year. No, it would take effect once the f the the the um the accountant has the vote of the selectman and the finance committee.
>> Okay. So you're looking >> and I did give you a copy also >> right here of the of the our town bylaw which allows the finance committee and and selectment during the fiscal year to
Raise the amount of money that a committee can take out of the revolving fund. It's it's right here.
>> Okay.
And just to clarify, Paula, you're asking for 11,500, >> right? I'm sorry. That is what it is.
>> Right now.
>> Well, they have >> Well, all they need is our approval, >> right? And it's money that we've raised.
I mean, it's not it's not any town money or anything.
>> So >> Well, Fin Comm will be here next week.
Yeah. Monday. Could we do it at that meeting?
>> We could do it right here tonight.
>> We could do it right here right now.
>> Just remind them to do their vote.
>> When do they >> on Monday, >> next joint meeting?
>> Monday. Does that you guys have your joint meeting? Um I can talk to the chair prior to the meeting and make sure it gets on his agenda as well.
>> Okay.
>> So, do you want to do that? Do our part tonight.
>> Sure.
>> Okay. I make a motion that we raise the limit that the cemetery commission can take out of their revolving fund to $11,500.
>> I'll second a motion. Further discussion.
Okay. All in favor?
>> I I your next item, ma'am.
>> The mowing contract.
So um the cemetery commission met and we voted to award the bid for the mowing and caretaking of the cemeteries and comment to Larry Creier in the amount of $25,500.
That is $1,000 more than what she did last year.
And the year before, that was in fiscal year 24, she went down. She was $500 less. Last year, she she was the same amount, and this year she's bringing it up to 25,500.
I did send the RFP out to some of the local landscapers in the area and for the past four or five years she's been the only one who bids and I think that the reason that the local landscapers aren't interested in our bid
Is because it's not only the mowing of the cemeteries common it's also um picking up all of the branches and everything that falls throughout the whole year. If we want to have grass planted or
Anything done to the um lawns that we're in charge of, they do that. The same thing with when we have a burial, we usually leave all of the flowers from a funeral there for a couple weeks. they have to come back, pick up the flowers,
And bring them to our graveyard, for lack of a better word.
Also, if for some reason the people who do our our burial digging for us are not available, they would have to come in and do the b do the digging for the burials. And there's numerous other jobs. Anyways, the local
Landscapers, they just want to come in and mow and get the hang out and uh that that isn't what we require. We require a lot more and they have to use their own equipment, their own gas.
We don't provide them with anything whatsoever.
>> Lori Corvier is going to do all of those things.
>> That's correct. Right. Yeah, we've been very happy. Yep. And if we haven't been if there has been a problem, we've just talked it over and they take care of it right away.
>> Okay. Okay. That's great.
>> All right. I'll make a motion to award the uh mowing of cemeteries and common area contract to Lorie Crevier of Barry Mass.
>> 25,500.
>> I'll second it. Okay. All in favor?
>> I.
>> All right, we have one more.
>> I have one more.
>> Yeah, we have a an appointment of Frank Hansen.
>> Right. We've had a vacancy on the cemetery for almost a year and a half now.
Benny Hansen was the um was a member of our board and over this period of time we'd asked different people to come on board.
People were always hesitant because we kind of explained to them that we are a working board. We're the ones who sell the lots. We're the ones when there's a burial. We work with the funeral parlors and mark out where the where the digging has to take place.
We take care of all of the money that comes in depositing it into the various accounts that we have.
We're just a working board. And >> who else is on it?
>> Jimmy Sweat. Jimmy is the chairman and I'm the clerk.
>> Mhm. Jimmy's been on the board probably >> for about eight years now at least.
Yeah. He's been on longer than I have.
>> Yeah. And we both still like it and everything. And really what we're looking for is a working member who's going to who's going to be available on a Monday or on a Saturday or Tuesday or or something like that. you know, if somebody passes away, especially if it's a full burial,
Usually within two or three or 4 days, they want that burial to happen. So, and we're busy getting the records out, measuring to make sure that there's room for this person in this particular lot, marking it out, contacting our the gravedigger, making
Sure that the lot that the um hole is dug for the burial, closing it up, planting, putting the lawn down, the loom down, grass seed.
This there's a lot of work, you know. So we had four people who were interested.
And on the weekend before the cemetery commission met, one of the gentlemen who was interested called me to say that he was withdrawing his name.
But Jimmy via the telephone talked to all four members and told them what he does his part.
I met with two of those four gentlemen and they came upstairs to my office and I went over with them what I do so that so that they would have a good picture of what goes on that we do.
So, um, when Jimmy and I met, we just really felt that, um, Frank Hansen was going to be the one who was going to have the time, to put in to work with us, be available when we need somebody to be available. So, that's why we we voted unanimously to bring his name up before
The board of selectment.
>> Thanks, Standing. Yeah, right. I I have no issues that I uh I make a motion to appoint Frank Hansen as the third member of the Hardwick Cemetery Commission.
>> Seconded.
>> All in favor?
>> I >> Thank you, gentlemen.
>> Thank you.
>> Thank you, Mayor.
>> Mr. Chair.
>> Yes.
>> Paul's here. Can I ask one question?
>> Absolutely. I was just a little uncertain about what you're saying about the annual town meeting and the now increased $11,000 that the commission take out. Well, here's the question. Oh, sure. So, the the motion was to do that for this current fiscal year and then also at the at the end meeting you would
>> this would confirm the vote of the board of select new finance committee, right? and it would leave our our um limit from from the annual town meeting forward at $11,000 even if we
Didn't raise $11,000.
But we would be able to spend up to $11,000 in our revolving fund.
>> You're not needing to spend that money in this fiscal year. You are this year before that.
>> Absolutely. Oh yeah.
>> What do you What do you intend to spend it on? I know that it's late. We would like to um take out some more stumps that whenever it seems in the past whenever a tree came down whether the
Cemetery commissioners, not us, but prior cemetery commissioners had a tree taken down or if because of the weather, winds and everything, a tree fell, they would have the tree removed. the fallen tree removed, but they would leave the stumps there. And so that is
Something that we're going to do is take out some more stumps.
Also, some more trees. We would like to have some more trees taken down, chipped, and the stumps removed. Also, and I know you're not going to know where I'm talking about, but anyways, in section 10 along the stone wall, um, we're hoping that we're going to have
Enough of money to have somebody come in with the right equipment and dig all of that up and then plant grass and make it nice and level so that we would be able to sell that particular area for um, burial plots.
>> Okay, thank you.
>> And then we had, you know, there's some of the areas of the grass area that really need some attention with the right kind of fertilizer and ant removal, whatever you do and and and more um grass planting.
>> There's plenty nothing has ever been done at that cemetery. Nothing, you know.
>> So, we're just trying to pick out the the biggest things. Sometimes a stone pillar gets knocked over in a tornado and has to be repaired, >> right? You know all about that. Yeah. So >> great. Mhm.
>> Okay. Thank you. Thank you.
>> Yeah. Do you want me to leave you a copy of it just a better understanding? Okay.
I'm going to make a copy of it and I'll leave it in the planning board though.
>> Okay. Good. Thank you.
>> Last last item of new business is uh to vote and sign the May 2nd, 2026 election warrant.
>> Mr. Chair, the recommendation of the town clerk is that polls should be open from 10 to 6:00 on May 2nd. Um we have two contested races um board of health and select board. Um so at your pleasure if you vote um I do have the warrant available for you to sign tonight.
>> I make a motion that we sign the uh May 2nd election warrant.
Second.
All >> in favor.
>> We just second it. So I don't need to talk over.
>> Okay.
>> Thank you.
>> I can't make a move.
Those
Are their comments.
Okay.
Minutes.
>> So I just so the board is aware I put them in order not necessarily as of received but just in order in terms of date uh with regular session first and executive second. So just nowhere.
>> Uh the executive session minutes are pretty much all contracts, Ziko, page building stuff and we can deal with
That because that's all complete. Uh the workplace complaint is it's >> not typed up yet anyway.
>> Town council suggested but we can't drag that out uh into the daylight yet. I will double check that and get it in.
>> Okay. I I I have it on my computer, but I haven't finished typing the minutes out anyway.
>> That would be only you and me anyway.
>> All right. July 14th, >> 2025 taking this printed few minutes.
>> Yeah, just real quick on the executive session part of it. Um, you know, on some of the stuff, we should be meeting in the executive session to go over these meeting minutes and approve them and decide what whether we're going to make them public or not.
>> You want to do that?
>> Because because if they're confidential, we haven't we haven't done a vote to this board to release them, >> right? or approval. Well, I checked today and it's some of the stuff we can't do that with, but the other is done.
>> Okay.
>> And out in the open.
>> So, we can proceed, but >> Okay.
>> We can also hold off if you want.
>> No, I'm just saying, you know, I'm just bringing it to your attention, Mr.
Chair. That's all that you know on some of these that are still confidential we should have an executive session to discuss and approve the meeting minutes whether they remain confidential you know what I mean >> and the only ones that are confidential are as far as I know uh the ones about
The workplace complaint the rest of it is I mean the Ziko stuff that's up and out and done okay so it's not it's not really confidential the other is to protect private I see. So, >> so you can approve executive session meeting minutes in open session. If
There was something that you wanted the executive session for, you just have to let me know. But the ones that are provided in tonight's um tonight's meeting can be approved and open.
>> Yes.
>> All right. Well, >> you want to start us off?
>> Sure.
July 14th, 2025, New Branchry Town Hall.
I reviewed it. I have no issues with it.
You, sir, >> I reviewed it as well. I have no issues with it. I'll make a motion to approve meeting minutes for July 14th, 2025.
>> I'll second a motion. All in favor? I I October 1st.
>> October 1st.
Let's see.
As well, I don't have any issues with that, sir.
Neither do I. I'll make a motion we approve October 1st, 2025 meeting minutes.
>> Seconded.
>> October 1st.
>> Yes.
All in favor?
>> I I Okay. October 27th, 2025. So, this is I do have issue with this. Um, doesn't include the executive session, the roll call vote, any record of us going into executive session in the record.
>> It also has numerous misspellings, >> right? Yeah, we should probably table it and then make the corrections and >> I'll agree to that.
>> Okay. So, we'll table October 27th.
December 16th.
Excuse me one second. Just find it.
That one we just have to amend because that one that it's a new brain tree.
Yeah, >> Jeff, you were not at that meeting.
>> You are correct.
>> Right. So, you were listed and you actually did a motion in that meeting.
So, I amend like I recommend we amend.
Strike Jeff is absent. And I believe I made the motion. You second the motion, Mr. B.
>> So, if we make the amendment, we approve it.
>> Okay.
>> That one was completely me and that's my fault. Okay.
>> I move that. No, I can't.
>> So, okay. I move that we approve December 16th, 2025 meeting minutes as amended.
>> Yes.
>> Second.
>> I can't f >> Okay, >> that one was on me.
>> Okay, so January 28, 2026.
No similar thing. We should table this because there's no executive session roll call vote um attendance >> spellings and >> grammar so yeah >> so what are we going to do with these?
We're going to put them into a executive session meeting and go over whatever we can't digest.
>> No, I'm just saying in the in the meeting minute record itself, >> right, >> didn't list the role called vote to go into executive session. It's not the executive session. It's the public record, >> right? So we just have to add that item.
>> Yes.
>> And then we have numerous I was noticing >> I looked at both these last two tables meeting minutes and there are numerous misspellings, grammatical errors.
>> Yeah.
>> Uh yeah, I I'd love to have the opportunity to go through and redline them as I'm sure Bill does and >> Okay.
>> So we table it to the next meeting, make the changes and approve it. May 28th.
Yes.
>> Okay. February 18th.
>> February 18th.
I went through it before I did not get
Still the spelling errors in this one too.
>> Yeah, it's just and and also I mean like yeah like Jeffrey Schmidt Jeffrey Smith >> um stuff like that >> scheme is also >> Yeah. Yeah, that's hacked pretty good.
>> All right, >> we should table it.
>> All right, table make changes and then approve it. Um, and we probably just have to add a couple like if if we want deep I don't know how detailed we want to be, but who made the motion and a vote.
>> That's all we really need, >> right?
>> And what the motion was.
>> Yeah. We just got to add that in here and there on on February 18th, 2026.
>> So, we'll table that.
March 4th, I'm okay with. I have no issues unless somebody else does.
All right. Um, >> I have no issues with it as well. I'll move to approve the meeting minutes for March 4th, 2026.
>> Second.
All >> in favor?
>> I >> March 9th.
Don't have any issues.
>> Same here. Uh move to uh approve meeting minutes for March 9th, 2026.
>> Second.
In favor?
>> I I >> So after tonight, I will go and I'll update the list to see where we are and I'll send the board an update if what's still outstanding.
>> Okay.
>> I was waiting to see what was approved tonight before I went ahead and did that. Yeah, that's good.
>> And we're not doing the executive session minutes or are we?
>> You think you're comfortable with them?
>> I'm comfortable with them. I typed them up.
>> Would you like to make a motion?
>> I'm going to let Bill look at it first.
I don't want to presume he's got no issues with them.
Some of them are short and sweet.
>> Well, like June 9th, I recuse myself.
So, you guys >> Oh, yeah. All right.
>> So, that's between the two.
>> I'll make a motion to approve the executive session meeting meeting minutes for June 9th, 2025.
>> I'll second it. All in favor?
>> I.
>> And you're abstaining?
>> Yes.
>> Now, October 14th. Yep. I don't have any issues with it.
>> We'll move to approve the executive session meeting minutes for October 20 14th, 2025.
>> Second.
All >> in favor?
>> I October 27th, 2025.
>> Anything, Bill?
>> Um, yeah.
>> Okay. There was there was so it says, you know, I made the thing that I recommended that the contract was invalid.
Well, we needed us to amend and add because there was no public vote made by the select board. That was my statement.
Sound red.
All right. No public vote.
>> Yeah.
>> Where is it?
It's It says William Tinker states the contract is invalid and the select board did not vote to sign the contract.
>> Well, right. We did not We did not do a public vote.
>> Did not have >> Well, have a public vote.
>> Did not have >> I make that amendment.
>> I can make that amendment before I post them.
>> And I'm I'm just writing it down here.
>> I'll make a motion to approve October 27th executive session >> as amended. as amended.
>> Second.
>> I'll second.
>> Okay. All in favor?
>> I November >> November.
>> November 10th, 2025.
>> And and I just make the same amendment.
There was my statement was there was no public vote on the board. That's all.
>> Okay.
It's the same thing. Yeah, because I just copied it right over. It was the same thing.
>> So, I'll make a motion to approve November 10th, 2025 with that amendment.
>> I'll second. All >> in favor?
>> I >> I recruiting.
>> Yeah, we are.
>> This is This is not as painful as I thought it would be.
>> Maybe. Don't you?
>> Yeah.
>> November 24th. November 24th, 2025.
Let's see. Bill Tinker was not at this one.
>> Right. I was not at this and I don't see I don't know if the the public one, but I I recuse myself.
>> You recused yourself?
>> Yes.
>> But uh our Zoom meeting was cancelled anyway.
>> And there's also another executive session for that same date, November 2024.
>> Yes, there is. I I have that on my computer at home. It's not part of >> what I've submitted yet.
>> Okay.
>> Because that is the personnel issue.
>> Okay.
>> But for the other the 24th is >> Yeah. This is the one at 6:05 or 6:00 was when it was supposed to start. So, I'll make a motion to uh approve the November 2024 meeting minute executive session
Meeting minutes for the 6:00 executive session.
>> I'll second it. All >> in favor?
>> I see the wind report. Would you like to do your report?
>> I'd love to. Thank you. Um so I've been meeting with Mark Corzac from the finance committee on the FY27 budget.
Really getting the hoping to get the finance committee a really good grasp on where we are with our debt and how where we were and how we got here and what we're doing now. And u I think it's been really helpful um especially going into those joint meetings. So I have another meeting with him tomorrow.
We had two public records appeals and one new public records request. Met with the highway superintendent and Harry Cmerford today on the excess gravel near Roach Field. So for your next meeting there's going to be an item to for the board to declare that gravel surplus so we can start the next process um which
Is um getting money for our excess gravel. So um look for that on your next agenda.
Had a call with Central Mass Regional Planning Commission um and Chairman Wallheim on the MVP grant project of the town of Harston. So, we got two bids back for the project and right now we are in the process of uh doing the evaluation for which one we're going to go with.
Met with the police chief, the fire chief and fire chief from New Brainree regarding the regionalization possibility uh with the fire departments between the two communities. Um, so everything will be prepared for your next joint meeting which is next Thursday at six o'clock.
>> Yeah.
>> Yes.
>> Um, met with Barry on the senior center regional agreement and shocker. I actually um invited chair uh Sman Tanker because I really wanted a member from the board present because I feel like every time I walk into a meeting with Barry, it gets very contentious around money. So, I really wanted a member of
The select board there um because that's ultimately going to come up before the board. So, it just made sense to have everyone be informed that way. We are advertising for a wastewater treatment plant operator, a highway equipment operator, and a van driver. We had one of our highway employees quit the other
Day. So, we are not just under staff, we are under staff now twice. Um we held our annual mandatory department head training. This year's training was on prioritizing and managing a multigenerational workplace. We had our insurance company, Maya, come in and do the training.
All the department heads were there and assistant department heads. It was a really good turnout and I think um, for the most part, everyone really enjoyed it.
I attended the Massachusetts Municipal Managers Association conference on risk management for town managers, administrators, and navigating personnel problems and legal landmines.
Just a fun little tidbit, I've been elected for the fourth year in a row to the Massachusetts Education and Government Association. Uh, we specialize in workers comp for municipalities and school districts. Um, so I've been elected for the fourth time. Um, I attended a quab watershed
Meeting.
For recognition, I want to recognize three of our firefighters that graduated the fire academy.
Firefighter Christian Lul, firefighter Kevin Thompson, and Joel Ek. and firefighter Thompson also received the outstanding student award.
>> Excellent.
>> Yeah, he's a friend friend of my sons.
>> Good job.
>> Um, important dates. Representative Bertham and Senator Durant are holding their April office hours here on April 7th from 10 to 11 and our annual town election is May 2nd. So that's what I have tonight. Mr. Mr.
Chair, question.
>> Yes, sir.
>> I didn't hear anything in the town administrator's report regarding the town accountant passing or not passing the test that she was taking that was talked about in the last meeting.
>> She doesn't know. I don't know. I wasn't I haven't seen her. I was at my conference last week. I was >> hoping for an update. Okay.
>> Thank you.
>> Round table.
>> I have nothing at the moment.
>> Round table.
For the most part this week I I'm not going to really mention anything.
I'll mention that at the next meeting once I have some answers on some stuff. That's all. Okay. The uh grant up at the old town hall is uh uh hurting.
We couldn't get any bids.
We didn't get any interest. Well, we did a walk through.
The first time, not very many people showed. Second time we had five or six contractors running around. And, uh, and this last week we had another walkth through and nobody showed at all. So, um, DBPC is breaking
It up, and trying to contact people who asked for plans, >> but it's not looking too wonderful.
>> Do you have a feel for why it's >> I don't I'm not really familiar with the scope of work or what you're trying to do up there. Okay. gutters. Uh originally rebuilding windows,
Storm windows, gutters.
The front where the stone the portico is uh years some years ago it was dug out for an inspection by some architectural historical something and they took out clay and they replaced
It with sand. So now it at that portico the stones that are laid there the water just goes right in goes down into the cell.
>> So the scope didn't include that. It included patching the stones at the surface level with you know cement.
>> Yep.
>> So that's pretty much it. Paint the port the cupula. Okay. So, my thinking, and it's just an idea or a thought, you know, is can we use some of this grant money and offer employees in this town to say do the gutters and pay them time
And a half, but do a Friday, do a Saturday. We bring in a gutter guide and make the gutter right on site and they hang it with a box truck.
>> It's an excellent idea.
No, we'll find out.
>> Okay.
And then you know other areas like you know you mentioned the sand like dig out the sand fill it with clay >> you know >> that would be pay all these people time and a half you know I mean basically we'd be asking Marty and his guys if that would something they want to do but we and we could put it out to the water
Guys as well. I mean, any employee that's filing will do some >> better tradesmen in in town, they're largely busy, but the grant expires in August. So, >> right. So, the more more we can do, >> it's just a suggestion.
>> No, I'll check with with the controllers.
>> Okay.
>> Anybody else?
>> If I may, Mr. Yeah, the uh I just want to learn what kind of went wrong in this process so we can maybe avoid it next time. Would it be fair to say that the original scope of work that was bid with PBPC was >> was
>> too large, >> too expensive. I mean, we we were not really going to get something that came in at $95,000 or less. And then you're we're unable or the PBPC is unable to like at that time adjust it and say, "Well, how about you just do half of the work for for half of the money that you
That you bid." I mean, >> well, that was tried. They chopped it up >> and they can't and that doesn't work, right? So, you can't >> parcel it up or >> Yeah, they they broke it down and it would have been possible this last time to do pieces of it, but not. So,
And I wasn't involved in the original scope of work or the clay sand thing would have kind of a fixed cuz that's probably the easiest thing to part.
But, yep. So, hoping for a fix and I'll check that out. Try to get some room for local tradesmen. Okay.
>> Anything else, Mr. Chairman >> looking for a motion to adjurnn.
>> So moved.
>> Second. All in >> favor. All right.
[00:00:00] meeting to order. I'd like to pledge [00:00:02] allegiance to the flag. [00:00:08] I pledge allegiance to the flag of the [00:00:10] United States of America and to the [00:00:13] republic for which it stands, one nation [00:00:16] under God, indivisible, with liberty and [00:00:19] justice for all. [00:00:24] Now, tonight we have a lot of minutes to [00:00:27] go over. [00:00:30] We have some other items. I would like [00:00:33] to put the minutes off to the end and [00:00:36] deal with people who are here to speak [00:00:39] so that they don't get tangled up. No [00:00:42] problem. And uh so uh I'd start with uh [00:00:49] Felix and I'm sorry I don't know your [00:00:52] last name. [00:00:54] >> And we were interested in talking about [00:00:56] 179 Main Street. Yes, [00:00:58] >> the white builders. So, I'll turn it [00:01:01] over to you. [00:01:02] >> Yeah. [00:01:03] >> Um, thank you for having me on the [00:01:06] agenda today. Um, [00:01:09] so the white building I came about it I [00:01:11] would I own the building right next to [00:01:13] it. Um, actually, so one has a building [00:01:16] I own and the building right next to it [00:01:18] is the abandoned building, right? So, I [00:01:21] was just trying to do some work on my [00:01:24] own property when uh Marty Henderson [00:01:27] Almighty, the high wishing protectant, [00:01:29] happened to be around the building. Um [00:01:31] him and I started talking and I asked [00:01:32] him what the story was with the building [00:01:34] and he said it's been abandoned for a [00:01:36] while. So, him and I kind of walked in [00:01:38] toward the building, told him, you know, [00:01:40] I'd be interested to see what the town [00:01:41] would be willing to do with the [00:01:42] building. Um, so I'm here proposing or [00:01:46] just first of all introducing myself and [00:01:49] you guys know who I am, but also letting [00:01:51] you know that we are interested in [00:01:54] pursuing that white building as um some [00:01:58] form of housing, whether that would be [00:02:00] some condos, whether that would be some [00:02:02] apartments. Um, that's what our interest [00:02:05] is. Um, I think Eric, we had met in the [00:02:09] summer, like late summer, my wife and I [00:02:11] met with you. [00:02:12] >> Yeah. And um at the time there was maybe [00:02:16] some discussions going on with the page [00:02:17] building and we thought there were title [00:02:19] issues that would affect all of the [00:02:20] buildings. So we kind of put everything [00:02:22] on hold. Um now it sounds like the page [00:02:24] has kind of been sorted out. So I'm not [00:02:26] sure where that building stands um in [00:02:29] terms of that. But, uh, I really just [00:02:32] wanted to put out what my suggestion is [00:02:36] and, um, [00:02:38] see if it's something I think town could [00:02:42] benefit from having a building like that [00:02:44] renovated, fixed up, being put back to [00:02:47] use. Um, when I looked at it with Marty, [00:02:49] it looked like it was in decent shape on [00:02:52] the inside, given it's been left for 12 [00:02:55] years with no use. Mhm. [00:02:57] >> Um, [00:02:59] so yeah, I just want to get the RFP [00:03:01] going or [00:03:03] >> get a discussion of how we can, you [00:03:07] know, find mutual agreement um to make [00:03:09] that building back or put that building [00:03:11] back to use. [00:03:13] >> Well, I think we're getting close to the [00:03:14] RFP stage with this building and another [00:03:18] that we'll be talking about tonight. So, [00:03:21] um, it was, uh, was it was a good time [00:03:24] that you came and blessed us again. [00:03:27] >> Yeah. [00:03:27] >> Would you like to ask any questions, [00:03:29] sir? [00:03:30] >> And when you say we, it's just you and [00:03:33] your wife or is it a group of people? [00:03:35] >> No, just just my wife. Okay. Yeah, just [00:03:43] questions at this point. I mean, [00:03:46] um, [00:03:48] condo like what are you like what are [00:03:51] you kind of considering? Is it going to [00:03:53] be low income housing, elderly housing [00:03:56] or just housing? [00:03:58] >> Just housing. We weren't really [00:03:59] considering low income. [00:04:00] >> Okay. [00:04:01] >> Um, we're just going to make it housing. [00:04:03] >> Mhm. Um, initial thought was about just [00:04:06] looking at the footprint and having my [00:04:08] engineers look at the building and and [00:04:10] the architecture, the layout, the square [00:04:12] footage, [00:04:13] >> about 14 apartments. [00:04:16] >> Mhm. [00:04:16] >> Um, 10 to 14 apartments or we could also [00:04:20] do some condominium style housing as [00:04:22] well where there's bigger more units um [00:04:26] like more bedrooms um but fewer units. [00:04:30] Um, but that was [00:04:33] >> Yeah, that was my initial thought. [00:04:34] >> All right. Thank you. [00:04:36] >> Yeah. [00:04:39] >> Okay. [00:04:42] >> Anybody else? [00:04:44] >> Yes, ma'am. [00:04:45] >> Um, where are you going to put the 14 [00:04:47] apartments? [00:04:49] >> Same footprint of the building. [00:04:52] >> Got the whole building and fit the 14 [00:04:55] apartments in there. So obviously this [00:04:57] is just hypothetically what I envision [00:05:00] doing, right? So [00:05:03] >> how many square feet are each one of [00:05:05] those apartments going 20 feet? [00:05:06] >> 900 roughly. 900,000. [00:05:13] >> Okay. [00:05:14] >> Um are you aware of the fact that it is [00:05:17] a historic building? [00:05:19] >> Yeah. [00:05:20] >> Okay. What are you going to do to [00:05:21] preserve the historic? [00:05:24] >> So that's where I want to work with the [00:05:25] town, right? This is this is just the [00:05:27] very beginning. I haven't even [00:05:30] done a lot to look into that part of it. [00:05:34] Uh this is just at the very beginning [00:05:36] across. [00:05:37] >> Are you are you aware of the fact that [00:05:38] it's in a historic district? [00:05:40] >> Yes, I am. [00:05:41] >> Okay. [00:05:44] >> That will affect what you can do on the [00:05:46] outside of the building. [00:05:49] >> I'm not even looking to um my plan is [00:05:53] not to change the outside of the [00:05:54] building. Right. I don't plan to make [00:05:58] this some modern looking like building. [00:06:01] Right. I'm trying to preserve as much of [00:06:04] the building as I can. Um [00:06:07] I've done projects where we've tried to [00:06:11] rehabilitate. I mean, we've met with the [00:06:13] historical community that have come [00:06:15] looked at the building. [00:06:15] >> Well, I'm on the historic commission. [00:06:17] That's why I'm asking. [00:06:18] >> Right. So I've met with people like you [00:06:20] uh who have come on site, looked at a [00:06:22] building, [00:06:23] >> gone through the viability of either [00:06:25] saving it, proposing in some situations [00:06:28] the building is so far gone that it has [00:06:30] to be torn down, [00:06:32] >> but we look for things we can preserve. [00:06:33] What can we preserve that we can put [00:06:35] back in the building? I don't think this [00:06:36] building is anywhere close. [00:06:37] >> It's not. So I wouldn't I wouldn't be [00:06:40] looking to um make drastic modifications [00:06:44] to what's already there. It's more [00:06:45] what's inside. [00:06:47] Are you talking onebedroom apartments? [00:06:50] >> So there was a consideration of majority [00:06:52] two bedrooms. Um [00:06:53] >> two bedrooms and 900 ft. [00:06:55] >> Two bedrooms would be at 1,000 ft. [00:06:56] >> 1,000 ft. [00:06:57] >> Right. And then the one bedrooms would [00:06:59] be [00:07:01] more like the 800 foot range. Um you're [00:07:05] aware of the fact that under that um [00:07:08] allowment of apartments that certain [00:07:09] percentage of them have to be kept as [00:07:12] low income by uh the feds have rules and [00:07:16] regulations. [00:07:16] >> So yeah. So I don't know where the [00:07:18] threshold of the town is. I don't know [00:07:20] how much low income the town has. It [00:07:22] depend the threshold of what's required. [00:07:25] >> Hardook is considered a lowinccome town. [00:07:28] >> Yeah. So the there when you do housing [00:07:31] according to the feds there's a certain [00:07:33] amount you have to put aside for low [00:07:34] income. Correct gentlemen. [00:07:36] >> There'll be u I'm sure that Felix is [00:07:40] going to run into all sorts of reds at [00:07:42] this point. [00:07:44] >> It's like you said it's the beginning [00:07:46] stages. [00:07:46] >> Yeah. It's preliminary. [00:07:48] >> Mhm. [00:07:49] >> Exactly. [00:07:50] >> We haven't even got an arrested. [00:07:57] Thank you. [00:07:57] >> I'm asking him questions that he may or [00:08:00] may not know so that he can make [00:08:02] informed decisions. [00:08:03] >> Thank you. [00:08:04] >> Yeah. [00:08:06] >> Okay. [00:08:07] >> Thank you. [00:08:07] >> All right. Thank you so much for coming. [00:08:09] >> All right. Thank you. [00:08:11] >> Has [00:08:12] just briefly. [00:08:14] >> Would you kindly spell your last name, [00:08:15] Felix, and and have you done something [00:08:18] like this before? [00:08:19] >> So, I've not done something of this [00:08:20] magnitude before, but I have done [00:08:22] something similar, smaller. Um, my last [00:08:25] name is W A and I'm like Mary Be like [00:08:28] boy. You are you [00:08:35] home? [00:08:36] >> I live in Southport. [00:08:40] >> And that's Bill Cole. He's chair of the [00:08:42] planning board. [00:08:43] >> Yes, I'm okay. I just [00:08:46] >> Thank you. [00:08:46] >> Yeah, no problem. [00:08:48] >> We got some heavy hitters in the room. [00:08:50] That's fine. I'm just [00:08:52] >> Mr. Chair. Yes, ma'am. [00:08:54] >> Um, so after tonight or whatever [00:08:56] direction that the board chooses, um, I [00:08:58] can let uh, Felix know and whoever might [00:09:01] be interested if that's [00:09:05] >> okay. [00:09:06] >> All right. Great. [00:09:07] >> Well, thank you so much for your time. [00:09:09] >> Thank you, sir. Appreciate it. [00:09:14] >> Should we just go right across to a [00:09:17] discussion on Rugles Hill Street? [00:09:21] Sure. Yeah. No reason why you can put [00:09:24] it. [00:09:25] >> Did you get a you got an email from [00:09:29] Jesus? Mr. [00:09:30] >> Yep. I responded. [00:09:31] >> Okay. [00:09:35] >> Take the lead here, per se. [00:09:38] >> Take the lead. Uh well, I assumed that [00:09:40] um Liz was interested in talking about [00:09:43] it or uh [00:09:45] >> um uh the the situation is that um it's [00:09:50] basically as we all know there's a uh a [00:09:54] restriction on the deed and the mixture [00:09:56] family is uh interested and wants to do [00:10:00] the exact same thing they did with the [00:10:01] page building is to take it back and [00:10:03] then transfer it to another. [00:10:05] >> You're sure of that? [00:10:06] >> I'm sure of that. [00:10:07] >> Okay. [00:10:08] Okay. It's just a matter of, you know, [00:10:11] they everybody's crossing their tees to [00:10:13] make sure that if, you know, we put in [00:10:17] this amount of time and effort that this [00:10:20] will come to pass because the mixers [00:10:22] don't want to spend astronomical amounts [00:10:24] of money and neither do I. [00:10:28] >> Okay. [00:10:30] >> Mr. Chair, in your packet is a [00:10:32] correspondence from town council [00:10:33] regarding the deed. [00:10:37] read it. What does it say? [00:10:41] >> Yeah, you want to It basically says that [00:10:45] um [00:10:47] their right to revert the property is [00:10:51] expired. [00:10:52] >> It's kind of like the page building, but [00:10:54] it's on the D [00:10:57] >> and the D is in your packet. [00:10:58] >> Okay. So, we had the same exact language [00:11:01] on the page and then we ran into we [00:11:03] couldn't get around it. We had to give [00:11:05] it back to the next, right? So, but the [00:11:08] attorney saying that the their right of [00:11:11] that has expired and whether it has or [00:11:14] hasn't I don't know. It's was mentioned [00:11:20] >> if I remember correctly that's the exact [00:11:21] same thing they said on the page. [00:11:23] Correct. [00:11:25] >> So, [00:11:27] we start an RFP. We'll find out pretty [00:11:31] quick. [00:11:32] >> Yeah. [00:11:32] >> If that's the case. [00:11:33] >> Right. And we don't want to spend a [00:11:35] whole lot of money on label on this. [00:11:37] >> No. [00:11:37] >> At all. [00:11:38] >> Spend a little [00:11:39] >> quite a bit on the page building. [00:11:41] >> Well, that's what I mean. All to find [00:11:42] out that we had to give a building. So, [00:11:45] >> right. [00:11:47] >> So, we make sure that the title is clear [00:11:48] and as you say [00:11:51] and we [00:11:55] need to sit and think of how to put what [00:11:58] to put in the RFP. [00:12:01] So, I guess tonight or if you if you [00:12:05] could tell me which one you want to do [00:12:06] first cuz I if it's 179 or if it's [00:12:10] Rugles, um [00:12:13] just some direction from the board and I [00:12:14] can draft something and I can um have [00:12:17] you guys look at it at at the next [00:12:19] meeting. But I just need to know which [00:12:20] one because I can't do both. I'm already [00:12:22] working on the IT one. [00:12:25] >> So, the title is clear on 179. [00:12:29] >> Yep. Uh Katie um attorney Klein had [00:12:34] >> right that's was a school in the town [00:12:36] and it hasn't moved so [00:12:39] >> right that property has been clear for a [00:12:41] while see [00:12:46] >> so um should we proceed that way come up [00:12:50] with two RFPs before our next meeting [00:12:53] >> I can't do the I can't do both of them [00:12:54] at your next meeting so I have to do the [00:12:56] IT one but I can do one of them for your [00:12:58] next meeting a draft Yeah. [00:12:59] >> Well, let's do the uh uh the Ruggles [00:13:03] Hills Road School [00:13:07] and we have to contact D. [00:13:11] We have to know that we're clear there, [00:13:13] >> right? [00:13:14] Well, [00:13:14] >> I I you know, in what I've I've done in [00:13:18] research, um you can basically piggy [00:13:20] back off of everything you did on the [00:13:22] page without spending any astronomical [00:13:26] amounts of money as long as the board [00:13:29] agrees to do that and votes in favor of [00:13:32] doing that. [00:13:33] >> But we still have to get the okay from D [00:13:36] that it's a legal lot for us to develop [00:13:39] or it's too close to the well. Um, well, [00:13:42] do you want information on that? [00:13:44] >> Because I did that research back 10 [00:13:47] years ago. [00:13:48] >> Does it still hold? Do you think [00:13:50] >> it what the situation is according to D [00:13:53] is that they they don't care. All right. [00:13:57] Um, and [00:14:00] correct me if I'm wrong, the tax maps [00:14:02] cut your well out. The survey from 2014 [00:14:07] does not cut the well out. Okay. Was [00:14:09] there a survey done after 2014, [00:14:13] Justine? Was there one done in the last [00:14:15] couple of years on all of the buildings? [00:14:17] >> Uh, we use Gary Lamper. I don't think [00:14:19] so. [00:14:20] >> Okay. Well, from 2014, it's a dotted [00:14:23] line cutting out the wellwater. When I [00:14:26] talked to D, they said there's a [00:14:29] setback. Okay. at this particular point [00:14:33] when you go by their rules and their [00:14:34] regulations 150 ft if I recall that goes [00:14:39] about a foot into the corner of one of [00:14:42] the building. Um when I talked to DP [00:14:46] they said that um well who wants the [00:14:50] building? Okay. And I I explained to [00:14:52] them what we were going to do. He says [00:14:54] what is going to take place on that [00:14:55] side? I said it's only going to be [00:14:56] gardens. He says, "Would you like me to [00:14:59] take the the setback out of the [00:15:01] building?" I said, "Well, it would be [00:15:02] helpful when I paint the building so I [00:15:04] don't have to ask you for permission." [00:15:06] Okay. So DP said as long as the building [00:15:10] was going to [00:15:12] sit it because it's still within the [00:15:15] zone as long as it wasn't going to be a [00:15:17] auto repair facility. It wasn't going to [00:15:19] do any of the things that they prohibit [00:15:22] in their zone [00:15:23] >> and it was basically going to stay [00:15:26] within the same [00:15:29] general makeup what that building's [00:15:31] always been which is a school because [00:15:33] we're going to do educational things out [00:15:35] of there. They were perfectly fine with [00:15:37] four set back up. They, you know, in my [00:15:41] opinion, and I don't think that the [00:15:43] mixers care at this point, my nonprofit [00:15:47] is ultimately going to get that [00:15:48] building. I am more than happy to argue [00:15:51] with D down the line because I don't [00:15:53] think it's going to be an argument. [00:15:56] um and that the town does not have to go [00:15:59] through whatever they have to do to get [00:16:02] that set back pulled out like 5 ft or 10 [00:16:05] ft. [00:16:07] But that is the situation. It's just a [00:16:09] matter of they because it's in the the [00:16:12] water situation, but I'm going to be in [00:16:14] the same situation. I'm going to be [00:16:15] planting like blueberries and peaches [00:16:17] there and doing organic farming and [00:16:19] gardening in that area. So, I don't want [00:16:22] any problems either, and that's only [00:16:23] going to help the wells, [00:16:26] >> right? Um, still, I'd like to I think we [00:16:31] should investigate a little bit with the [00:16:34] EP and make sure what still goes [00:16:37] >> what you just explained. [00:16:38] >> And I remember Justine saying something [00:16:40] at one of one of these situations that [00:16:43] she had uh talked to D and they were [00:16:46] willing to pull the setback out of the [00:16:48] building. [00:16:50] That's still [00:16:50] >> we have to I'm sorry. [00:16:53] >> We'll do that. We'll call him I'll call [00:16:54] him and and we'll talk to him. [00:16:57] >> Can do you mind if I just pay you back [00:16:59] on this real quick? [00:17:00] >> Sure. [00:17:00] >> Um so any sort of disposition of [00:17:03] property, any sort of real estate [00:17:04] transaction, we need to have our town [00:17:06] council involved. You know, that's, you [00:17:08] know, why we we have them to, [00:17:10] >> you know, advocate for us on our behalf. [00:17:13] Like they work for us. Um, [00:17:17] >> so you're suggesting we get our town [00:17:19] council to talk to DE? [00:17:21] >> No, I'm suggesting that we do our due [00:17:22] diligence as a town. Um, I have contacts [00:17:24] with them, just dealing with them on the [00:17:26] sewer project side of it. Um, but I [00:17:30] highly recommend that we follow the [00:17:32] advice this time from our town council. [00:17:34] I mean, they do this for over 200 towns [00:17:36] in the Commonwealth. You know, reading [00:17:40] these correspondences, I think the board [00:17:42] should take them seriously. [00:17:44] Well, we did take them seriously for the [00:17:47] page building. We spent about what 6,500 [00:17:49] in legal only to give up the page [00:17:51] building. [00:17:52] >> But by the board that wasn't that was [00:17:54] not the recommendation of town council [00:17:56] or court or to go to court and fight [00:17:59] this decision, [00:17:59] >> right? [00:18:00] >> That was the option, [00:18:02] >> right? We didn't know that we had [00:18:03] trouble until we got into it. [00:18:05] >> So, I'm just saying I [00:18:08] >> we already know our legal bills. [00:18:10] >> Yes. [00:18:11] >> Y right. I mean, and I I get it. We want [00:18:15] to take the legal advice, but we can [00:18:18] read the deed. If that restriction's on [00:18:19] the deed, [00:18:22] what do we do? [00:18:23] >> Sounds just like the page, [00:18:25] >> right? So, I I would, you know, I'd [00:18:28] recommend that you actually reach out to [00:18:30] the Mixster Trust and say because [00:18:32] ultimately we're only going to give it [00:18:34] to them and what they do with that [00:18:36] property is the same like they chose to [00:18:38] do with the page builder, [00:18:41] >> you know, cuz once we give it to the [00:18:42] mixer trust, that's it. The town's [00:18:44] >> town. We can't say, "Oh, pass it on to [00:18:48] this person. I'll pass it on to that." [00:18:50] We lose all control over it. But we give [00:18:52] it to them because it's on the deed. [00:18:59] >> Well, let's see the deed. [00:19:00] >> Right. Okay. We'll review it. [00:19:03] >> It's in your packet. [00:19:04] >> Okay. All right. You want to block [00:19:06] together an RFP? [00:19:08] >> I can work on one. I'll draft something [00:19:10] for your next building before our next [00:19:11] meeting. [00:19:12] >> Yeah. [00:19:12] >> And then we'll know what we're talking [00:19:14] about. [00:19:16] >> This was my question though, sir. On the [00:19:18] RFP. [00:19:19] If we can't sell the building, we can [00:19:21] only give it to the next trust. [00:19:23] >> Well, if that's the way that's the deed [00:19:25] is written, [00:19:26] >> right? [00:19:27] >> Right. [00:19:28] >> So then why do an RP? You know what I [00:19:31] mean? We should read the the deed and [00:19:33] and have town council or you know, we [00:19:38] read it and say, is it the same [00:19:39] language? Is are we going to have to [00:19:41] give this back to the next trust? [00:19:44] >> Well, that's the thing. Why do the R [00:19:47] >> cuz if we why do an RFP? [00:19:49] >> Why do the RFP if we're only going to [00:19:51] end up in the same position again? [00:19:55] >> So what do you want to do now? Read the [00:19:57] deed and figure it out. [00:20:00] >> I in my opinion, [00:20:03] you know, with all due respect, Liz, [00:20:06] >> we should be looking at the 179 Main [00:20:09] Street [00:20:11] RFP because that's clear. It's clear [00:20:15] title. We We own the building. [00:20:20] We should [00:20:22] get our ducks more in a row. [00:20:25] Figure out what we want to do with the [00:20:27] Rugles School. [00:20:29] >> I think that's a good idea. [00:20:31] >> Well, we can reach out to D. We can [00:20:33] reach out to the Minister Trust and we [00:20:34] can read the dean and if we have any [00:20:36] questions, we can run by town council. [00:20:38] We don't need to waste our uh [00:20:40] >> right resource of resources to do an RFP [00:20:43] that might not do anything. That's [00:20:46] >> all right. So, we make some calls. We [00:20:48] read the deed. [00:20:49] >> We talk about it at our next meeting and [00:20:51] decide which way we're going to jump. [00:20:53] >> Exactly. [00:20:54] >> So, don't do don't work on something. [00:20:55] Prepare for your next. [00:20:57] >> Okay. [00:20:57] >> Just the Rugles not the Rugles Hill [00:21:00] School, but 179 Main Street. [00:21:02] >> So, you do want a draft of that one. [00:21:04] Okay. I want to make sure I understand [00:21:06] where Okay. Yeah. Don't write up an RFP [00:21:08] for school. [00:21:09] >> Um, Mr. Chair, do you mind if I ask a [00:21:11] quick question? [00:21:12] >> Um, Bill, if you want, I can set up a [00:21:15] call with town council if you want to [00:21:16] talk to them about Rugles in the [00:21:17] meantime, too. Like if to make if you [00:21:20] want to be get more comfortable and get [00:21:22] your head wrapped around what they're [00:21:23] saying. I absolutely don't mind doing [00:21:25] that. You just have to let me know. [00:21:27] >> Okay. [00:21:28] >> Okay. I mean, I'll I'll look at the deed [00:21:30] and everything. [00:21:31] >> I'd like to go through it, too. [00:21:32] >> Right. I haven't had [00:21:34] >> the least we can call town council at [00:21:36] this point. Right. [00:21:37] >> Yeah. [00:21:38] >> I don't [00:21:39] >> Well, there [00:21:41] we're going to have to ask, [00:21:42] >> right? But they're clear, concise, [00:21:44] >> clear, concise questions. [00:21:46] >> Yes, [00:21:48] >> Bill. [00:21:49] >> Thank you. Um, [00:21:52] I'm not 100% sure about this, but I [00:21:54] think that the with the page building, [00:21:58] um, the deed clearly said, you know, go [00:22:02] the mixers have the right to provide for [00:22:03] a dollar. [00:22:05] >> Correct. [00:22:05] >> And there was the question, well, did [00:22:07] that expire or not? I think I think our [00:22:09] town council said that's expired, but I [00:22:11] think the the buyers, the friends of the [00:22:13] page, [00:22:15] um, their attorney or title company or [00:22:18] something said, "No, we We won't accept [00:22:20] that. You won't be able to accomplish [00:22:22] this unless the mixers unless it goes [00:22:25] through their right of first take it for [00:22:28] the dollar and then and then donate. [00:22:30] >> So they did that. I don't think there [00:22:32] was a mixer trust until that [00:22:35] >> need arose. So that so they [00:22:38] >> created among the living beneficiaries [00:22:40] or whatever uh and then transferred in [00:22:42] that fashion. So one question would be [00:22:45] and I guess here you've already looked [00:22:47] at the deed is it is the language [00:22:49] exactly the same? If it is then it seems [00:22:52] like that one of the next questions [00:22:54] would be does the buyer whoever that is [00:22:59] um [00:23:00] are they able to are they [00:23:04] able to take the property and buy the [00:23:08] property without the concern that the [00:23:10] that the friends of the page have? In [00:23:12] other words, does it have to go through [00:23:14] the page through the mixtures at all? [00:23:17] Because I don't I don't think the mixers [00:23:19] would have cared if if it wasn't [00:23:23] the opinion of the buyers that it had to [00:23:25] go that route. So anyway, maybe maybe [00:23:27] you do need that when it if it gets down [00:23:29] to the RFP stage. I would just have this [00:23:31] question. Liz has mentioned how things [00:23:33] in historic district or historic [00:23:35] buildings [00:23:37] um need to be mentioned. Um, so in any [00:23:41] RFP about either of these properties, I [00:23:44] guess that would be part of it. Sort of [00:23:46] do your own diligence, but recognize [00:23:48] that it's in an historic district. Um, I [00:23:52] don't think, I may be wrong about this, [00:23:54] but I don't think that there is any [00:23:56] requirement to have uh sustain [00:24:01] this uh subsidized housing provided in [00:24:05] in a development. [00:24:07] >> Um, doesn't have to be. We we have [00:24:09] essentially none of that in town and it [00:24:11] could continue that way. It puts us at [00:24:13] risk for some other kinds of expedited [00:24:15] developments, you know, that that could [00:24:17] come our way. But, uh, if people know [00:24:21] that and they're looking at an RP, then [00:24:23] I think that they could, you know, could [00:24:26] do their own diligence from there and [00:24:28] maybe come up with an idea. [00:24:30] >> Okay. Thank you. Yes, ma'am. Um [00:24:35] basically um I I understand you know [00:24:39] that you have to do the due diligence. [00:24:40] The deed um says that if the building is [00:24:44] not being used by the town, they have to [00:24:46] go back to the heirs [00:24:48] um and the heirs being the same people [00:24:51] that uh go [00:24:54] you trickle down to the to the next [00:24:56] trust. Okay. Um, and if if this going to [00:25:03] be going this way, um, you know, you [00:25:06] spend $6,500 on the page, why would you [00:25:09] why would you spend anything to fight [00:25:12] something that is going to be, [00:25:16] I mean, kind of a losing battle in some [00:25:18] ways because, you know, [00:25:19] >> well, it was triggered by an offer or we [00:25:23] were in the process of trying to sell [00:25:25] it. [00:25:25] >> Mhm. and found out that that was not the [00:25:27] way to go. So at this point, [00:25:31] >> well, I think you know, [00:25:32] >> we have to most people will look at a [00:25:35] lot of people would look at that deed [00:25:37] from the mixers and it would raise the [00:25:40] same red flags. Okay, I I my nonprofit [00:25:44] is not raising the red flags, okay? [00:25:47] Because um we're not going to mess with [00:25:51] the building or anything like that, [00:25:52] okay? Um and [00:25:55] and wait. [00:25:56] >> You're going to re you're planning to [00:25:59] >> get a hold of this building and fix it. [00:26:02] >> Yeah. We're going to fix it back to [00:26:03] where it's going to look just like it [00:26:05] did before. [00:26:05] >> Renovate it. And you're going to You [00:26:08] were talking community kitchen and [00:26:10] glasses and all sorts of great stuff. [00:26:12] >> Mhm. [00:26:13] >> And there's a group behind you. [00:26:15] >> This is what [00:26:16] >> a group of people behind you to do this. [00:26:18] >> Yes. [00:26:20] >> Okay. I mean, we're already we're [00:26:22] already in the, you know, we've gone and [00:26:24] filed for our 501c3. We're already uh [00:26:28] investigating grants, which, you know, I [00:26:31] can't go and put in yet because I don't [00:26:34] want to have to explain if I have to [00:26:36] give them back, you know. So, um it's [00:26:40] it's that type of situation. I mean, [00:26:42] we're ready, willing, and able to um fix [00:26:46] that building. Same situation. [00:26:49] >> All right. So, we're going to read the [00:26:50] deed. [00:26:52] We're going to contact D. Make sure that [00:26:54] this is still doable. [00:26:56] >> Yep. [00:26:57] >> We're focusing on Rugles Hill Road. [00:27:01] >> I thought it was 179. [00:27:03] >> 179 Main Street in Gilbertville. We're [00:27:06] focusing on for the RFP. [00:27:08] >> For the RFP. [00:27:09] >> Before we do an RFP on this, we have to [00:27:13] figure out [00:27:14] >> I'm going to call D and we'll follow [00:27:16] that down. We'll read the deed and [00:27:20] and we come up with an RFP for the white [00:27:22] building [00:27:22] >> and I'll have it on your agenda for the [00:27:24] next meeting. [00:27:25] >> Okay. Agreeable. [00:27:27] >> Reach. Should we reach out to Mr. Trust [00:27:30] if you'd like? [00:27:31] >> Okay. Sure. You want to do that? [00:27:34] >> Sure. [00:27:34] >> I'll give you the contact. [00:27:36] >> Okay. [00:27:37] >> Um and just just so that Justin just so [00:27:40] you know, there's at least two RFPs that [00:27:41] are already been written for that [00:27:42] building. [00:27:43] >> I've seen I've seen them. Do you mind if [00:27:45] I respond to what Mr. poll said. [00:27:49] >> Thanks. Um, so you're talking about [00:27:51] chapter 40b, which is the um the 10% [00:27:54] that we're required to have for lower [00:27:57] than housing. I actually don't know off [00:27:58] the top made the percentage of what [00:28:00] Hardwick has. Um, [00:28:01] >> less than 1%, [00:28:02] >> but that's a it was stated that it was a [00:28:05] federal law. It's actually a state law. [00:28:07] Um, and we actually that would not be [00:28:10] triggered by someone wanting to come in [00:28:13] and put in condos. So, I just wanted to [00:28:15] make sure [00:28:15] >> condos I don't know. It wouldn't have [00:28:18] isn't attributed by apartments. [00:28:20] >> No, not at all. Um, [00:28:22] >> number of units. [00:28:22] >> No. And just cuz it was um talked about [00:28:26] historic district. Um so when I put [00:28:29] together the one for the RFP for the [00:28:31] page building, I actually worked with [00:28:32] Paula who is very knowledgeable and the [00:28:38] historic nature and the historic [00:28:40] districts and all the facts and [00:28:42] information that she gathered for me. Um [00:28:44] so that I'm sure I'm hoping that you'll [00:28:46] help me with this one too. So yeah, um [00:28:48] that's the historic nature of these [00:28:50] buildings is covered by what I consider [00:28:53] to be an expert. [00:28:58] >> Yeah. [00:28:59] >> One thing chair um you did mention [00:29:04] we we didn't put on an RFP on this [00:29:06] property and that's what happened with [00:29:08] the page by us trying to sell that [00:29:09] property. Excuse me. By us trying to [00:29:12] sell that property is what triggered the [00:29:14] actual reversal. We haven't technically [00:29:17] done anything to trigger that reversal. [00:29:20] >> That's what I was asking. How do we [00:29:21] trigger that? [00:29:22] >> Right. But that's why we just ask the [00:29:24] mixer trust. We we give it to you. Find [00:29:27] out. [00:29:27] >> Yeah. Good. [00:29:28] >> We'll just give it to you and and then [00:29:30] you do what you want to do with that [00:29:32] property. [00:29:34] >> Right. [00:29:36] >> So, it saves us from doing an RFP, [00:29:38] triggering it, and then them showing up [00:29:40] saying, "Hey, we want it." [00:29:41] >> Right. [00:29:42] >> You know that. I think they add to it [00:29:45] anyway. [00:29:46] >> Just make it easy, [00:29:47] >> right? [00:29:48] >> All right. I'm still going to call D. [00:29:49] >> Yep. [00:29:50] >> Oh, absolutely. [00:29:51] >> Yeah. [00:29:53] >> It's a town. Well, [00:29:55] >> town. [00:29:56] >> Yeah. We don't want to give that away. [00:30:01] >> Okay. [00:30:03] Okay. Um, I guess we'll keep going. [00:30:07] Cemetery commission. [00:30:09] >> Which item? There's three of them. Is it [00:30:12] take them in order discussion and vote [00:30:15] on cemetery commission revolving [00:30:18] account? [00:30:23] >> So the cemetery commission has had a um [00:30:26] has a revolving account even before I [00:30:29] went on the commission which was [00:30:31] probably five or six years ago. And in [00:30:34] the revolving account um and I do have [00:30:37] the certification from Ryan. It's this [00:30:40] piece of paper right here. [00:30:41] >> Yep. It's in your packets. [00:30:43] >> Yep. And um so under the cemetery [00:30:46] commission, we can only withdraw $5,000 [00:30:51] of any money that is in the revolving [00:30:54] fund [00:30:56] today. [00:31:02] That would be this piece of paper and it [00:31:06] was from um the town accountant. Today [00:31:09] we have $11,767.36 [00:31:14] in the revolving fund. But in this 26 [00:31:18] fiscal year, we can only spend $5,000 [00:31:23] of that $11,700. [00:31:27] >> Mhm. So, um, we would like we would we [00:31:31] are asking the select then to and the [00:31:34] finance committee to vote that we can [00:31:37] spend up to $11,000 [00:31:40] in this fiscal year, [00:31:43] both the finance committee and the [00:31:45] select, and let the town accountant [00:31:47] know, [00:31:47] >> yes, [00:31:48] >> that we can spend up to $11,000 [00:31:51] in this fiscal year. and at the annual [00:31:54] town meeting because that's the only [00:31:56] time that you can make changes to the [00:31:59] revolving fund unless the finance [00:32:02] committee is selected through the first [00:32:04] fiscal year vote um differently um that [00:32:09] we could spend up to $11,000. When the [00:32:12] town meeting comes, we will ask the town [00:32:14] meeting, we will put it right in the in [00:32:17] our um revolving fund that we're going [00:32:19] to now spend up to $11,000. And just to [00:32:22] let you know, [00:32:26] in prior years, [00:32:28] we have never raised [00:32:31] $11,000 [00:32:34] in a in a fiscal year. That $5,000 limit [00:32:39] that we have had in the revolving fund [00:32:42] has always been enough of money because [00:32:45] that's all that we've earned in that [00:32:47] fiscal year from July 1st to December [00:32:52] 31st of 25. [00:32:55] We earned $11,000. We have had a very [00:32:59] very busy six first six months of this [00:33:05] fiscal year. with deaths, burials, [00:33:09] whether they be cremations or full [00:33:11] burials, as well as monuments, [00:33:15] and ground markers. Because for a [00:33:17] monument or a ground marker, [00:33:20] we require a footing that the people who [00:33:24] own the um the lot have to pay for. So [00:33:28] we have had a a bonus year of a lot of [00:33:32] burials and footings that we have had to [00:33:35] put in. So we have a lot of things that [00:33:38] that we could do at the cemetery. [00:33:41] That's why I'm asking if you could raise [00:33:44] our [00:33:45] um revolving amount to this to $11,000. [00:33:51] >> Bill, but [00:33:51] >> this wouldn't take effect until next [00:33:54] fiscal year. No, it would take effect [00:33:56] once the f the the the um the accountant [00:34:00] has the vote of the selectman and the [00:34:02] finance committee. [00:34:03] >> Okay. So you're looking [00:34:05] >> and I did give you a copy also [00:34:10] >> right here of the of the our town bylaw [00:34:15] which allows the finance committee and [00:34:18] and selectment during the fiscal year to [00:34:21] raise the amount of money that a [00:34:25] committee can take out of the revolving [00:34:28] fund. It's it's right here. [00:34:30] >> Okay. [00:34:33] And just to clarify, Paula, you're [00:34:35] asking for 11,500, [00:34:37] >> right? I'm sorry. That is what it is. [00:34:42] >> Right now. [00:34:44] >> Well, they have [00:34:46] >> Well, all they need is our approval, [00:34:49] >> right? And it's money that we've raised. [00:34:51] I mean, it's not it's not any town money [00:34:53] or anything. [00:34:54] >> So, uh [00:34:55] >> Well, Fin Comm will be here next week. [00:34:58] Yeah. Monday. Could we do it at that [00:35:00] meeting? [00:35:02] >> We could do it right here tonight. [00:35:03] >> We could do it right here right now. [00:35:05] >> Just remind them to do their vote. [00:35:07] >> When do they uh [00:35:08] >> on Monday, [00:35:08] >> next joint meeting? [00:35:10] >> Monday. Does that you guys have your [00:35:12] joint meeting? Um I can talk to the [00:35:14] chair prior to the meeting and make sure [00:35:16] it gets on his agenda as well. [00:35:18] >> Okay. [00:35:20] >> So, do you want to do that? Do our part [00:35:23] tonight. [00:35:23] >> Sure. [00:35:24] >> Okay. I make a motion that we raise the [00:35:27] uh limit that the cemetery commission [00:35:32] can take out of their revolving fund to [00:35:34] $11,500. [00:35:37] >> I'll second a motion. Further [00:35:39] discussion. [00:35:41] Okay. All in favor? [00:35:42] >> I I [00:35:48] your next item, ma'am. [00:35:51] >> The mowing contract. [00:35:54] Um [00:35:56] so um the cemetery commission met and we [00:36:01] voted to award the bid for the mowing [00:36:05] and caretaking of the cemeteries and [00:36:07] comment to Larry Creier in the amount of [00:36:11] $25,500. [00:36:14] That is $1,000 more than what she did [00:36:18] last year. [00:36:21] Um, [00:36:23] and the year before, that was in fiscal [00:36:26] year [00:36:28] 24, [00:36:30] she went down. She was $500 less. Last [00:36:34] year, she she was the same amount, and [00:36:38] this year she's bringing it up to [00:36:39] 25,500. [00:36:42] I did send the RFP out to [00:36:45] some of the local [00:36:48] landscapers in the area [00:36:50] and for the past four or five years [00:36:53] she's been the only one who bids and I [00:36:56] think that the reason that the local [00:36:59] landscapers aren't interested in our bid [00:37:03] is because it's not only the mowing of [00:37:06] the cemeteries common [00:37:09] it's also um picking up all of the [00:37:14] branches and everything that falls [00:37:17] throughout the whole year. If we want to [00:37:20] have grass planted or [00:37:23] anything done to the um lawns that we're [00:37:28] in charge of, they do that. The same [00:37:32] thing with when we have a burial, we [00:37:35] usually leave all of the flowers from a [00:37:37] funeral there for a couple weeks. they [00:37:40] have to come back, pick up the flowers, [00:37:42] and bring them to our [00:37:45] graveyard, for lack of a better word. [00:37:49] Um, also, if for some reason [00:37:53] the people who do our our burial digging [00:37:58] for us are not available, they would [00:38:01] have to come in and do the b do the [00:38:03] digging for the burials. And there's [00:38:06] numerous other jobs. Anyways, the local [00:38:08] landscapers, they just want to come in [00:38:10] and mow and get the hang out and uh that [00:38:13] that isn't what we require. We require a [00:38:15] lot more and they have to use their own [00:38:19] equipment, their own gas. [00:38:22] We don't provide them with anything [00:38:24] whatsoever. [00:38:28] >> Lori Corvier is [00:38:31] going to do all of those things. [00:38:33] >> That's correct. Right. Yeah, we've been [00:38:34] very happy. Yep. And if we haven't been [00:38:38] if there has been a problem, we've just [00:38:40] talked it over and they take care of it [00:38:42] right away. [00:38:43] >> Okay. Okay. That's great. [00:38:47] >> All right. I'll make a motion to award [00:38:50] the uh mowing of cemeteries and common [00:38:53] area contract to Lorie Crevier of Barry [00:38:58] Mass. [00:39:00] >> 25,500. [00:39:02] >> I'll second it. Okay. All in favor? [00:39:05] >> I. [00:39:09] >> All right, we have one more. [00:39:11] >> I have one more. [00:39:13] >> Yeah, we have a an appointment of Frank [00:39:16] Hansen. [00:39:17] >> Right. We've had a vacancy on the [00:39:20] cemetery [00:39:22] for almost a year and a half now. Um [00:39:25] Benny Hansen was the um was a member of [00:39:29] our board [00:39:31] and over this period of time we'd asked [00:39:35] different people to come on board. [00:39:38] People were always hesitant because we [00:39:39] kind of explained to them that we are a [00:39:42] working board. We're the ones who sell [00:39:44] the lots. We're the ones when there's a [00:39:46] burial. We work with the funeral parlors [00:39:50] and mark out where the where the digging [00:39:52] has to take place. [00:39:55] Um [00:39:57] um we take care of all of the money that [00:40:00] comes in depositing it into the um um [00:40:04] various accounts that we have. [00:40:07] Um we're just a working board. And um [00:40:12] >> who else is on it? [00:40:14] >> Jimmy Sweat. Jimmy is the chairman and [00:40:17] I'm the clerk. [00:40:19] >> Mhm. Jimmy's been on the board probably [00:40:22] >> for about eight years now at least. [00:40:24] Yeah. He's been on longer than I have. [00:40:26] >> Yeah. And we both still like it and [00:40:28] everything. And really what we're [00:40:30] looking for is a working member who's [00:40:32] going to who's going to be available on [00:40:34] a Monday or on a Saturday or Tuesday or [00:40:38] or something like that. you know, if [00:40:40] somebody passes away, especially if it's [00:40:42] a full burial, [00:40:44] usually within two or three or 4 days, [00:40:46] they want that burial to happen. So, and [00:40:50] we're busy getting the records out, [00:40:53] measuring to make sure that there's room [00:40:55] for this person in this particular lot, [00:40:58] marking it out, [00:41:01] contacting our the gravedigger, making [00:41:04] sure that the lot that the um hole is [00:41:07] dug for the burial, [00:41:09] closing it up, planting, putting the [00:41:12] lawn down, the loom down, grass seed. [00:41:16] This there's a lot of work, you know. So [00:41:18] we had four people who were interested. [00:41:21] Um and on the weekend before the [00:41:25] cemetery commission met, one of the [00:41:28] gentlemen who was interested called me [00:41:32] to say that he was withdrawing his name. [00:41:35] But Jimmy via the telephone [00:41:39] talked to all four members and told them [00:41:44] what he does his part. [00:41:47] I met with two of those four gentlemen [00:41:51] and they came upstairs to my office and [00:41:55] I went over with them what I do so that [00:41:58] so that they would have a good picture [00:42:00] of what goes on that we do. [00:42:04] So, um, when Jimmy and I met, we just [00:42:06] really felt that, um, Frank Hansen was [00:42:10] going to be the one who was going to [00:42:11] have the time, [00:42:14] um, to put in to work with us, be [00:42:16] available when we need somebody to be [00:42:18] available. So, that's why we we voted [00:42:21] unanimously to bring his name up before [00:42:24] the board of selectment. [00:42:27] >> Thanks, [00:42:30] Standing. Yeah, right. I I have no [00:42:32] issues that I uh I make a motion to [00:42:36] appoint Frank Hansen as the third member [00:42:38] of the Hardwick Cemetery Commission. [00:42:42] >> Seconded. [00:42:46] >> All in favor? [00:42:47] >> I [00:42:48] >> Thank you, gentlemen. [00:42:49] >> Thank you. [00:42:49] >> Thank you, Mayor. [00:42:55] >> Mr. Chair. [00:42:56] >> Yes. [00:42:57] >> Paul's here. Can I ask one question? [00:42:59] >> Absolutely. I was just a little [00:43:00] uncertain about what you're saying about [00:43:01] the annual town meeting and the now [00:43:04] increased $11,000 that the commission [00:43:07] take out. Well, here's the question. Oh, [00:43:10] sure. So, the the motion was to do that [00:43:12] for this current fiscal year and then [00:43:14] also at the at the end meeting you would [00:43:17] >> this would [00:43:20] confirm the vote of the board of select [00:43:22] new finance committee, right? and it [00:43:24] would leave our [00:43:26] our um limit from from the annual town [00:43:32] meeting forward at $11,000 even if we [00:43:35] didn't raise $11,000. [00:43:38] But we would be able to spend up to [00:43:40] $11,000 in our revolving fund. [00:43:43] >> You're not needing to spend that money [00:43:45] in this fiscal year. You are this year [00:43:48] before that. [00:43:49] >> Absolutely. Oh yeah. [00:43:52] >> What do you What do you intend to spend [00:43:54] it on? I know that it's late. We would [00:43:56] like to um take out some more [00:44:01] um stumps [00:44:04] that whenever it seems in the past [00:44:08] whenever a tree came down whether the [00:44:11] cemetery commissioners, not us, but [00:44:14] prior cemetery commissioners had a tree [00:44:16] taken down or if because of the weather, [00:44:19] winds and everything, a tree fell, [00:44:22] they would have the tree removed. the [00:44:26] fallen tree removed, but they would [00:44:27] leave the stumps there. And so that is [00:44:31] something that we're going to do is take [00:44:33] out some more stumps. [00:44:35] Also, some more trees. We would like to [00:44:38] have some more trees taken down, [00:44:40] chipped, and the stumps removed. Also, [00:44:44] um, and I know you're not going to know [00:44:45] where I'm talking about, but anyways, in [00:44:47] section 10 along the stone wall, um, [00:44:51] we're hoping that we're going to have [00:44:54] enough of money to have somebody come in [00:44:57] with the right equipment and dig all of [00:45:00] that up and then plant grass and make it [00:45:03] nice and level so that we would be able [00:45:06] to sell that particular area [00:45:11] for um, burial plots. [00:45:14] >> Okay, thank you. [00:45:15] >> And then we had, you know, there's some [00:45:17] of the areas of the grass area that [00:45:20] really need some attention with the [00:45:23] right kind of fertilizer and ant [00:45:27] removal, whatever you do and and and [00:45:30] more um grass planting. [00:45:32] >> There's plenty nothing has ever been [00:45:34] done at that cemetery. Nothing, you [00:45:37] know. [00:45:38] >> So, we're just trying to pick out the [00:45:41] the biggest things. Sometimes a stone [00:45:43] pillar gets knocked over in a tornado [00:45:45] and has to be repaired, [00:45:46] >> right? You know all about that. Yeah. So [00:45:49] >> great. Mhm. [00:45:50] >> Okay. Thank you. Thank you. [00:45:52] >> Yeah. Do you want me to leave you a copy [00:45:54] of it just a better understanding? Okay. [00:45:56] I'm going to make a copy of it and I'll [00:45:58] leave it in the planning board though. [00:45:59] >> Okay. Good. Thank you. [00:46:01] >> Last last item of new business is uh to [00:46:04] vote and sign the May 2nd, 2026 election [00:46:09] warrant. [00:46:10] >> Mr. Chair, the recommendation of the [00:46:12] town clerk is that polls should be open [00:46:14] from 10 to 6:00 on May 2nd. Um we have [00:46:17] two contested races um board of health [00:46:21] and select board. Um so at your pleasure [00:46:24] if you vote um I do have the warrant [00:46:27] available for you to sign tonight. [00:46:30] >> I make a motion that we sign the uh May [00:46:32] 2nd election warrant. [00:46:35] Second. [00:46:40] All [00:46:40] >> in favor. [00:46:49] >> We just second it. So I don't need to [00:46:52] talk over. [00:46:55] >> Okay. [00:46:55] >> Thank you. [00:46:59] >> I can't make a move. [00:47:04] Those [00:47:23] are their comments. [00:47:29] Okay. [00:47:34] minutes. [00:47:37] >> So I just so the board is aware I put [00:47:39] them in order not necessarily as of [00:47:42] received but just in order in terms of [00:47:43] date uh with regular session first and [00:47:46] executive second. So just nowhere. [00:47:54] >> Uh the [00:47:57] executive session minutes are [00:48:01] pretty much all [00:48:04] um contracts, [00:48:07] Ziko, [00:48:09] page building stuff and we can deal with [00:48:12] that because that's all complete. Uh the [00:48:15] um workplace complaint is it's [00:48:19] >> not typed up yet anyway. [00:48:21] >> Town council suggested but we can't drag [00:48:23] that out uh into the daylight yet. I [00:48:26] will double check that and get it in. [00:48:29] >> Okay. I I I have it on my computer, but [00:48:33] I haven't finished typing the minutes [00:48:35] out anyway. [00:48:37] >> That would be only you and me anyway. [00:48:42] >> All right. July 14th, [00:48:46] >> 2025 [00:48:48] taking this printed few minutes. [00:48:49] >> Yeah, just real quick on the executive [00:48:51] session part of it. Um, [00:48:55] you know, on some of the stuff, we [00:48:57] should be meeting in the executive [00:48:58] session to go over these meeting minutes [00:49:00] and approve them and decide what whether [00:49:03] we're going to make them public or not. [00:49:05] >> You want to do that? [00:49:05] >> Because because if they're confidential, [00:49:08] we haven't we haven't done a vote to [00:49:10] this board to release them, [00:49:12] >> right? or approval. Well, I checked [00:49:15] today and it's [00:49:18] some of the stuff we can't do that with, [00:49:20] but the other is done. [00:49:23] >> Okay. [00:49:23] >> And out in the open. [00:49:25] >> So, we can proceed, but [00:49:26] >> Okay. [00:49:27] >> We can also hold off if you want. [00:49:29] >> No, I'm just saying, you know, I'm just [00:49:31] bringing it to your attention, Mr. [00:49:33] Chair. That's all that you know on some [00:49:35] of these that are still confidential we [00:49:37] should have an executive session to [00:49:38] discuss and approve the meeting minutes [00:49:40] whether they remain confidential you [00:49:42] know what I mean [00:49:43] >> and the only ones that are confidential [00:49:45] are as far as I know uh the ones about [00:49:49] the workplace complaint the rest of it [00:49:52] is I mean the Ziko stuff that's up and [00:49:56] out and done okay so it's not it's not [00:50:00] really confidential the other is to [00:50:02] protect private I see. So, [00:50:04] >> so you can approve executive session [00:50:06] meeting minutes in open session. If [00:50:08] there was something that you wanted the [00:50:09] executive session for, you just have to [00:50:10] let me know. But the ones that are [00:50:12] provided in tonight's um tonight's [00:50:15] meeting can be approved and open. [00:50:17] >> Yes. [00:50:20] >> All right. Well, [00:50:22] >> you want to start us off? [00:50:24] >> Sure. [00:50:28] Um July 14th, 2025, [00:50:32] New Branchry Town Hall. [00:50:35] I reviewed it. I have no issues with it. [00:50:38] You, sir, [00:50:39] >> I reviewed it as well. I have no issues [00:50:42] with it. I'll make a motion to approve [00:50:45] meeting minutes for July 14th, 2025. [00:50:49] >> I'll second a motion. All in favor? I I [00:50:59] October 1st. [00:51:00] >> October 1st. [00:51:04] Let's see. [00:51:05] As well, [00:51:08] I don't have any issues with that, sir. [00:51:11] Neither do I. I'll make a motion we [00:51:13] approve October 1st, 2025 meeting [00:51:16] minutes. [00:51:17] >> Seconded. [00:51:18] >> October 1st. [00:51:20] >> Yes. [00:51:22] All in favor? [00:51:23] >> I I [00:51:25] Okay. October 27th, 2025. So, this is I [00:51:30] do have issue with this. Um, doesn't [00:51:34] include the executive session, the roll [00:51:36] call vote, any record of us going into [00:51:39] executive session in the record. [00:51:42] >> It also has numerous misspellings, [00:51:46] >> right? Yeah, we should probably table it [00:51:48] and then make the corrections and [00:51:50] >> I'll agree to that. [00:51:52] >> Okay. So, we'll table October 27th. [00:51:59] Um December 16th. [00:52:04] Excuse me one second. Just find it. Um [00:52:08] that one we just have to amend because [00:52:12] that one that it's a new brain tree. [00:52:15] Yeah, [00:52:15] >> Jeff, you were not at that meeting. [00:52:18] >> You are correct. [00:52:19] >> Right. So, you were listed and you [00:52:22] actually did a motion in that meeting. [00:52:24] So, I amend like I recommend we amend. [00:52:27] Strike Jeff is absent. And [00:52:31] I believe I made the motion. You second [00:52:33] the motion, Mr. B. [00:52:35] >> So, if we make the amendment, we approve [00:52:38] it. [00:52:38] >> Okay. [00:52:39] >> That one was completely me and that's my [00:52:40] fault. Okay. [00:52:42] >> I move that. No, I can't. [00:52:45] >> So, okay. I move that we approve [00:52:48] December 16th, 2025 meeting minutes as [00:52:51] amended. [00:52:52] >> Yes. [00:52:52] >> Second. [00:52:54] >> I can't [00:52:57] f [00:52:59] >> Okay, [00:53:00] >> that one was on me. [00:53:02] >> Okay, so January 28, 2026. [00:53:06] Um, no similar thing. We should table [00:53:09] this because there's no executive [00:53:11] session roll call vote um attendance [00:53:14] >> spellings and [00:53:15] >> grammar so yeah [00:53:18] >> so what are we going to do with these? [00:53:19] We're going to put them into a executive [00:53:21] session meeting and go over whatever we [00:53:24] can't [00:53:26] digest. [00:53:27] >> No, I'm just saying in the in the [00:53:29] meeting minute record itself, [00:53:30] >> right, [00:53:31] >> didn't list the role called vote to go [00:53:33] into executive session. It's not the [00:53:35] executive session. It's the public [00:53:36] record, [00:53:37] >> right? So we just have to add that item. [00:53:39] >> Yes. [00:53:40] >> And then we have numerous I was noticing [00:53:44] >> I looked at both these last two tables [00:53:47] meeting minutes and there are numerous [00:53:49] misspellings, grammatical errors. [00:53:52] >> Yeah. [00:53:53] >> Uh yeah, I I'd love to have the [00:53:56] opportunity to go through and redline [00:53:58] them as I'm sure Bill does and [00:54:00] >> Okay. [00:54:01] >> So we table it to the next meeting, make [00:54:03] the changes and approve it. May 28th. [00:54:06] Yes. [00:54:09] >> Okay. February 18th. [00:54:11] >> February 18th. [00:54:16] I went through it [00:54:22] before I did not get [00:54:37] still the spelling errors in this one [00:54:39] too. [00:54:39] >> Yeah, it's just and and also I mean like [00:54:43] um yeah like Jeffrey Schmidt Jeffrey [00:54:46] Smith [00:54:47] >> um stuff like that [00:54:49] >> scheme is also [00:54:50] >> Yeah. Yeah, that's hacked pretty good. [00:54:53] >> All right, [00:54:54] >> we should table it. [00:54:56] >> All right, table make changes and then [00:54:58] approve it. Um, and we probably just [00:55:00] have to add a couple like if if we want [00:55:03] deep I don't know how detailed we want [00:55:05] to be, but who made the motion and a [00:55:07] vote. [00:55:08] >> That's all we really need, [00:55:09] >> right? [00:55:10] >> And what the motion was. [00:55:12] >> Yeah. We just got to add that in here [00:55:13] and there on on February 18th, 2026. [00:55:19] >> So, we'll table that. [00:55:23] March 4th, I'm okay with. I have no [00:55:25] issues unless somebody else does. [00:55:33] All right. Um, [00:55:36] >> I have no issues with it as well. I'll [00:55:40] move to approve the meeting minutes for [00:55:42] March 4th, 2026. [00:55:46] >> Second. [00:55:49] All [00:55:49] >> in favor? [00:55:50] >> I [00:55:56] >> March 9th. [00:55:58] don't have any issues. [00:56:00] >> Same here. Uh move to uh approve meeting [00:56:03] minutes for March 9th, 2026. [00:56:07] >> Second. [00:56:09] In favor? [00:56:10] >> I I [00:56:11] >> So after tonight, I will go and I'll [00:56:13] update the list to see where we are and [00:56:15] I'll send the board an update if what's [00:56:17] still outstanding. [00:56:18] >> Okay. [00:56:20] >> I was waiting to see what was approved [00:56:21] tonight before I went ahead and did [00:56:23] that. Yeah, that's good. [00:56:24] >> And we're not doing the executive [00:56:28] session minutes or are we? [00:56:32] >> You think you're comfortable with them? [00:56:35] >> I'm comfortable with them. I typed them [00:56:37] up. [00:56:42] >> Would you like to make a motion? [00:56:43] >> I'm going to let Bill look at it first. [00:56:46] I don't want to presume he's got no [00:56:49] issues with them. [00:56:53] Some of them are short and sweet. [00:56:56] >> Well, like June 9th, I recuse myself. [00:56:58] So, you guys [00:56:58] >> Oh, yeah. All right. [00:57:00] >> So, that's between the two. [00:57:01] >> I'll make a motion to approve the uh [00:57:04] executive session meeting meeting [00:57:06] minutes for June 9th, 2025. [00:57:08] >> I'll second it. All in favor? [00:57:11] >> I. [00:57:11] >> And you're abstaining? [00:57:12] >> Yes. [00:57:18] >> Now, October 14th. Yep. I don't have any [00:57:22] issues with it. [00:57:24] >> We'll move to approve the executive [00:57:28] session meeting minutes for October 20 [00:57:30] 14th, 2025. [00:57:32] >> Second. [00:57:34] All [00:57:34] >> in favor? [00:57:35] >> I [00:57:41] October 27th, 2025. [00:57:46] >> Anything, Bill? [00:57:47] >> Um, [00:57:49] yeah. [00:57:50] >> Okay. There was there was um [00:57:54] so it says, you know, I made the thing [00:57:56] that I recommended that the contract was [00:57:58] invalid. [00:58:00] Well, we needed us to amend and add [00:58:02] because there was no public vote made by [00:58:05] the select board. That was my statement. [00:58:09] Sound red. [00:58:12] All right. No public vote. [00:58:14] >> Yeah. [00:58:17] >> Where is it? [00:58:19] It's It says William Tinker states the [00:58:21] contract is invalid and the select board [00:58:23] did not vote to sign the contract. [00:58:26] >> Well, right. We did not We did not do a [00:58:28] public vote. [00:58:31] >> Did not have [00:58:32] >> Well, have a public vote. [00:58:33] >> Did not have [00:58:36] >> I make that amendment. [00:58:37] >> I can make that amendment before I post [00:58:39] them. [00:58:39] >> And I'm I'm just writing it down here. [00:58:42] >> I'll make a motion to approve October [00:58:44] 27th executive session [00:58:46] >> as amended. as amended. [00:58:48] >> Second. [00:58:48] >> I'll second. [00:58:49] >> Okay. All in favor? [00:58:51] >> I [00:58:58] November [00:58:58] >> November. [00:59:00] >> November 10th, [00:59:02] 2025. [00:59:08] >> And and I just make the same amendment. [00:59:10] There was my statement was there was no [00:59:13] public vote on the board. That's all. [00:59:15] >> Okay. [00:59:17] It's the same thing. Yeah, because I [00:59:18] just copied it right over. It was the [00:59:20] same thing. [00:59:23] >> So, I'll make a motion to approve [00:59:25] November 10th, 2025 [00:59:27] uh with that amendment. [00:59:29] >> I'll second. All [00:59:31] >> in favor? [00:59:32] >> I [00:59:33] >> I recruiting. [00:59:35] >> Yeah, we are. [00:59:36] >> This is This is not as painful as I [00:59:38] thought it would be. [00:59:40] >> Maybe. Don't you? [00:59:42] >> Yeah. [00:59:43] >> November 24th. November 24th, 2025. [00:59:48] Let's see. Bill Tinker was not at this [00:59:51] one. [00:59:52] >> Right. I was not at this and I don't see [00:59:54] um I don't know if the the public one, [00:59:56] but I I recuse myself. [00:59:58] >> You recused yourself? [00:59:59] >> Yes. [01:00:00] >> But uh our Zoom meeting was cancelled [01:00:02] anyway. [01:00:03] >> And there's also another executive [01:00:06] session for that same date, November [01:00:07] 2024. [01:00:09] >> Yes, there is. I I have that on my [01:00:11] computer at home. It's not part of [01:00:14] >> what I've submitted yet. [01:00:16] >> Okay. [01:00:16] >> Because that is the personnel issue. [01:00:20] >> Okay. [01:00:21] >> But for the other the 24th is [01:00:25] >> Yeah. This is the one at 6:05 or 6:00 [01:00:28] was when it was supposed to start. So, [01:00:30] I'll make a motion to uh approve the [01:00:33] November 2024 [01:00:36] uh meeting minute executive session [01:00:39] meeting minutes [01:00:41] uh for the 6:00 executive session. [01:00:45] >> I'll second it. All [01:00:47] >> in favor? [01:00:48] >> I [01:00:54] see the wind report. Would you like to [01:00:59] um do your report? [01:01:00] >> I'd love to. Thank you. Um so I've been [01:01:05] meeting with Mark Corzac from the [01:01:07] finance committee on the FY27 budget. [01:01:09] Really getting the hoping to get the [01:01:11] finance committee a really good grasp on [01:01:13] where we are with our debt and how where [01:01:15] we were and how we got here and what [01:01:17] we're doing now. And u I think it's been [01:01:20] really helpful um especially going into [01:01:22] those joint meetings. So I have another [01:01:23] meeting with him tomorrow. [01:01:26] Um we had two public records appeals and [01:01:28] one new public records request. Met with [01:01:31] um the highway superintendent and Harry [01:01:33] Cmerford today on the excess gravel near [01:01:35] Roach Field. So for your next meeting um [01:01:39] there's going to be an item to for the [01:01:41] board to declare that gravel surplus so [01:01:43] we can start the next process um which [01:01:46] is um getting money for our excess [01:01:49] gravel. So um look for that on your next [01:01:51] agenda. [01:01:53] had a call with Central Mass Regional [01:01:54] Planning Commission um and Chairman [01:01:57] Wallheim on the MVP grant project of the [01:02:00] town of Harston. So, we got two bids [01:02:03] back for the project and right now we [01:02:06] are in the process of uh doing the [01:02:07] evaluation for which one we're going to [01:02:09] go with. [01:02:11] Uh met with the police chief, the fire [01:02:12] chief and fire chief from New Brainree [01:02:14] regarding the regionalization [01:02:15] possibility uh with the fire departments [01:02:17] between the two communities. Um, so [01:02:20] everything will be prepared for your [01:02:21] next joint meeting which is next [01:02:22] Thursday at six o'clock. [01:02:25] >> Yeah. [01:02:26] >> Yes. [01:02:28] >> Um, met with Barry on the senior center [01:02:30] regional agreement and shocker. I [01:02:32] actually um invited chair uh Sman Tanker [01:02:36] because I really wanted a member from [01:02:38] the board present because I feel like [01:02:40] every time I walk into a meeting with [01:02:42] Barry, it gets very contentious around [01:02:44] money. So, I really wanted a member of [01:02:45] the select board there um because that's [01:02:48] ultimately going to come up before the [01:02:49] board. So, it just made sense to have [01:02:52] everyone [01:02:53] um be informed that way. We are [01:02:56] advertising for a wastewater treatment [01:02:57] plant operator, a highway equipment [01:02:59] operator, and a van driver. We had one [01:03:01] of our highway employees quit the other [01:03:03] day. So, we are not just under staff, we [01:03:06] are under staff now twice. Um we held [01:03:09] our annual mandatory department head [01:03:11] training. This year's training was on [01:03:13] prioritizing and managing a [01:03:15] multigenerational workplace. We had our [01:03:17] insurance company, Maya, come in and do [01:03:18] the training. [01:03:20] Um, all the department heads were there [01:03:22] and assistant department heads. It was a [01:03:23] really good turnout and I think um, for [01:03:25] the most part, everyone really enjoyed [01:03:26] it. [01:03:28] I attended the Massachusetts Municipal [01:03:30] Managers Association conference on risk [01:03:32] management for town managers, [01:03:33] administrators, and navigating personnel [01:03:36] problems and legal landmines. [01:03:38] Um, just a fun little tidbit, I've been [01:03:42] elected for the fourth year in a row to [01:03:43] the Massachusetts Education and [01:03:44] Government Association. Uh, we [01:03:46] specialize in workers comp for [01:03:48] municipalities and school districts. Um, [01:03:50] so I've been elected for the fourth [01:03:51] time. Um, I attended a quab watershed [01:03:54] meeting. [01:03:56] Um, for recognition, I want to recognize [01:03:59] three of our firefighters that graduated [01:04:00] the fire academy. [01:04:02] Firefighter Christian Lul, firefighter [01:04:05] Kevin Thompson, and Joel Ek. and [01:04:08] firefighter Thompson also received the [01:04:10] outstanding student award. [01:04:12] >> Excellent. [01:04:13] >> Yeah, he's a friend friend of my sons. [01:04:16] >> Good job. [01:04:18] >> Um, important dates. Representative [01:04:20] Bertham and Senator Durant are holding [01:04:21] their April office hours here on April [01:04:24] 7th from 10 to 11 and our [01:04:30] annual town election is May 2nd. So [01:04:33] that's what I have tonight. Mr. Mr. [01:04:34] Chair, question. [01:04:36] >> Yes, sir. [01:04:37] >> I didn't hear anything in the town [01:04:38] administrator's report regarding the [01:04:40] town accountant passing or not passing [01:04:42] the test that she was taking that was [01:04:44] talked about in the last meeting. [01:04:45] >> She doesn't know. I don't know. I wasn't [01:04:47] I haven't seen her. I was at my [01:04:49] conference last week. I was [01:04:50] >> hoping for an update. Okay. [01:04:52] >> Thank you. [01:04:55] >> Round table. [01:04:57] >> I have nothing at the moment. [01:05:03] >> Round table. [01:05:04] Um, for the most part this week I I'm [01:05:07] not going to really mention anything. [01:05:08] Um, I'll mention that at the next [01:05:10] meeting once I have some answers on some [01:05:12] stuff. That's all. Okay. The uh grant up [01:05:18] at the old town hall is uh uh hurting. [01:05:23] Uh we couldn't get any bids. [01:05:26] Um we didn't get any interest. Well, we [01:05:30] did a walk through. [01:05:32] Um, the first time, [01:05:35] not very many people showed. Second time [01:05:38] we had five or six contractors running [01:05:42] around. And, uh, and this last week we [01:05:47] had another walkth through and nobody [01:05:49] showed at all. So, um, DBPC is breaking [01:05:53] it up, [01:05:54] uh, and trying to contact people who [01:05:58] asked for plans, [01:06:01] >> but it's not looking too wonderful. [01:06:07] >> Do you have a feel for why it's [01:06:11] >> I don't [01:06:14] I'm not really familiar with the scope [01:06:16] of work or what you're trying to do up [01:06:18] there. Okay. gutters. Uh originally [01:06:22] rebuilding windows, [01:06:25] storm windows, gutters. [01:06:28] The front [01:06:30] where the stone the portico [01:06:33] is uh years some years ago it was dug [01:06:37] out for an inspection by some [01:06:41] architectural [01:06:42] historical something [01:06:45] and they took out clay and they replaced [01:06:48] it with sand. So now it at that portico [01:06:53] the stones that are laid there [01:06:56] the water just goes right in goes down [01:06:58] into the cell. [01:06:59] >> So the scope didn't include that. It [01:07:04] included patching the stones at the [01:07:08] surface level with you know cement. [01:07:11] >> Yep. [01:07:12] >> So that's pretty much it. Paint the port [01:07:16] the cupula. Okay. So, my thinking, and [01:07:20] it's just an idea or a thought, you [01:07:22] know, is can we use some of this grant [01:07:25] money and offer employees in this town [01:07:28] to say do the gutters and pay them time [01:07:30] and a half, but do a Friday, do a [01:07:33] Saturday. We bring in a gutter guide and [01:07:35] make the gutter right on site and they [01:07:37] hang it with a box truck. [01:07:38] >> It's an excellent idea. [01:07:41] No, we'll find out. [01:07:42] >> Okay. [01:07:48] And then you know other areas like you [01:07:50] know you mentioned the sand like dig out [01:07:51] the sand fill it with clay [01:07:55] >> you know [01:07:55] >> that would be pay all these people time [01:07:58] and a half you know I mean basically [01:08:00] we'd be asking Marty and his guys if [01:08:03] that would something they want to do but [01:08:04] we and we could put it out to the water [01:08:06] guys as well. I mean, any employee [01:08:08] that's filing will do some [01:08:10] >> better tradesmen in in town, they're [01:08:13] largely busy, but the grant expires in [01:08:17] August. So, [01:08:18] >> right. So, the more more we can do, [01:08:20] >> it's just a suggestion. [01:08:21] >> No, I'll check with with the uh [01:08:24] controllers. [01:08:25] >> Okay. [01:08:30] >> Anybody else? [01:08:32] >> If I may, Mr. Yeah, the uh I just want [01:08:35] to learn what kind of went wrong in this [01:08:37] process so we can maybe avoid it next [01:08:39] time. Would it be fair to say that the [01:08:44] original scope of work that was bid with [01:08:46] PBPC was [01:08:49] >> was um [01:08:50] >> too large, [01:08:51] >> too expensive. I mean, we we were not [01:08:53] really going to get something that came [01:08:54] in at $95,000 or less. And then you're [01:08:58] we're unable or the PBPC is unable to [01:09:01] like at that time adjust it and say, [01:09:04] "Well, how about you just do half of the [01:09:06] work for for half of the money that you [01:09:08] that you bid." I mean, [01:09:09] >> well, that was tried. They chopped it up [01:09:11] >> and they can't and that doesn't work, [01:09:13] right? So, you can't [01:09:15] >> parcel it up or [01:09:16] >> Yeah, they they broke it down and it [01:09:18] would have been possible this last time [01:09:22] to do pieces of it, but not. So, [01:09:27] and I wasn't involved in the original [01:09:31] scope of work or the clay sand thing [01:09:35] would have kind of a fixed cuz that's [01:09:38] probably the easiest thing to part. [01:09:41] But, yep. So, hoping for a fix and I'll [01:09:45] check that out. Try to get some room for [01:09:49] local tradesmen. Okay. [01:09:54] >> Anything else, Mr. Chairman [01:09:56] >> looking for a motion to adjurnn. [01:09:58] >> So moved. [01:10:00] >> Second. All in [01:10:01] >> favor. All right.
